5232-1 and published in the French government JO (link:

Hi Folks,

Has anyone heard about the France Decree - Article L. 5232-1 of the Public
Health Code on personal stereo equipment?
It's going to limit SPL (Sound Pressure Level) from personal stereo equipment
to 100 dB.
If this decree has been enacted, then the enforced date will be from 1 May
2006.

I am not sure if this France Decree is still a proposed draft or has been
officially published and enacted?

P.S. Personal Stereo Equipment such as portable apparatus that constitutes
allowing the sound reproduction or the radiophonic reception, or both, by
means of a headphone or earphones diffusing the sound with the ears of the
user and that this one can use while moving.  This may include but not limit
to musical Walkmans, MP3 players, PDAs, and Mobile Phones, etc.

UK objected very strongly in CENELEC about the underlying standard EN 
50332-1. The French Decree initiative exists because they had no success 
in persuading the Commission that a Directive should be enacted.

UK position, endorsed by organizations concerned with hearing loss, is 
that the way to stop people damaging their hearing is public education. 
The reason is that there are MANY ways to damage your hearing and 
playing a CD player too loud is just one. Also, we don't have any 
evidence that a significant number of people DO play them too loud. The 
one item on the site below that mentions players mentions exposure time 
but says nothing about sound level. Otherwise it's very sensible:

If the device is wirelessly connected then it will be subject to the RTTE
Directive 1999/5/EC, which applies the Low Voltage Directive without the
lower voltage limit, hence the requirements of the LVD must be applied for
any operating voltage, which will include 3Vdc. Obviously there will be vast
sections of any harmonised standard that will not be applicable since there
will be no mains part to the equipment, so assessment is not such a great
task. For this type of equipment, the relevant standard to apply would be EN
60950-1. I wouldn't expect costs of more than GB£3k for third-party
certification of a product of this nature.

There are very few products indeed for which a mandatory safety approval 
is required in Europe, whether battery or mains operated.

While the current Low-voltage Directive has lower bounds on supply 
voltage, it is in the manufacturer's interest to apply the relevant 
safety standard, EN 60950-1 in this case, as far as possible. This is 
because of the General Product Safety Directive, which requires ALL 
products to be safe, but does not specify any particular way to 
demonstrate that.

Many modern types of battery store a lot of energy in a small volume, 
and can get very hot or even explode under fault conditions.
