other phone except an iphone.

I've done trekking some months ago in Karnala, trekked uphill with
friends, but felt downhill was a bit riskier, so partially came down
with friends, and partially with our trekking instructor. It was a
 good experience, totally doable.
I had done horse riding some years ago, when I was fairly sighted, I
can't remember any part where you'd need sight. I simply had to hold
onto the horse, and the rest would be done by it and its trainer.
 Totally doable again.
Quite some time ago, someone shared an news article, where a couple of
visually impaired people (a few of them are on this list) had done
some serious trekking/climbing, hope one of them shares their
 experience here.
By the way, a question from me, I had heard, I may be totally mistaken
because I'm absolutely unsure, but had heard that there was a blind
person who had climbed the 17 highest peaks in the world? Is something
like this actually true, if so, could you share that mountaineer's
name, and any related information, would be interesting.

 you
please share your experiences and any tips whatsoever?

Vivek,
I guess you may be new to the list. Wanted to suggest you routing dowager
piracy is not a healthy practice. In fact, since you are writing on a public
domain, it spoils your own credibility as the posts are publicly archives.

Instead looking for piracy copy, you should get started with NVDA a free, open
source and powerful screen reader. Let FS realize that they loose customers due
to the cost. NVDA can be downloaded from NVDA-project.org

2011-06-16 Thread mukesh jain
Hello mr. Sanjay,
Your warm welcome on the list. I am glad to see one of my classmate on
the list. I hope that you will have good amount of learning from this
knowledgeable portal serving the VI community at national as well as
global level.

Before replying to your mail, I would like to just add some of the
bright success achieved by mr. Sanjay. He had scored 61% in his ll.b.
in 2001 and stood first in Government Law Colege, mumbai. In ll.m. he
was honored as gold medallist by the Mumbai University securing third
top position in the University.

Now, coming back to your mail, I have one good article on the
captioned subject wich may help you to answer some of your queries. I
am reproducing below the said article.

Articles : Access to Justice- New Challenges : Lawyers Indian Public

“Access to justice” in its general term, means that individual’s
access to court or a guarantee of legal representation. It has many
fundamental elements
such as identification and recognition of grievance, awareness and
legal advice or assistance, accessibility to court or claim for
relief, adjudication
of grievance, enforcement of relief, of course this may be the
ultimate goal of a litigant public.

The concept of ‘access to justice’ has two significant components.
First is a strong and effective legal system with rights, enumerated
and supported by
substantive legislations. Other is a useful and accessible judicial/
remedial system easily available to the litigant public.

The Constitution of India is the living document of this Country and
the basic law of this Nation. As disclosed in its preamble, it stands
for securing
justice to all the Citizens. In Article 39A, the Constitution retains
its aspiration to secure and promote access to justice, in following
terms

“ The State shall secure that the operations of the legal system
promote justice, on the basis of equal opportunity, and shall, in
particular, provide
free legal aid, by suitable legislation or schemes or in any other
way, to ensure that opportunities for securing justice are not denied
to any citizen
by reason of economic or other disabilities”.

Access to justice is recognized as a prominent and fundamental right,
in several international documents. In India, the National Commission
to Review the
Working of Constitution (NCRWC), constituted in the 50th year of
Independence, in its final report suggested for incorporation of this
right as fundamental
rights by incorporating Art.30 A, in the Constitution, in following terms,

30 A. Access to Courts and Tribunals and Speedy justice.-
(1) Everyone has a right to have any dispute that can be resolved by
the application
of law decided in fair public hearing before an independent court, or
where appropriate, another independent and impartial tribunal or
forum.

(2). The right to access to courts shall deemed to
include the right to reasonably speedy and effective justice in all
matters before the courts,
tribunal or other for and state shall take all reasonable steps to
achieve the said objectives.

The identification and recognition of one’s grievance has a direct
co-relation to his right. This bundle of rights includes natural
rights or basic and
human rights, fundamental rights, other constitutional rights and
statutory rights.

Identification and protection of these rights, especially that of the
poor and disadvantaged people must be the chief concern, while
formulating the principles
of access to justice.

Apart from the Universal Declaration of Human Rights, the Constitution
of India, guarantees, fundamental rights in its Part III, from
Articles 14 to 32.
This includes, right to equality, freedoms, right to life, religious
rights, minority rights and finally the special right which guarantees
constitutional
remedies in cases of infringement of fundamental rights. Though these
rights are not absolute, but protected under Article 13 of the
Constitution, which
expressly prohibits enacting of law inconsistent with or in derogation
with fundamental rights. Additionally, any action abridging the
fundamental rights
are subject to inherent or implied limitation, as per the Doctrine of
Basic Structure or Basic Features.

