Cthugha Free ?

2004-02-25 Thread Martin Albert
After 3 years of struggling a giant step could lastly be made - the
relicensing of cthugha is perfect.

Harald has made a last release, cthugha1.4a,
http://www.geocities.com/CapeCanaveral/Lab/6386/, and handed the source
over to my hands. I'm very pleased, as i hope this eases my efforts to
keep it in a good shape and develop it further. I planned a complete
rewrite to make it free, but the changed situation allows incremental
updates, the critical sources mentioned below being first. Now,

 - Is the license (Appendix1) ok? I can find no problem, but it's all
become so complicated ...

 - There is a header file (Appendix2 - soon to be replaced). I find no
problem with it. Is it ok for now?

 - There are some util sources (App.3 and App4). Hm, no copyright at
all. What about them?

 - Last and least, getopt-long. I don't think it's being used much and
might go away. But it 'mentions' ;) GPL. Do you think they're ok?

I'm very happy, that i can ask that questions after all. Looking forward
for your critic, martin

Thank you for your reply (and getting it from the archive and
going through it). You nearly answered the q. that i had on mind:

What is the quickest, most painless way (for him) to get a quite
unresponsive ex-upstream maintainer to provide a free license?

If he is moving on, just ask him to public domain it just as the
 people did before him.

Thanks. Now for the details:

The remainder of the source (not already public domain, no explicit
author's copyright notice) is Copyright 1995-97 by Harald
 Deischinger.
The source code may be copied freely and may be used in other

I think this may remain? While this has to be changed:

 programs under the following conditions:
It may not be used in a commercial program without prior
permission. Please credit the author (in general, credit Cthugha,
Torps Productions and Harald Deischinger) as the source of the code.

What about the begging for credits? I never understood why this is not
in DFSG 4.). Is that against 9.? It is also done in the hello package.

However, i find it nearly impossible for a non-native english speaker
to completely understand even the DFSG. I try often, but heading and
content of each paragraph appear to me to have 'nothing in common'.

(What does 7. mean need for execution of an additional license'. I
execute programs for a long time, but admit i never got this sentence.)
As much as i try, i have sometimes difficulties following even a german
lawyer. I never restricted my own software and, honestly, i feel quite
secure with my compiler and without your help, i would rather rewrite
this program from scratch before i'd start to sort out all that legal
stuff. That's why i was asking in the first place. So:

Thanks for your help - i'm afraid i will need a little more
(decrescendo to whispering ... ;) Greetings, martin

cthugha (non-free) license

2001-09-14 Thread Martin Albert
(i'm not subscribed to this list, please Cc me on replies)

Hello, wishing a nice day!

I'm quite new to Debian development and don't know much about the
workings of this list. But i have some questions at least ;)

Cthugha is (still) a non-free package, that i maintain for Debian and
want to become the upstream maintainer also, as the oriinal author is
not going to develop it any further. I mailed him in february this year
and last 5 minutes ago to convince him to provide a last archive with
another license. My question is: what keeps cthugha from being free?

As i said, i don't know how you are working here. Before i start to
cutpaste all the licensing here, i rather wait for somebody to tell me
so. Cthugha_1.4-1 is in non-free/graphics.

I'm afraid there are several issues - the main license contains
'commercial use ... send me a postcard', but there are apparently some
modules from foreign authors containing other licenses.

I'm going through the software during the next days, mostly to make it
work better, but keep an eye on licenses also. May be some critical
modules can easily be rewritten, don't know yet. I wanted to aks here
in parallel already, so things get moving.

Any input welcome, greetings, martin
