Doctors, nurses and medics caring for the approximately 600 prisoners at the U.S. naval base in Cuba are required to provide health information to military and CIA interrogators, according to the report in the respected New England Journal of Medicine. Since late 2003, psychiatrists and psychologists (at Guantanamo) have been part of a strategy that employs extreme stress, combined with behaviour-shaping rewards, to extract actionable intelligence from resistant captives, it states. Such tactics are considered torture by many authorities, the authors note. Medical personnel belonging to the U.S. military's Southern Command have also been told to volunteer to interrogators information they believe may be valuable, the report adds. The report was published ahead of schedule last night on the journal's website because of current public interest in this topic, the journal says. The report's authors Dr. Gregg Bloche, a physician who is also a law professor at Georgetown University in Washington, and Jonathan Marks, a London lawyer who is currently a fellow in bioethics at Georgetown's law centre say that while Guantanamo veterans are ordered not to discuss what goes on there, making it difficult to know how, exactly, military intelligence personnel have used medical information for interrogation, they've been able to assemble part of the picture. They suggest that interrogators at the camp, set up in 2001 to detain prisoners captured in Afghanistan and later Iraq, have had access to prisoners' medical records since early 2003. That contradicts Pentagon statements that there is a separation between intelligence-gathering and patient care. William Winkenwerder, U.S. assistant secretary of defence for health affairs, said in a memo made public in May that Guantanamo prisoners' medical records are considered private as are American citizens'. However, this claim, our inquiry has determined, is sharply at odds with orders given to military medical personnel and with actual practice at Guantanamo, the authors write. Using medical records to devise interrogation protocols crosses an ethical line, said Peter Singer, director of the University of Toronto's Joint Centre for Bioethics. The goal for the physician is to care for the sick, not to aid an interrogation, he said. Patients are patients and prisoners are prisoners and mixing those two things on the part of physicians who work in prisons is actually quite dangerous. Physicians are there for the benefit of patients and if they are seen to be there for some other purpose, it really blurs what they're doing. An Amnesty International Canada spokesman said the report gives serious pause to anyone who is following what happens at Guantanamo. This reinforces the necessity for a full, independent commission of inquiry into the detentions. What is going on and what rules are being violated, John Tackaberry said from Ottawa. The American government needs to accept its responsibility to expose what is actually happening and show the world they are following standards that are acceptable in terms of international law, he said. According to the authors, a previously unreported U.S. Southern Command policy statement dated Aug. 6, 2002, instructs health-care providers that communications from enemy persons under U.S. control at Guantanamo are not confidential and are not subject to the assertion of privileges by detainees. That policy memorandum also tells medical personnel they should convey any information concerning ... the accomplishment of a military or national security mission ... obtained from detainees in the course of treatment to non-medical military or other U.S. personnel who have an apparent need to know the information, the authors found. The only limit on the policy is that caregivers cannot themselves act as interrogators, the authors say. But since the policy calls on caregivers to hand over information they think might be valuable, they are, in effect, part of Guantanamo's surveillance network and dissolving the Pentagon's purported separation between intelligence gathering and patient care, they write. An internal, May 24, 2005, memo from the Army Medical Command, offering guidance to caregivers responsible for detainees, refers to the `interpretation of relevant excerpts from medical records' for the purpose of `assistance with the interrogation process.' The four independent experts claim to have reliable accounts of detainees being tortured at the US base. They say Washington hasn't responded to their repeated requests to visit the facility to check on the conditions, and they're threatening to file their report regardless of whether or not they get access to the base. Alison Caldwell reports UN human rights investigators have accused the US of stalling on their request to visit foreign terror suspects at the base. ALISON CALDWELL: The UN's independent human rights investigators have been trying to visit Guantanamo Bay since early 2002, and they say the United States has yet to respond to their requests. MANFRED NOWAK: We don't have a definite no, we have not been told you are not allowed