I just verified the behavior with the prefork MPM on HEAD.  "apachectl restart"
will start the server if it isn't already running.  "apachectl restart" will 
not stop the running server if the configuration file is busted.

Exactly what error message is received when you try "apachectl restart" but 
Apache is not yet running?  

What patches have been applied to the Apache sources, if any?

What MPM are you using?

Running 2.0.40 with the worker MPM, I see this message when you do "apachectl 
restart" and Apache is not running:
httpd not running, trying to start
It does indeed start.  Also, "apachectl" won't stop the existing server if
the config file is currently busted.

I hit return instead of tab.   :-(  Anyway, the details:

If you try to restart the server when it isn't started already, the restart
command gives an error and doesn't start the server.  In the past, the server
used to start if it wasn't already running.

This is usually just a minor inconvenience, except that if there is a problem
with the config file, the restart command will stop the server, and not restart 
it.

We should do a quick sanity check on the file before trying to do the restart.
