I am able to hold the content that I have legally on the website I have.
It is not possible to create a fork of the FlexWiki software and run a
separate development and build server. The Micrososft License that is used
for FlexWiki is not a copyleft license. Microsoft has each committer assign
their copyrights in the code they create to Microsoft (this is common in the
Open Source world). There is also at least one patent on the FlexWiki
software that I am aware of, that is central to the storage engine. For
development to continue without Microsoft would mean that they would have to
revise the license. For development to continue with Microsoft they need to
revive the site, including the build server.
I have not heard from David in more than 6 months now.

A little misunderstanding - I was not speaking of reusing the flexwiki.com
domain name, but to create a new site with flexwiki.com content. Is the
result the same, ie do we need MS approval for that? I'm thinking while
writing, but I'm afraid the answer is yes (I'm not a lawyer...).

Microsoft owns the copyrights and the domain. For that reason it is not
possible to create a new site using FlexWiki.com
Screwturn wiki has just complete a major upgrade to their codebase which
unprimed the capability to add new features. I have not done full
comparision but the main difference is the lack of WikiTalk functionality.
It may be possible to include the most important features using LINQ, which
would allow keyword selection.
It would be good if David would let us know microsft's intentions

Well, that would not be a problem to open up a site with the old
content.
But can we, legally speaking - we may need to get John agreement.
John, if
you read us...
Adam, screwtape is missing a nice feature - autolinking between pages
(ie, no need to explicitely declare a word as being a link to another
wiki page).
But stop me if I'm wrong.

Ah, yes, I have used that mirror occasionally.
I guess that my concern would be whether or not the project is just
dead and I should use screwtape wiki next time. The actual website
being down for months is pretty indicative...

I believe that I've emailed him before and not received an answer.
It's been a long time now that the site's been down, unfortunately.

I guess you need to ask David Ornstein at Microsoft as they provide
