The reason I can't get all excited over this is because
this is NOT a case of GOVERNMENT out of control.

Whether one agrees or disagrees with the policy, it is
one which has been adapted by a PRIVATE ENTITY, an
association representing that particular subdivision.

The Henrys knew about the policy (or should have
made it their business to become aquainted with all
the rules and regs) when they moved into that subdivision,
indeed the enforcement of the subdivision's particular
rules and regulations is probably what made the house
they bought (and seemingly sold with no problem) a
popular commodity.

It was the Henrys job to abide by the rules they agreed
to be regulated by when they bought the house in that
particular subdivision.  If they found those rules and
regulations too restrictive, they were free to live
elsewhere.

Pink Plastic Flamingos Elicit Fine

LAWRENCEVILLE, Ga. (AP) - When Doug Henry bought a pair of pink flamingos at
an antique market for $15, he thought he'd found a real bargain and great
yard art.

His neighbors in the Towne Park subdivision didn't agree. Now that bargain
could end up costing Henry thousands of dollars.

Last fall, the subdivision's homeowners association began fining Henry $25 a
day for violating its rules prohibiting unapproved lawn decorations. By the
time Henry and his wife, Ellen, sold their house, the fine had reached
$3,400.

``That's a lot of money for two little flamingos,'' said Ellen Henry.

The couple said they didn't learn about the fine until last month, when the
association placed a lien on their house and attorneys handling the sale
withheld $3,400 in escrow. If someone had just asked, the couple would have
moved the plastic birds, Doug Henry said.

Homeowners association spokesman George Nowack said the group sent the couple
two certified letters explaining the fine, but both came back as
undeliverable.

Now if the two sides don't reach a settlement, a judge might have to decide
who gets the $3,400 in escrow.

I have to admit it; pink flamingos are pretty icky, but it's not often that
bad taste is taken to court.  Prudy
