should give serious consideration towards setting a better example:

9/11 attacks. USA Toady is either a pretty funny typo, or a pretty funny
dis.

The article references a CITI/U.Mich. report from 31 August, Detecting
Steganographic Content on the Internet -- apologies in advance if the
report url (or analysis thereof) was previously posted onlist, I may have
missed it.

In an article in the San Francisco Bay Guardian this week, there is an
article about MUNI's policy of making audio recordings of passengers.

 imagine that case law and legal precedent can combat the
 legislative onslaught to come.

All bets are definitely off. IANAL, but what seems most relevant to the
discussion of national ID cards from the earlier 1983 decision was the
court's affirmation that citizens shouldn't be subject to arrest for not
displaying ID to law enforcement on demand. As far as I can see, the
judgement doesn't restrict whether or not a law enforcement officer can
*ask* for ID, just says that a citizen shouldn't be presumed guilty of
some crime for not displaying it.

During los anos Clinton, there was some talk of implementing a national ID
card system as part of his healthcare proposal, if memory serves -- and
that idea tanked. Offhand, I'm not aware of other instances in US history
when a national ID card system has been proposed + debated in the name of
national security... surely this must have come up before at some point...

No, it's the lack of a credible threat of such a system being put in
place. Once the system is in place it is too late to impliment crypto to
recover.

Nigerian Corrupt Official's Bank Account scam spam.
No surprise, though lne.com's filters usually block them.
The interesting thing was that this claims to be sent by the
 CDR Anonymizer [EMAIL PROTECTED]

This is the first time I've seen spam using an anonymizer -
any guesses whether the spammer understands how to use it,
or whether they just harvested the address from one of Choate's web pages?
I'm assuming it's probably the latter.

Working to keep our neighbors awake and informed is our best hope, in my 
view - that is the only way democracy will ever work.

Historically this has often failed (e.g., the lack of outcry against Japanese 
internment camps).  Neighboors are willing to sell their liberty and their neighbors 
at the drop of a hat if someone in government promises them greater security, even 
though these same liars failed them time and time again.  

Since the New Deal Americans and corporations have become increasingly reliant on 
government to provide for them, shield them from their own poor judgement and folly 
and transfer the responsibility to the rest of us.  (Citizens of a like mind should 
structure upcoming tax filings to deduct Congress' largess to the airlines and 
others).  We cannot depend on these cowards and weaklings.

You'll notice that no Declaration of War was formally given.  Even so Congress has 
moved to curtail civil liberties.  From my perspective both life and liberty are 
equally dear.  Those that attempt to take either I will treat the same.

This is an example of the Nigerian Scam, also called 419 Letters, or
just plain 419.  Most 419 letters and emails originate from or are
traceable back to Nigeria. However, some originate from other nations,
mostly also West African nations such as Ghana, Togo, Liberia, Sierra
Leone, Ivory Coast ( Cote D'Ivoire ) etc.

It's the current wrinkle of a decades-old scam that nets tens of
millions of dollars per year, and may be the third largest industry in
Nigeria.  The 419 Coalition believes that it is the elites from which
successive governments of Nigeria have been drawn who are the scammers.
Expect little cooperation from Nigerian authorities.

The Scam operates as follows: the target receives an unsolicited fax,
email, or letter concerning Nigeria containing either a money laundering

bequest, money cleaning, or misallocated funds.

EFF members have asked why we have objected to some of the proposed
changes to wiretapping and other laws made in the aftermath of the recent
terrorist attacks on the U.S. We do not raise these objections lightly,
not are they light objections.  We fully support legitimate government
efforts to bring the perpetrators of these attacks to justice. Yet as a
watchdog for civil liberties, we are skeptical of claims that the only way
we can increase our security is by giving up our freedoms.  And a close
look at the specific measures proposed shows several areas that should
concern all Americans.

First, these bills are not being carefully reviewed, or even reviewed at
all, by our lawmakers.   SA 1562 was introduced late at night and voted on
within a half hour, with several senators complaining that they had not
been given the chance to read it.  Similarly, both MATA and its later
incarnation, ATA, are long and complex bills, making changes throughout
our legal structure. Yet the Attorney General has asked for them to be
voted into law within a week.  This complete dismissal of the normal
processes for legislation should alarm anyone who believes in democratic
government.