to visit Guantanamo Bay, but we have also have not received a definite yes. ALISON CALDWELL: Manfred Nowak is the UN's special investigator on torture. He says his team needs full access to the facilities at Guantanamo Bay and the detainees who are being held there. But the US has refused to guarantee him the right to speak to the terror suspects in private. Only the detaining authority receives its report. But the UN's experts would be expected to make a public report. A US spokeswoman said the UN's request was being reviewed in Washington. The Bush administration has repeatedly denied allegations of torture at Guantanamo Bay. The Australian terror-suspect David Hicks has been held at Guantanamo Bay for three-and-a-half years. He's yet to be tried by the special military commission. The acknowledgement was made in a report submitted yesterday to the UN Committee against Torture, said a member of the 10-person panel. The US mission to the UN institutions in Geneva was unavailable for comment on the report. They are no longer trying to duck this, and have respected their obligation to inform the UN, the committee member said anonymously, adding that the US described the incidents as isolated acts carried out by low-ranking members of the military who were being punished. They will have to explain themselves to the committee, the member said. Nothing should be kept in the dark. UN sources said it was the first time the world body had received such a frank statement on torture from US authorities. The committee is gathering information from the US ahead of hearings next May. Human Rights Watch said that Israel has not upheld its obligation under international law to provide an effective remedy to victims of human rights abuses in the Territories, and this bill is yet further evidence of that. On Thursday, Human Rights Watch attended the hearing of the Knesset's Constitution, Law and Justice Committee in which members of parliament debated an amendment to the Civil Wrongs (Liability of State) Law, 5712-1952. The proposed amendment would prohibit a national of an enemy state or a resident of a conflict zone from bringing claims for compensation against the state in an Israeli court for harm inflicted by Israeli forces. This would apply even if Israeli forces have clearly acted wrongfully and regardless of whether the harm occurs in the Occupied Palestinian Territories or beyond. The bill would give the minister of defense the authority to define all of the Occupied Palestinian Territories as a conflict zone, thus precluding compensation for all Palestinians in the territories. The government has stated that it will exclude settlements from the conflict zone, thus preserving compensation rights for Israeli citizens. The bill seeks to expand an already problematic Israeli law that prohibits compensation for war operations, which are defined to include any action combating terror, hostile acts or insurrection, and also an action intended to prevent terror, hostile acts, or insurrection that is taken in a situation endangering life or limb. This would prohibit all residents of a conflict zone from seeking compensation whether or not the harm they have suffered is related to any specific operation. If implemented, this bill would prohibit Palestinians under occupation from seeking compensation even if an Israeli soldier is found guilty of killing a civilian without any justification at all, said Sarah Leah Whitson, Middle East director at Human Rights Watch. It sends the message that Israel will offer no remedy to certain victims, no matter how wrong or unlawful the conduct of its soldiers. Under international human rights law, every state is obliged to provide effective remedies to victims of human rights violations. That requirement includes the obligation to provide victims and their relatives with fair and adequate compensation. In addition, Israel is obligated to investigate, prosecute and punish those responsible for the abuses. Although Israel disputes that its international human rights obligations apply to the Occupied Territories, this view has been rejected definitively by the international bodies responsible for monitoring state compliance under these treaties. Israel is a party to five international human rights treaties that require the state to ensure a remedy to persons whose human rights are violated. The Knesset should respect Israel's international legal obligation to provide victims of human rights abuses with compensation, said Whitson. The Israeli government maintains that it has no duty under international law to pay compensation to civilians during a time of armed conflict. The government also claims that there is a permanent state of armed conflict in the Occupied Palestinian Territories. However, as the occupying power, much of the time Israel is policing and performing law enforcement duties instead, Human Rights Watch said. More than 1,600 civilians have been killed in the territories in situations outside of armed conflict since September 2000. But if implemented as the government has suggested, this bill would