There are other sets of rights guaranteed as per the express
provisions in the Statutes. Right of representation in elected bodies,
right to maintenance,
right to minimum wages, right to social security, right to vote are
some of such rights. In India, there are number of statutes dealing
with these special
kinds of rights, such as Representation of Peoples Act, Minimum Wages
Act, Provisions for Maintenance under Section 125 of the Code of
Criminal Procedure,
Social securities under Workmen’s Compensation Act, Industrial
Disputes Act, Employee’s Provident Fund and Miscellaneous Provisions
Act, Payment of Bonus
Act, Payment of Gratuity Act, Employees State Insurance Act etc.

Our country is a secular ad democratic republic. Rights of different
religious peoples and that of

The question as to whether the access to justice is a constitutional
right, a statutory right or a common law right was debated in
different jurisdiction in different manner. Whereas the Supreme Court
of India in Tamilnad Mercantile Bank Shareholders Welfare Assn. (2) v.
S.C. Sekar reported in (2009) 2 SCC 784 has held that access to
justice is a human right which in certain situations, may also be
considered to be a fundamental right, the question with regard to the
constitutional aspect of the matter vis-à-vis the power of judicial
review had been considered in many cases.

In Arunima Baruah v. Union of India, reported in (2007) 6 SCC 120, it
was held thatOn the one hand, judicial review is a basic feature of
the Constitution, on the other, it provides for a discretionary
remedy. Access to justice is a human right.

A person who has a grievance against a State, a forum must be provided
for redressal thereof. (See Hatton vs United Kingdom. For reference
see also Zee Telefilms Ltd. v. Union of India.)

The evolution of the law in this behalf although sporadic but on a
positive note. The judiciary acts as a defender of individual
liberties wherever a person raises a concern with regard to violation
or protection of his right, the Court shall step in. Even an accused,
be terrorist or otherwise has the right to approach the court of law.
In R v Secretary of State for the Home Department, ex parte Leech
reported in [1994] Q.B. 198, Steyn LJ said ''It is a principle of our
law that every citizen has a right of unimpeded access to a court''.
Further in Raymond v Honey [1983] 1 AC 1, Lord Wilberforce at
described the right of access to the courts as a ''constitutional
right''.

Laws, J in R v The Lord Chancellor, ex p Witham, [1997] 2 All ER 779
after discussing various decisions including Ex parte Leech (supra)
equated the right to access to justice to the right of speech and
expression in the following words:

''I cannot think that the right of access to justice is in some way a
lesser right than that of free expression; the circumstances in which
free speech
might justifiably be curtailed in my view run wider than any in which
the citizen might properly be prevented by the State from seeking
redress from the Queen's courts. Indeed, the right to a fair trial,
which of necessity imports the right of access to the court, is as
near to an absolute right as any which I can envisage''.

Laws, J referred to the proposition that:
''The executive cannot in law abrogate the right of access to justice,
unless it is specifically so permitted by Parliament; and this is the
meaning of the constitutional right''.

It was furthermore held that ''access of right to a court is a
constitutional right'', which can only be denied by a specific
legislation ''turning people away from the court door''. The head note
of this decision uses this term common law constitutional right.

In an article Dr. Cyrus Dass, a member of Faculty of Law University of
Malaya published in ''World of All Human Rights'' Soli J. Sorabji a
Festschrift, opined that the same may safely be taken as an accurate
compendious description of the right.

read my mail which has subject like Good Morning I am available to all of
you with the morningtea. and inside the mail I am asking about how to
configure Gmail on my mobile. Now how would you get to know from my subject
line that I am asking for some sort of help or I am going to suggest
something unless you open the mail and read it completely. Since AI is a big
list and many people ask/suggest many things. It might not be convenient for
everyone to read each mail. People who need to prioritise their reading
preferences, would love to read those things wwhich interest them and.
Hence, putting appropriate subject line saves lot of time of such people.

Hope this gives more clarification to what Aditi was trying to convey.

Hashim, As far as my knowledge goes RTI Act 2005 has Sections and not
Articles that too only 31 (Refer link for bare Act:
http://righttoinformation.gov.in/webactrti.htm ). Articles are often found
in Constitutions and UN Conventions etc and not in the Acts.