Second, these changes are permanent.  EFF shares the desire to move
quickly now in order to better track the perpetrators of this shocking
attack.  But none of the legislative changes that have been proposed so
far is temporary -- these are broad ranging, permanent reductions in civil
liberties and privacy of all Americans.  History has shown that such laws,
passed in haste during a time of crisis, linger and cause difficulties
long after the crisis has passed.

Third, these proposed laws include provisions that appear to have nothing
to do with fighting terrorism, such as allowing wiretaps based upon
allegations of defacing a web site. If it is the case that low-level
computer defacement is a problem that relates to terrorism, we encourage
law enforcement to explain the connection. Instead, it seems that several
of the most worrisome provisions of the proposed laws are part of a
general law enforcement wish list rather than a specific response to
terrorism.

Finally, changes in surveillance authority are suggested without any
showing that the current requirements for FISA, Title III and pen/trap
surveillance posed a barrier to the investigation of the attacks.  We have
been told that FISA warrants were issued and served on major ISPs within
hours of the terrorist attacks last week.  There have been no reports that
the minimal processes required for these warrants have hampered the
investigations.

The EFF does not categorically oppose all changes in our laws or
regulations in response to the attack.  But responses that are unrelated
to increasing our security or that change parts of the laws that are not a
barrier to preventing of terrorism are not only bad policy, they run the
risk of lulling us into believing that we are more safe than we actually
are.  The EFF does not claim to be experts in anti-terrorism measures. We
are experts in civil liberties and privacy, however, and believe that any
lessening of those rights must be carefully debated and adequately justified.

The U.S. legal system has been based upon the basic precept that American
citizens should not be subject to surveillance unless there has been a
showing that he or she may have committed a serious offense.  Maybe we now
wish abandon that precept.  Maybe we now wish to live in a world where who

In the SJ Mercury News this morning: Ellison, (who doesn't think that laws pertaining 
to other people pertain to him, evidenced by his refusal to obey flight curfew laws 
regulating takeoffs and landings at SJ Airport) volunteers to donate all the 
Oracle-ware necessary to deploy National ID cards.  For this act of patriotism he 
naturally gets lots of column inches of aggrandizement. 

He is quoted in the article as suggesting a card that stores your fingerprint, 
allowing authentication by a fingreprint reader.

'We're quite willing to provide the software for this absolutely free.'

But Ellison said in the electronic age little privacy is left anyway ...

 'This privacy you're concerned about is largely an illusion,' he said. 'All you have 
to give up is your illusions, not any of your privacy.'

Howard Gantman, a spokesman for Sen. Diane Feinstein, D-Calif, said that she would be 
interested in discussing the idea with Ellison.

Fuckwits.  I'm concerned the possibility of Nat ID cards is a more virulent threat 
than wiretapping and crypto restrictions.

Radio Frequency Identification Device (RFID)

   A Radio Frequency Identifcation Device (RFID) is a device used
   for electronic identification. An RFID ear tag can be applied to
   an animal's ear in the same way as a visual ID tag. The RFID
   contains a microchip with a unique identification number and
   specialized micro-electronic circuitry (a transponder) for
   communicating this unique number to an RFID reader. 

   The RFID is called a passive communication device because it
   does not contain a battery. Rather, it uses electromagnetic
   energy received from the RFID reader to power the transponder
   and send a radio signal containing the unique identification
   number back to the reader. This number can then be fed directly
   to a computer for recording.

   RFID technology works in dirty, dusty and moist environments
   and does not require a direct line-of-sight to work. This means
   the technology works exceptionally well in livestock and
   carcase processing environments.

Barcodes

Barcodes are used extensively in many applications around the
   world, including on tags and labels. Barcoded eartags are available
   for individual animal identification. 

   Information is stored in the barcode by making parallel lines with
   certain thickness and gaps. When a barcode is scanned using a
   barcode reader, the reader decodes the barcode to reveal it's
   unique identifying number. The barcode scanner can be linked to a
   to a computer to record these unique numbers.