preclude compensation for any of the victims of unlawful conduct even in cases outside armed conflict. Even a situation of actual armed conflict does not preempt all human rights obligations, Whitson said. Israel still has an obligation to ensure remedies for serious violations. In addition, the Israeli government has claimed that lawsuits filed by Palestinians for compensation would place an undue burden on the state and on reservists who would have to testify. The government also argued that such cases may require it to disclose classified military intelligence regarding the conduct of military operations. Inconvenience to state agencies and actors, however, is no justification for denying certain victims their rights under international law, Human Rights Watch said. In a report on Monday to mark the Refugee Week,'' it said an estimated 25,000 asylum-seekers, including children, pregnant women and victims of torture, were held in detention centres last year. Detained for years Some of them had been locked up for upto two years though there was no evidence that, if allowed to move around freely, they would abscond, it claimed. Kate Allen, director of Amnesty International (U.K.), questioned the criteria for detaining people in this manner saying it was so broad that literally'' anybody could be taken into detention. All the people we talked to and met in the duration of our research were abiding by Home Office reporting restrictions they had no intention of absconding. There were families with young children, there were pregnant women, there were women who had been raped. There were people who'd been in the most appalling of situations, and there was no evidence that these people were about to abscond,'' she said. Even as the Government defended the policy, Amnesty's findings were supported by other rights groups, including the Refugee Council which said that people were being detained arbitrarily'' and without appropriate consideration''. Home Office Minister Tony McNulty disputed Amnesty's figures in a BBC interview but acknowledged that the detention period should be as short as possible. Dec 31, 2004 - An American legal team interviewing men and women formerly held in US-run prisons throughout Iraq says new cases of abuse and torture have continued to stream in since an initial fact-finding mission to the country in August. Michigan-based attorney Shereef Akeel told The NewStandard that he has not had time to count up each separate allegation of abuse since returning from a December trip to Amman, Jordan, where he met with released detainees, but said there were absolutely now at least 100 cases. He said he expected to compile as many as 300 after sorting out survivors' statements and coordinating them with witnesses' accounts. The newer cases also appear to substantiate earlier evidence gathered implicating a widespread policy of insult and assault committed against Iraqis charged of no crimes, as well as the systematic targeting of prisoners with particularly strong religious convictions. The team had already recorded testimony from over 50 former detainees, detailing severe abuse, rape, torture, humiliation, and religious degradation allegedly committed throughout the network of US-run detention centers and prisons in Iraq. In August, Akeel and his investigative partner, Mohammed Alomari, also revealed what appears to be the systematic targeting of religious inmates, as well as the rape of a 15-year-old boy by his captors as late as July 2004. After two more rounds of interviews with former detainees, one in October and another earlier this month, the team has at least doubled the number of abuse cases their office is officially handling. The growing chaos in Iraq kept Akeels team out of the country, so Iraqis were bussed into Jordan and put up in a hotel, giving them a brief respite from the war even as they were asked to show their prison-issued documentation, including release papers, and to tell their horrific stories. Were only speaking with people who have been released. They were released without charges. They were held without charges, stressed Akeel. One day you get a form -- your time is up and youre served with a blanket release. The newer cases also appear to substantiate earlier evidence gathered implicating a widespread policy of insult and assault committed against Iraqis charged of no crimes, as well as the systematic targeting of prisoners with particularly strong religious convictions. Clerics and other community leaders apparently comprise a significant number of the teams documented cases. Akeel said he was surprised by how many Iraqi professionals and clergy were among the detainees interviewed in building the case. The stature of these people -- lawyers, doctors, pharmacists -- all they're trying to do is help Iraq, said Akeel, who is particularly concerned with the number and nature of abuse claims brought by imams and tribal leaders. When you're torturing imams, making naked women serve them food... what do you think they're going to tell their followers about Americans? Akeel said. Akeel cited one instance