What makes the situation especially ludicrous is that one of these hijackers rented a room from a San Diego landlord who was an FBI informant on the Muslim community. That's bad enough. But after 9-11, when the Joint Congressional Intelligence Committee found out what had been going on, the FBI refused to allow the informant to be interviewed by the committee staff or to testify. The FBI actually took steps to hide this man so Congress could not find him. All this is described at some length in former senator Bob Graham's book Intelligence MattersXthe one book on this entire affair written by an actual participant in the behind-the-scenes wheeling and dealing over what was permitted to come into public view about 9-11. Graham was chairman of the joint congressional investigation. To resolve the informant question, Graham writes, he met with Attorney General John Ashcroft, FBI director Robert Mueller, and other top officials. But when he tried to serve a subpoena on one top FBI official, the man shrank away and would not take the piece of paper. In the end, Graham says, he discovered that the FBI was taking its hard line on the informant on orders from the White House. Now comes the Justice Department's Office of Inspector General with a lengthy description of the FBI's relationship with the landlord asset. Like the congressional committee, the inspector general did not interview the landlord, but relies on secondhand information gathered from FBI agents. The landlord no longer works for the Bureau. The inspector general reports, "In July 2003 the asset was given a $100,000 payment and closed as an asset." It is interesting to note that the 9-11 Commission was formed in late 2002. The Joint Congressional Inquiry, which discovered the landlord's existence and sought unsuccessfully to question him, issued its final report July 24, 2003. Bush for a second time in just three weeks by voting to shield libraries and bookstores from government investigators trying to collect information on terrorism suspects. By a vote of 238-187, the chamber on Wednesday approved an amendment to a bill funding the Justice Department that prohibits it from using a section of the USA Patriot Act enabling agents to gain access to customer reading records from US libraries and bookstore. The vote in defiance of a presidential veto threat, followed last month's passage of legislation allowing new federal funding for embryonic stem cell research, also in spite of Bush's repeated threats to veto it. Enacted barely six weeks after the September 11, 2001, terrorist attacks on New York and Washington, the USA Patriot Act is seen by the Bush administration as a key legal tool in the war on terror. It gives the Federal Bureau of Investigation and other US law enforcement agencies greater search and surveillance powers by streamlining procedures and eliminating red tape. But critics have charged that the law threatens to undermine key civil liberties by making Americans more vulnerable to government intrusion. Section 215 of the act has drawn particularly strong fire because it has empowered federal agents to access the reading records of Americans in both libraries and bookstores after securing an order from a secret court. A similar amendment to protect US readers, offered by independent Congressman Bernie Sanders last year, failed to pass by just one vote. But on Wednesday, the pendulum clearly swung in his favor as 38 Republicans joined most of the Democrats in a bid to remedy the situation. The passage of this amendment helps reign in an administration intent on chipping away at the very civil liberties that define us as a nation, an elated Sanders said in a statement. We must do all we can to protect Americans from terrorism, but we must do it in a way that does not undermine the basic constitutional rights that makes us a free country, he added. The amendment passed just one day after the White House publicly threatened to veto the whole bill that funds the Justice, State and Commerce Departments, if the Sanders measure ever saw the light of day. If any amendment that would weaken the USA Patriot Act were included in a bill presented to the president for his signature, the presidents senior advisors would recommend a veto, the White House's Office of Management and Budget warned in a terse statement. But most House members appeared not in the mood for compromises. House Democratic Minority Leader Nancy Pelosi said that when Congress voted for the Patriot Act in late 2001, members were confident it would be accompanied by strong Congressional oversight. What makes the situation especially ludicrous is that one of these hijackers rented a room from a San Diego landlord who was an FBI informant on the Muslim community. That's bad enough. But after 9-11, when the Joint Congressional Intelligence Committee found out what had been going on, the FBI refused to allow the informant to be interviewed by the committee staff or to testify. The FBI actually took steps to hide this man so Congress could not find him. All this is described at some length in former senator Bob