Genetic (DNA) Traceback

Every animal has a unique genetic makeup (it's DNA). Genetic testing to determine an 
animal's unique DNA profile can be used to trace the identity of meat products back to 
individual animals for source verification and quality assurance. 

DNA diagnostics can also be used to determine the parentage of animals to allow sire 
or pedigree testing and for the selection of livestock with desirable traits.

Via strategic partnership, AgInfoLink can offer our clients a number of DNA based
processes and services. These products include Gene Marker Technology, for carcase and 
meat quality, plus DNA services fingerprinting for parentage and traceback. An 
important part of these service includes DNA sample gathering and storage labels, for 
both meat/blood samples and for hair samples, plus services to store and analyse these 
samples.

   Example 1  Bull Selection.
   For cattle producers, selection of bulls is critical to introducing or modifying 
specific traits of progeny. It is not usually achievable to directly link performance 
of progeny animals and carcases to bulls because of multiple sire mating. Not all 
performance characteristics of stock and carcases can be attributed to genetics, 
however, genetics do play a major factor. If producers can be presented data that

bulls to be selected that mirror the bulls linked to exceptionally good progeny. Bulls 
linked to poor performing progeny would be culled. To achieve the outcome of 
objectively based bull selection, AgInfoLink offers producers DNA sampling and Storage 
tools to gather DNA from Bulls at a property level and to gather DNA from progeny at a 
carcase level. AgInfoLink systems can be used to gather and store!
 live animal data and carcase data, plus, link the DNA sample numbers for live animals 
and carcases to eartag numbers carcase ticket numbers.

   Using AgInfoLink's reporting tools, key performance data can be reported to show 
exceptional animals (good or bad) and list their DNA sample numbers. Producers can 
identify progeny of interest. Using the DNA sample numbers stored in the AgInfoLink 
system, a DNA parentage test can then be undertaken DNA from carcases is then linked 
to bulls.

government. Indeed,
  the CIA was Ellison's first customer, and the company's
name stems from a
  CIA-funded project launched in the mid-1970s that sought
better ways of
  storing and retrieving digital data.

  Civil libertarians said caution is needed.

  ``It strikes me as a form of overreaction to the events
that we have
  experienced,'' said Robert Post, a constitutional law
professor at the
  University of California-Berkeley. ``If we allow a
terrorist attack to destroy
  forms of freedom that we have enjoyed, we will have given
the victory to
  them. This kind of recommendation does just that.''

  Post said while such a system may catch some criminals, it
could be hacked
  or faked or evaded by capable terrorists. Nor is it clear
that such a system
  would have foiled the Sept. 11 attacks, he said.

  Strong support

  But polls last week show many Americans support a national
ID card.

that citizens carry

on notice that a rebalancing is going to occur, it's a new world and we will use 
every measure at our disposal to combat terrorism ?? - I fear it is naive to imagine 
that case law and legal precedent can combat the legislative onslaught to come. 


The power to arrest--or otherwise to prolong a seizure until a suspect had
responded to the satisfaction of the police officers--would undoubtedly
elicit cooperation from a high percentage of even those very few
individuals not sufficiently coerced by a show
of authority, brief physicaldetention,
and a frisk. We have never claimed that expansion of the power of police
officers to act on reasonable suspicion alone, or even less, would further
no law enforcement interests. See, e.g., Brown v. Texas , 443 U.S. 47, 52,
99 S.Ct. 2637, 2641, 61 L.Ed.2d 357 (1979). But the balance struck by the
Fourth Amendment between the public interest in effective law enforcement
and the equally public interest in safeguarding individual freedom and
privacy from arbitrary governmental interference forbids such expansion.

Detention beyond the limits of Terry without

Just picked this up on CNN interview.

Any use of encryption technology in Pakistan is now punishable by
execution.

Can someone look into this who may have access to this sort of information
to confirm or deny the report.

Bin Laden has also been rumored to wear pants.

Cooksey won't be running for House again in 2002 - he's planning
to run for Senate instead.  I hope the Democrat's better,
though this is the part of the country that put out
vote for the crook bumper stickers when the crook's
opponent was (ostensibly ex-) Klansman David Duke.