in which a man engaging in a religious fast during the day said he was denied food throughout the night, only to have it served minutes before he was required to resume his fast. Akeel said this treatment went on for days. One of the teams most unexpected initial discoveries in reviewing the release papers was that former detainees were alleging illegal activities in as many as two dozen different US-run prisons in Iraq, challenging the US governments official position that the scandal at Abu Ghraib prison was limited to a single facility. Akeel says they have now documented cases from over 25 prisons. The more people we meet, the more detention centers we find out about, said Alomari, Akeel's partner. The vast majority of claimants in the case are men. Aside from one lost client who killed herself upon discovering she was pregnant, Akeel said only about ten women have come forward, though suspicion of sexual and other abuses committed against Iraqi women by American captors is widespread. It's very, very difficult for them, said Akeel, explaining that while a man may be ostracized following sexual abuse, a woman could very well face death at the hands of her family or at the very least, be shunned and never allowed to marry. Akeel charges that interrogators took advantage of the culture, knowing the women would be unlikely to talk. He described one case where captors reportedly raped a female detainee from behind in a cell directly across from a male prisoner. Officials say the program could cost $1.5 billion and generate more than 50,000 drums of hazardous and radioactive waste. Project managers say that most if not all of the new plutonium is intended for secret missions and they declined to divulge any details. But in the past, it has powered espionage devices. (Chicago) Human rights lawyer and Unitarian Universalist Service Committees Stop Torture Permanently Campaign Director Jennifer Harbury spoke about U.S. prisoners abroad and their experiences with abuse and torture. For the last 20 years Harbury worked for reforms in human rights violations committed by the United States. She wrote about her first-hand experiences in the book, Searching for Everardo, which chronicles her efforts to save the life of her late husband, Mayan resistance leader Efrain (Everardo) Bamaca Velasquez in the early 90s. Moreover, she is the author of Bridge of Courage. Her forthcoming third book documents the Central Intelligence Agencys involvement with torture in Latin America and the Middle East. According to the UUSC web site, the organization initiated the STOP Campaign in 2004 in response to the human rights crisis created by the U.S. torture and abuse of detainees in Afghanistan, Iraq and Guantanamo Bay. In her introduction Harbury said: Anyonewho believes in the basic value system of our (American) society were horrified by the torture practices that occurred in Abu Ghraib, that maybe somehow we would lose our national conscience. In the past, whenever she gave talks to Americans throughout the U.S., the universal reaction she experienced from audience members was outrage. Some Republican voters expressed to her that they voted for a particular candidate, but not for torture. We are facing a moral crisis, Harbury said, who believes many high-level officials decided to de facto legalized torture. Her lecture focused on the U.S. Governments responses to the political, legal and national security issues surrounding the Abu Ghraib prison scandal. She summarized the governments responses as follows: it was a few, rogue operators; second, the abuses within U.S. prisons were just short of the legal limits of torture, but protected by the established guidelines; and finally, in the aftermath of 09/11 U.S. administrative officials want to keep Americans safe. First, Harbury answered with a rhetorical question: are these explanations provoking the entire world and creating anti-American sentiment? The official response from U.S. officials that the torture at Abu Ghraib happened as a result of a few contractors and Military Personnel, a few bad apples, is false. The Abu Ghraib photographs exhibited some of the torture practices, as well as the use of cruel and degrading treatment. The UUSC web site references the Abu Ghraib photograph of a hooded Iraqi with wires attached to his fingers. They call this pose the Vietnam position, hence the phrase has warfare meaning associated with it. According to Harbury the abuse and torture practices used in prisons, like Abu Ghraib, are methods refined by different intelligence agencies over decades. Torture Methods Procedures What is the definition of torture? According to the U.N. Convention Against Torture (as explained on the UUSC web site), torture is any act by which severe pain or suffering, whether mental or physical, is intentionally inflicted on a person by any government official or agent. This includes acts of torture inflicted at the request of, or with the consent of, government officials as well. For instance, in a water-boarding session, they tie up the person, submerge him in water then drown him into