Graham's book Intelligence MattersXthe one book on this entire affair written by an actual participant in the behind-the-scenes wheeling and dealing over what was permitted to come into public view about 9-11. Graham was chairman of the joint congressional investigation. To resolve the informant question, Graham writes, he met with Attorney General John Ashcroft, FBI director Robert Mueller, and other top officials. But when he tried to serve a subpoena on one top FBI official, the man shrank away and would not take the piece of paper. In the end, Graham says, he discovered that the FBI was taking its hard line on the informant on orders from the White House. Now comes the Justice Department's Office of Inspector General with a lengthy description of the FBI's relationship with the landlord asset. Like the congressional committee, the inspector general did not interview the landlord, but relies on secondhand information gathered from FBI agents. The landlord no longer works for the Bureau. The inspector general reports, "In July 2003 the asset was given a $100,000 payment and closed as an asset." It is interesting to note that the 9-11 Commission was formed in late 2002. The Joint Congressional Inquiry, which discovered the landlord's existence and sought unsuccessfully to question him, issued its final report July 24, 2003. Time for homeschooling -- Justice 101. Let's say Jack that you go into Jim's candystore and steal a chocolate bar. Jim calls the police. The prosecutor charges Jack with theft. Jack will be charged and brought to trial in this courtroom. The prosecutor will sit at this table over here. What's this over here? This is the witness stand. The prosecutor will call Jim as a witness. Jim will testify that Jack stole the candy bar. Over in this box sit 12 of Jack's fellow citizens. They will hear the evidence. Behind this bench over here sits the judge. The judge will determine what evidence gets to the jury. After the jury hears the evidence, they will walk back into this room, close the door, and decide whether Jack is guilty or not. After reaching a verdict, the jurors will file back into the jury box and tell the judge of their decision. If the verdict is guilty, the judge will hand down his sentence. Jack will go to jail. His reputation will be in tatters. His life destroyed. No more play group. No more swimming in the creek. No more candy bars. That was last night's lesson. This morning, we awake to a front-page Wall Street Journal article reporting that KPMG -- one of the nation's big four accounting firms -- is facing criminal charges for the aggressive marketing of abusive tax shelters that cost the federal government $1.4 billion in lost revenue. A November 2003 Senate report found that KPMG devoted substantial resources to and obtained significant fees from potentially abusive and illegal tax shelters costing the U.S. Treasury billions. According to the Journal, last year, the Internal Revenue Service told a federal court that KPMG falsely asserts that it has never developed, sold or promoted a tax shelter and that KPMG tried for years to delay or conceal evidence behind sometimes false claims of legal privilege. Here's the first sentence from the article, written by Journal reporter John R. Wilke: Federal prosecutors have built a criminal case against KPMG LLP for obstruction of justice and the sale of abusive tax shelters, igniting a debate among top Justice Department officials over whether to seek an indictment -- at the risk of killing one of the four remaining big accounting firms. KPMG issued a statement yesterday saying that it takes full responsibility for the unlawful conduct by former KPMG partners during the period under investigation by the Justice Department. KPMG said it has taken actions to ensure that this type of conduct does not occur again, including firm-wide structural, cultural and governance reforms. In the wake of the criminal prosecution of Arthur Andersen, which drove the accounting firm out of business, federal prosecutors increasingly have shied away from criminally prosecuting big firms. Increasingly, federal prosecutors look to what impact a criminal prosecution will have on the firm. First came the deferred prosecution agreement -- that's where prosecutors file an indictment on the condition that the company behave itself for a period of years, usually two. If things are in order after two years, the indictment is dropped. Slate wiped clean. No record of indictment. No conviction. The New Agenda's Charley Allan writes: We are going to hit a Cuban airplane, said Luis Posada in Caracas, Venezuela, according to a recently declassified CIA document. On October 6 1976, just days later, Cubana Airline flight 455 exploded off the coast of Barbados, killing all 73 passengers. Posada, who is 77 and has dual Venezuelan and Cuban citizenship, was arrested in Miami on May 17 for illegal entry into the US. He is claiming asylum and, so far, the Bush administration has refused to extradite him to Venezuela, where he is wanted for the terrorist bombing. Until 1974, the ex-CIA agent, who specialized