As Rainer already assumed, this is a feature / works as designed. Common /
default behavior in Word Processors; if there are numbered paragraphs of a
different level above, the current num para has the next counted number.
If you want number 1 in this case, you have to tart the numbering with "0".

I checked with "2.4.1  Multilingual version German UI WIN XP:
[680m17(Build9310)]"  and can confirm the reported effect, but I see it as a
feature, not as a bug.
Please reproduce as reported with attached sample document, and you might agree

2008 ---
Create a list of three elements and style it with Numbering 1.
Demote the first two elements to level 2. 
The third element will be assigned number 2 even if it is the first level 1 
element.

So you get this:
   1. numbering 1 level 2
   2. numbering 1 level 2
2. numbering 1 level 1 <--- should be 1. !!

instead of this:
   1. numbering 1 level 2
   2. numbering 1 level 2
1. numbering 1 level 1 

Resetting the numbering solves the problem
