Probably made things a little worse, but not much. From what I understand,
bounces mails to the report address just calls them out to the archive
maintainers, and shouldn't adversely affect either foolish user unless the
administrators make further mistakes.

Reporting list spam

2011-02-19 Thread David Jardine
I recently bounced a foolish user's reply to a spam message to
report-lists...@lists.debian.org, but then began to wonder whether
I wasn't being just as foolish myself.

Did my action achieve anything or just make matters worse?

Cheers,
David

I think in this context it would be a combination of 'claim' and
'report'. I don't know if English has an equivalent.

You probably mean: [...] to the Court of Schöneberg [...]

In a way, yes. But it also can be viewed as "these types of spam are
wrong". Drinking is OK, so long as you don't drive while under the
influence, and you don't do it under 21, or you don't let other people
under 21 do it. Alcohol sellers are able to sell it under certain
provisions, but if they sell to minors, the feds'll come over and board
up the business, or at least they should.

No opt-in requirement is of course a fatal flaw. With verifiable
opt-in of course, it is no longer spam and is now a mailing list.

True.

My point was that this law, sadly, establishes the principle that
spamming is legal, as long as you abide by the rules. There is no
requirement to opt in and they can spam you until you opt out. I
believe you are right that most spam violates this law, but what good is
it if no one will enforce it? Worse yet, spammers have the option to
continue spamming legally.

That's not true for the U.S. Several years ago, the U.S. Congress
passed the unfortunately named [yes you] CAN-SPAM Act of 2003. The law
uses the opt-out principle, thereby legalizing spam, except for specific
prohibited practices. That is, any entity is free to send you UBE until
you opt out. You must notify each individual entity whose mail you do
not wish to receive ... there is no way to globally opt out.

Spamming activities that are now illegal in the U.S.: sending UBE to
electronically harvested addresses, forging headers, deceptive subject
lines, failure to provide a working opt-out mechanism, ignoring
recipient's opt-out declarations and distributing addresses of people
who opt out without indicating that fact. As a practical matter, your
chances of being prosecuted for any of these are remote.

If you do report it, make it clear to you isp that you got the mail from the
debian.org mailing lists (to which you are subscribed) and that problem is
that someone sent spam to the list. Otherwise your isp (or whatever script
they use) might assume that debian.org sent spam to you.

Probably, yes. Especially if the server from which the spam originates
(not to be confused with the 'from' or 'reply-to' address) is within
your country. Sending spam is illegal in many countries including the EU
and the US, so the people responsible for servers in these countries are

'host' and 'whois' are your friends here.