convulsions and unconsciousness. Immediately after they use cardiopulmonary resuscitation (CPR), until they revive him into consciousness. Some other examples are denial of toilet privileges, prolonged exposure to hot and cold by clothing removal and/or water, loud music, sleep deprivation, stress and duress positions, and solitary confinement. Usually, detainees subjected to torture will experience these practices in combinations. She described one case where a man sat naked, short-bolted to a floor for 24 hours. With the exception of solitary confinement, they subjected him to these torture practices to the point he pulled out clumps of his hair. The fact he acted on his distress demonstrates that torture practices may cause mental breakdowns. In Afghanistan a warlord threw a bomb at a U.S. military base. U.S. Forces captured a man who had nothing to do with the incident. While imprisoned they hit the mans leg over 100 times. As a result of his pulpification, the man developed a blood clot in his leg and it killed him. When they slam prisoners heads into walls, it is not uncommon for the prisoners to die from it. Speaking at a May 25th news conference in London unveiling the group's annual human rights report, Khan said, the American-run prison camp at Guantanamo Bay, Cuba has become the gulag of our time. Amnesty International is calling for the closing of the Guantanamo detention facility, which currently holds some 540 prisoners from 40 nations -- many detained without charge, and some held more than three years. Over the past year, investigations by the International Committee of the Red Cross and the FBI have documented cases of abuse and torture at the hands of U.S. personnel at Guantanamo and prisons in Iraq and Afghanistan. William Schultz, executive director of Amnesty International USA, called on foreign governments to investigate and prosecute all senior U.S. officials who have violated the Geneva Conventions and the U.N. Convention Against Torture. Among those he named were President Bush, Defense Secretary Donald Rumsfeld and Attorney General Alberto Gonzalez. Between The Lines' Scott Harris spoke with Joshua Rubenstein, northeast regional director of Amnesty International USA, who summarizes his group's condemnation of Bush administration policies that have condoned torture. JOSHUA RUBENSTEIN: Amnesty issues what we call our annual report every spring. As in all these years there are reports on over a 140 countries. So, we highlight the ongoing crisis in Darfur where nearly 2 million refugees have been created -- many of them are staying in camps on both sides of the border with Chad. We talk about the ongoing crisis in Congo where more than 3 million casualties have taken place. We talk about Chechnya and Russia. So this is a report that covers the whole globe. But of course, we have focused on the United States this year because of this scandal regarding torture. It was just a year ago that the world was alerted to the mistreatment and torture of prisoners at Abu Ghraib prison in Baghdad, Iraq. And what we've learned since then has really reinforced our concerns. It turns out that leading officials in the government, in the Pentagon, in the White House, in the Department of Justice were drafting memorandums not only justifying the use of torture, but coming up with contrived arguments in order to protect American personnel from being accused of using torture. So these are very contrived legal arguments, and we believe they genuinely reinforce the mistreatment and the torture that we're now finding out about in Afghanistan, in Guantanamo (Bay U.S. Naval base in Cuba) and in Iraq. Plus we're now focusing on this policy of extraordinary rendition, where the United States takes prisoners either from the United States or different countries, say in Europe, and sends them to Syria or Egypt or Jordan for interrogation. Now why would they do that? We believe it's because they rely on those countries to interrogate these prisoners using torture and the U.S. wants to keep somewhat of a distance to keep its hands clean, while it has surrogates carry this kind of interrogation. In a sense, we call it outsourcing torture. So this is what is focused on in the report. BETWEEN THE LINES: Could you be specific about the kinds of torture that you believe are linked directly to official U.S. policy rather than the actions of rogue or sadistic guards or interrogators? Because the idea that lower-level soldiers are responsible for this abuse, is really the essence of how the White House has responded to this scandal. JOSHUA RUBENSTEIN: Well, we feel there has been a real whitewash by blaming all of these lower down personnel and trying to keep the investigations away from people in the command structure. Approximately 125 members of the U.S armed forces have either been court-martialed or received nonjudicial punishment or other administrative action. But to date, no one in the extended chain of command, including those who formulated policies on the treatment and interrogation of prisoners has been held accountable. So, for example, we now
