If the version is anything other than 59r, you problem is solved.
Go to the Wiki and search for Music On Hold.
Do the install of version 59r ONLY as described in the docs.

  That is actually incorrect.  Zaptel timing is not required or used by
MOH.

  But Asterisk's RTP implementation does use the incoming stream to 
time the outgoing stream.  So if there are no incoming packets, no 
outgoing packets are sent, and you don't hear the music.  This means 
that you can't use VAD/Silence detection on any SIP end-points with 
Asterisk.  This affects any sounds played by Asterisk, including 
annoucements, ring-backs, etc., not just MOH.
The strange thing about this is that when I have X-Lite configured not
to send silence and dial into a queue I hear the queue announcements
(every 60 seconds as I've configured) but no MOH, however when I tell it
to transmit silence I hear both the announcements and MOH !!!

Am I right in thinking that when X-Lite is set not to transmit silence,
I shouldn't even hear the announcements ???

Perhaps the instructions have improved, but I discovered that some 
instructions were incomplete. Perhaps not to a Linux expert, but to the 
normal reader, information such as in what directory should a specific 
operation be performed.
I finally was able to move some stuff around and bumble into it, but 
still get the complaint when Asterisk loads about the flexibel (sp?) 
rate not fully tested.
The Wiki mentions this, but again a solution is not provided for the novice.

I already have the correct version of mpg123 installed and running.  I
can hear MOH through my SIP connection to sipgate (now that I've got
ztdummy successfully installed) but with X-Lite I can always hear
announcements but only MOH when it is set to transmit silence.

Yep.  The Wiki is a work in progress so some things are great... Some...
A little less great.  8)

I still get the warning and I know 100% that my mp3s are CBR !!!

I've tried madplay which seemed to work OK (and didn't complain about
the mpg3) but it seemed to emphasize the sibilants more than mpg123 - it
may have just been the volume but mpg123 sounded clearer.

 Having an amd64 I cannot use mpg123 since it will not
compile. Searching throuhgout the list I've read some people use
madplay through custom in the config file. Is there a particular
reason for using madplay or I could use any mp3 file reader?

I currently use AudioGrabber (http://www.audiograbber.com-us.net/) with
LAME and set to CBR.  It's worked for me for many years...

It is ALL very curious.
It certainly is - I too noticed that it also complained about the sample
files, supplied with Asterisk.  madplay doesn't seem to complain but I
think it uses a bit more CPU.
