Having read the e-mail about the US v Emerson, I thought I should
explain a couple of things of possible interest, especially since
this case started in my home city in Texas and has moved up the file
to Lousiana.
The main point of the case that is of great concern to the Amendment
II is that the guy of main focus in the case brandished a gun at his
wife (former, I assume now) while he had a restraining order put on
him by his wife. At the moment in the case, it is possible that if
heard by the US Supreme Court, it could possibly go the way of
Amendment II grounds or Amendment V grounds, assuming the Justices
decide to hear it at all. The main focus on Amendment II is that the
first judge to hear it decided that a Congressional law was
unconstitutional, namely that Emerson having a gun while on a
restraining order was illegal. He doesn't deny that he had it, and
the 1st Judge stated that he was being denied his Amendment II rights
in that he was being considered, legally, to have the same suspended
rights as a felon, and that since he was not a felon, the law was
overstepping its bounds on him.
I have to assume that for some valid reason this case has not been a
main focus of coverage in the city where it all started, and having
talked to some people at the local newspaper, it doesn't appear that
it ever will be covered with concern, which seems odd since no case
of such importance to Amendment II has come up in over 6 decades.
We shall see what becomes of this.