[AI] Good morning!

2007-03-29 Thread Shadab Husain
My dear Sir,

Hope that you would be in the best of your spirits by default: so am
I by your benediction.

I have written an answer on Bacon's wisdom, which, I believe, would
also serve as Bacon's as an essayist; and, as it is my humble opinion,
a little expansion in the last few paragraphs, (please note this while
reading), would make this answer fit for the Blake's verdict—Good
advise for Satan's kingdom. Now, the main purpose why I want this
answer to be checked by you is this is that I have mildly expressed a
doubt on Bacon by his own verbatim in the seventh paragraph, and, I
want to know from you that, while writing on his wisdom, may I write
it? Also, please, my gentle Sir, let me know that the words which are
under the heading of Common and Indispensable Views, have I
downplayed the importance of Bacon's works? Sir, I want to remind you
as usual that, I am ready to come under your fiery exclamations; so,
please feel free to expose my weaknesses to me.

Whatever your opinions may be on the answer—(good or bad), my
happiness is exceeding all limits to say once again that, I am,

Yours till death

Shadab Husain

In the Jacobean Age, as men became conscious of miscellaneous
complexities of contemporary London life, they also grew agog to find
relevant commentary of current issues in classical literature. The
humanists of court circles found the lessons of diplomacy and
statecraft in Machiavelli and Tacitus, the instances of courage and
fortitude in Plutarch, and the hints of courtesy and wit in Cicero.
So, this wise outlook and curious proclivity for insight in the folks
surviving at the time, allowed a diverse train of thoughts to crop up.
Thus, this prudent mind set of the people of that time gave rise to a
new genre to spring out, and, it came forth in an organized and
polished form of writing which is known as essay.

The central figure who, deriving this technique of writing from
Montaigne, magnificently practiced and soared this genre to its top by
his superlative witty ideas was Francis Bacon. In his peculiarly
facile style, Bacon, (1561—1626), well aware of the need of the hour
gave his readers such rare pieces of writing, which are replete with
extravagant wisdom and illuminative sagacity. I found that I was
fitted as he states, by nature with desire to seek, patience to
doubt, fondness to meditate, slowness to assert, readiness to
consider, carefulness to dispose. Interweaving these peerless
qualities, and elegantly expressing them on paper, he gave his readers
that invaluable trove of wisdom which no wise would let go. This
enlightened air of wisdom flows freely throughout all his essays.

  Simple Allusions and Familiar Diction

It is to be recognised that Bacon, unlike his contemporaries,
refrained himself from using complicated allusions and superficial
verbiage. He expresses the most intricate and abstract idea, but in
more than most easy and common manner. Thus, he sums up volumes in few
words, when he writes, Ipsa Scientia Potestas Est,
meaning--Knowledge is power. Significantly, while opining on Bacon's
writing style, Harold V. Routh states that The true importance of his
style is to be found in its pregnancy.

  Aphoristic Utterances

Bacon is very well known for his condensed and outshining prudent
aphorisms. Hence, when we read the following short sentences, which
are replete with sententious wisdom, we become perfectly acquainted by
his dexterous opinions: Discretion in speech is more than eloquence.
Silence is the virtue of fools. And In charity there is no excess.
The soothing ease of manner in his writing, and his unrestrained
prodigality to convey thoughts of far-sightedness and diligence,
through his excellent aphoristic skill to his readers was the main
plank of all his speculations.

  Common and Indispensable Views

The disquisitions of Bacon have indispensable as well as very common
suggestions in them. For instance, in an essay called—Of Travel, while
explaining the pros and cons of traveling, he tells that a traveler
should keep maps or books with him so that he could become aware of
the important places and culture of the country/state/town, before
visiting them. He also gives the suggestion to his readers to jot down
the beautiful, lucrative and noxious things of the place while
visiting it—Let diaries therefore be brought in use. Traveling
under some tutor, or in the care of a grave servant, he approves
because their experience could prove them good counselors and guides.
These were the general views that he stated in this essay.
Significantly, Routh acknowledges that Bacon's essays have narrow,
but practical views.

On the other hand, he asserts that men should not indulge themselves
in any quarrel while traveling. He is of the view that They are
commonly for mistresses, healths, place, and words. This uncommonly
clever suggestion he gives apart from the general views mentioned
above; and, which is indispensably pragmatic at all