in explosives at the infamous School of the Americas in Georgia, was head of the Venezuelan political police -- DISIP -- from where he, reportedly, oversaw the assassination of prominent leftists. Venezuelan President Hugo Chavez has threatened to sever diplomatic links if Posada is not turned over, which the US is obliged to do under bilateral treaties. He has accused the US of harboring a known international terrorist, making a mockery of its ?war on terror.? ?We demand that the US government stop its hypocrisy and its two-faced attitude and send this terrorist, this bandit, to Venezuela,? Chavez insisted last month. ?The world is watching.? This case has become a major headache for George Bush, who is loth to give up such a loyal veteran of the right-wing cause. Posada is hailed as a hero among Miami?s rich, Castro-hating Cuban exiles, who form a key component of his base of support, as well as that of Bush?s brother Jeb, the governor of Florida. A policeman in the Batista dictatorship, Posada also participated in the Bay of Pigs invasion as part of ?Operation 40.? Their mission was simply to assassinate Castro. He also freelanced for the Las Vegas mafia, at one point, supplying mob boss Frank ?Lefty? Rosenthal with detonators and fuses for car-bombs, according to the FBI. Two Argentinean founders of the Mothers of Plaza de Mayo, a movement which supports parents of missing or tortured people in south America, are also demanding Posada?s extradition. They accuse him of involvement in Operation Condor, the US military plan which coordinated the bloodthirsty dictatorships of the 1970s in the region. After bribing his way out of Venezuelan jail in 1985, he worked for Oliver North, directing terror against the people of Nicaragua, supplying the US-backed Contras with weapons in an illegal war against the Sandinista government. The main focus throughout his life, however, seems to be an obsession with overthrowing Fidel Castro. Posada masterminded a string of bombings in Havana during an international youth and student festival in 1997, resulting in the death of an Italian tourist at the Copacabana hotel. ?We didn?t want to hurt anybody,? he claimed in an interview with the New York Times the following year. ?We just wanted to make a big scandal so that the tourists don?t come any more.? ?I sleep like a baby,? he famously boasted, showing little remorse for the misery he caused. ?That Italian was sitting in the wrong place at the wrong time.? In 2000, he was caught red-handed in Panama, preparing to assassinate Castro by blowing up a packed auditorium of over 3,000 students with 33 pounds of C-4 explosives. Although found guilty, he was pardoned in 2004 by outgoing President Mireya Moscoso, who promptly moved to Miami. Seeking to pre-empt those Russians hoping to repeat the scenario of Ukraines stage-managed orange revolution in the streets of Moscow, Rogozin claimed any such regime change would be ginger in coloran obvious allusion to the hair color of Anatoly Chubais, the hugely unpopular pro-Western, reformist liberal. Rodinas leftward economic platform should be taken less as an endorsement of dogmatic Soviet collectivism, says Jatras, than a rejection of the oligarchs looting of Russias national patrimony and the sink-or-swim economic Hobbesianism into which most Russians were plunged without benefit of either property or legal protection. Rogozin and his party take great pains to insist that their Russian patriotic appeal is not chauvinist nor even nationalist, and that respect for the identities and traditions of all of Russias many ethnic groups is itself part of what makes Russia what it is. The fact the most of the partys leadershipincluding Rogozin himself and a large portion of the Partys public followingare practicing Orthodox Christians, Jatras sees as conclusive evidence that Rodina is not a throwback to communism: At the same time, Mr. Rogozins and Rodinas desire to see the restoration of a strong Russian national state, and his seeking common ground with both Europe and China, points to a troublesome potential development for proponents of U.S.-led benevolent global hegemony and architects of the so-called color revolutions that are progressively transforming Russias strategic space into one dominated by Washington. Following successful U.S- Soros-supported efforts in Georgia in 2003 and Ukraine in 2004, speculation is rife as to who is next, with the leading guesses being Belarus and Kazakhstan. Most observers believe Belarus will be a tough nut to crack, however, with the Lukashenko government having imposed severe restrictions on the NGOs that serve as the essential transmission belts for mobilization of the pro-Western, reformist, democratic forces. Kazakhstan seemed to be a more likely bet for the next upheaval, with President Nazerbayevs government having been relatively open to outside influences. In early June, however, the Kazakh parliamentwith an eye to events in Kyrgystan and Uzbekistan, and their own upcoming presidential election in 2006enacted tight new restrictions on foreign-funded organizations.
