Arranging this coupling requires but a few simple basic steps; council must declare its readiness to dance, once again, by putting The `scoundrel' Fishman in default, cease rubber stamping Larry's list of candidates for eminent domain and announce itself open to bids on the triangle, sewer plant and various other parcels not yet seized by The Fish; these steps would immediately realize offers of $10 million for the triangle, roughly the same (per unit price) for the sewer plant and additional sites in the waterfront redevelopment area. Downside, Larry would be really pissed off and pout; upside, Larry would be really pissed off and pout, Asbury would collect a slug of dough and the NY Times could write an article about, and visitors would see, actual development. the triangle is worth no where near $10m. 4.5 acres were just sold in Long Branch (2 blocks in) with 8o units for $10m. It does have a vlaue, to the right developer. Don't believe the hype. Then there's a beach club with an offer standing for $10m (with land and beach), another one with less land, but location that rumor has it has sold for around $6m plus. (all local). The biggest mistake AP, the state, and the the county made was not making the entire beach a county or federal park. They still can make the beach and bw one - and the green acres. What would this do? Take control of the beaches, a money losing operation in AP and turn it over. What will happen - people will come. Of course, many locals don't want people to invade the beaches - as it will ruin the club atomsphere. With people, the biz on bw and even those downtown would have a better shot at survival until the day Dick and Jane move in one of those beachfront units. Yahoo! Based Upon Strong Demand for Phase I, Company Moves Forward With Phase II of Wesley Grove ASBURY PARK, N.J., March 21, 2006 - Kushner Companies has closed title to three city blocks in Asbury Park, N.J., for development of Phase II of Wesley Grove at Asbury Park, a luxury residential development now under construction along the famed Wesley Lake at the southern edge of the city, announced Jeffrey Freireich, managing director. This acquisition clears the way for the private developer to move through the City's Technical Review Committee approval process on its proposal to build an additional 300 condominiums and duplexes. Financing was supplied by Valley National Bank, which also supplied the Phase I financing. Kushner Companies purchased the land, which includes three distinct Blocks, 131, 142 and 143, that form the triangle between Cookman, Asbury and Heck Avenues. Kushner Companies purchased the parcels from Asbury Partners, master developer of Oceanfront Asbury, the 56-acre, mixed-use master planned waterfront redevelopment now underway in Asbury Park. We have financed both phases of this project and are thrilled with the success, noted Christopher J. Coiley, senior vice president at Valley National Bank. We feel very positive about our involvement in the redevelopment of this historic area. We are very excited about the purchase, which was completed the first week of March, noted Freireich. Our development arm, Westminster Communities, is well along on construction of Phase I of Wesley Grove. The new community has generated exciting demand from buyers. In fact, we are approaching a 50 percent sellout, and based on the response, we are looking forward to moving as quickly as possible to begin Phase II. The first portion of Phase I of Wesley Grove, known as The St. James, is scheduled for completion by early fall 2006. The sales agreement for that parcel provides for this. In other words, the city agreed that even though they were not going to get the money for a while (they still haven't), the valuations were to be as of August 2001. BTW, which is also the point that the viel of litigation was lifted. You will hear some talk that this same date has to be used for the appraisal of properties to be condemned. That is bs. The law in all 50 states requires the valuation to be as of the date of title vesting. However, the law also requires that no increase/decrease in value from the purpose for which the property is be taken be attributable to the property itself. In other words, value the property as if the project didn't and never existed. Easier said than done. Some try to pin the value to a specific point in time when they surmise the project started to affect values. Certainly an option; however, council has chosen to sell and the deal they've struck appears to be the worst of all worlds. Fish pays nothing, he flips to some half-assed developer, who builds god knows what, the wind no longer blows through, and Larry's coffers score another $10million.
