You have received several correct replies; the new standard applies.
That is why industry insists on transition periods, normally three years
from publication, for new or revised standards to become mandatory. If
companies ignore the transition period, the Commission could argue that
it is pointless to have it!

 Each unit placed on the market must comply with the then current standards.
A unit is placed on the market when the item leaves the manufacturing stage.
You have the following options:

1) create a Tecnical Construction File of the current design and obtain an
opinion from a Competent Body that the product is in compliance with the
essential requirements of the EMC directive, or

2) build units and place them in distribution where they can remain for an
indefinite time. Your company can own and operate a distribution center if
necessary.

Hi Al,

I do not know of a guide but it is usually stated in the directive what
"placing a product on the market" means.  It is my understanding that you
can not ship(place on the market) anything into the EC that carries the CE
mark after the date of withdrawal of a standard that is used to show
compliance to a directive.  Any products that are stored in a warehouse in
the EC can still be sold after the DOW.  Work in progress does not count.
It must be in the country.

My understanding is as follows :

The regulations applies to products first placed on the market or put into
service.  A product is first placed on the community market when it is made
available for the first time.  This is considered to take place when a
product is transferred from the stage of manufacture with the intention of
distribution and/or use on the community market. Thus if a manufacturer
starts the manufacturing phase, and the relevant standard is supersceeded,
then the current (new)standard should be used when the product is placed on
the market.  The supersceeded standard will not be sufficient to provide
presumption of conformity with essential requirements.
The concept of placing on the market refers to each individual product, not
to a type of product, and whether it was manufactured as an individual unit
or in a series.
