We're getting the same issue with php5.2.5 using the cake_1.2.3.8166 release so suggest the issue doesnt only apply to php4. I suggest that you consider upgrading to version 5.x as Cake may not support PHP4.x for much longer. This isn't an official announcement, only based on the number of people who have been strongly suggesting that Cake no longer support it.
