Your base OS is out of date with respect to packages.
Update to a newer snapshot and then run pkg_add -ui before
trying again.

The goal is to replace apache httpd 1.3.x with nginx because apache httpd 2.x is
not compatible with OpenBSD license.

It looks you miss the point, messing OpenBSD version with pkg version?
