I believe that you are correct.  Additionally, the OEM license alows 
free upgrades for that major version and that is why when a machine is 
sold, it should include the original disks.

No, you cannot legally borrow it from your neighbor.  Your neighbor  
would be violating his Software License Agreement (assuming he still  
has the OS on his machine).

If you bought the computer new, there's a document that has the OS  
information on it.   I have used that to replace a lost or damaged  
install disk (not the retail OS, but the install disk that I, the  
original purchaser, received with the new computer).  Apple did that  
for me once upon a time.  (It was 9.1, I believe, on my G4.)

But that's not the situation described by the OP in this thread.

You can get the software license agreements (in nearly any language)  
from this page: http://www.apple.com/legal/sla/

Here's the appropriate excerpt of the SLA for Tiger (from  http:// 
images.apple.com/legal/sla/docs/macosx1044.pdf ):

 From 2.A: "This License does not allow the Apple Software to exist  
on more than one computer at a time, and you may not make the Apple  
Software available over a network where it could be used by multiple  
computers at the same time. If you use Setup Assistant to transfer  
software from one Apple-labeled computer to another Apple-labeled  
computer, please remember that continued use of the original copy of  
the software may be prohibited once a copy has been transferred to  
another computer, unless you already have a licensed copy of such  
software on both computers. You should check the relevant software  
license agreements for applicable terms and conditions. You may make  
one copy of the Apple Software (excluding the Boot ROM code) in  
machine-readable form for backup purposes only; provided that the  
backup copy must include all copyright or other proprietary notices  
contained on the original."

A couple of key clauses: "This License does not allow the Apple  
Software to exist on more than one computer at a time"
"You may make one copy of the Apple Software... for backup purposes  
only".

Note, the OP of this thread does not have a license to the software.

Further, this is from the rules page of the lemswap list:   
"Trafficking in wares and pirated software is illegal, violates the

software may be sold on this list. This also applies to software  
'left on' hard drives or installed on computers. Original software

Software licenses do not belong to machines.

Aside from a few Macs (like the Mac SE) that had OS's on their ROM  
chips, all Apples are produced without an OS.  They're all sold  
*with* an OS (and install disks).  If you sell a machine with an OS  
installed on it, you're supposed to include the install disks.  (In  
other words, you can't use 1 license to install the OS on multiple  
machines--you're supposed to buy that OS for each machine.)

The OP of this thread described a situation where the person did not  
own the OS.  He is not entitled to download it from some sharing site  
as you advised him to do.  I still think his first recourse should be  
to contact the seller who should have included disks.  If the OS  
wasn't part of the purchase price, then it's up to him to purchase  
the OS.

giving the install cd to  someone that has the right using that cd...
It is not meaning giving that cd to someone that has no right using...
Do u remember that how many copy you may make from orginal DVD when
first DVD released out in USA.

Please do not confuse LEND OR REDISTRIBUTE with optaining your legal
copy You may copy your DVD and lost them, you may barrow someone's
copied DVD or CD and recopy from it. As long as you right to do it.

It is the logic why all share or backup sites alive... You cannot stop
it. Admit it or not admit it. As long as you use it like that IT IS
LEGAL.

No... it is %100 legal. You have the right to have the orginal
manufactured disc of that computer. As long as you do not change the
version. You may just call Apple and ask them. They will say what i
said to you. You may barrow or you may ask to your friend put a ftp
server just for you (not public open area), it is not problem. Because
you lost your computer disc. IT IS LEGAL.

Please read rules and laws before belaming legal things in to illegal.
You see every one potentional illegal that use internet?

Please review the thread.  Someone who bought a second hand G4 that  
had Mac OS X installed on it but no disks was looking for a place to  
purchase the disks.  You advised him to download it from rapidshare  
reasoning that owning a Mac entitles you to Mac OS X.

What you advised was actually illegal.

Debating whether or not a jury would convict someone (the people who  
own or run rapidshare, for example) is completely irrelevant.

Whatever... It is supreme or whatever court you have there... given
that decision. You may copy for your belongings... whatever they
protected them you may decode it and copy it. As long as it is

Uploading and storing a copy of software
that you legitimately own as

Their own site says it's purpose is:

link."

IOW, RapidShare's purpose is SHARING.  It is NOT
backup.

I understand what you're saying.  At best, you're making an argument  
that rapidshare or whatever upload service isn't violating the Apple  
copyright or EULA, but what you described (someone who doesn't  
legally own the software obtaining it from that source) is most  
definitely illegal.   The fact that you can find a legal use of  
rapidshare, however, doesn't prove that they aren't violating laws.   
(It would be like a bank robber pointing to the thousands of times he  
walked into a bank and didn't rob it as a defense.)

The context of your advice was NOT someone who owns the software  
making a backup copy and storing it on rapidshare for their own use  
within the license agreement.

I suspect they have to say the software is on there for demonstration  
purposes only, and is to be deleted (or reinstalled from a legal  
disk) by the purchaser.

I don't think they can legally advertise these machines as being sold  
"with Mac OS X" if the disks aren't included.

And belive me i bet on it powermax is more illegal... i do not think
they use if exist any Apple OEM license for installing Mac OS X 10.4
on that machine :) So clear out this, if someone buy a machine that

I am the originator of this thread.  Joe is correct below.  I do not own the 
software, however it is on a used machine I purchased from Mac of All Trades.

 

For the record I do plan on purchasing it sometime in the future - hopefully 
for a 50 - 60 price not the inflated ebay prices.

 

Secondly I asked Mac of All Trades and PowerMax how they are allowed to sell 
used machines with no discs.  According to them as a Apple Authorized Reseller 
they are able to do this within certain rights.  Of course they didn't tell me 
all the legalities other than if i wanted to to call Apple to check.

 

Third - I appreciate all the responses!

Joe... infact you are right in point of view... but rapidshare and
magaupload like sites use that... It is like that you may copy your
version on a backup and put somewhere for backup purposes. As long as
you do not use illegal way, it is legal. You make some bad statement,
you have ability to make illegal means not being illegal, or we are
all illegal... I wish my English is enough for clear out. But not
rapdishare or any other share services are illegal if you do not use
them illegal way. Thats the idea!

Uploading and storing a copy of software that you legitimately own as  
a backup copy is NOT what you described to the guy asking about  
getting this software.  He does not own the software.  That's exactly  
the problem.

is to make a backup of legally owned software.  (If so, why do they  
have "share" as part of their name?)

Thats the logic. They legitimize. For example you bought a Lord of the
Rings DVD box set for $40. You have to right to have a CD copy or DVD
for backup purposes. You have the cover and orginal CD... You somehow
scratch it, you may use your backups. It is legal. You may download
same version of it and use it... It is legal. As soon as you may show
you are the buyer of it. Remember the stickers, cartoons that is said
is legal copy ?

So downloading same version of Mac OS that Apple manufactured with is
legal from whatever source, because that Apple is always comes with
system, without system you cannot buy it. You may use whatever source
for install same system (not higher or lower version, exactly same
manufactured system) and it is %100 legal.

Dan sorry, but you may ask a lawyer about this... If you have the
computer that is bluemarked as a system as Apple Computers, you may
barrow... you may download because you have the right the copy of
orginal cd as backup for yourself... In this case you would use your
backup. As long as you use same version of installation it is legal
because as i said Apple Computers come with license of Mac Os but only
manufactured Mac Os not other. The share ports use this backup issues
and legitimite their selfs. So what you are doing is legal or illegal
according what you are doing. If you do not use the orginal system,
and barrow a cd or carbon copy it is illegal. But as mentioned other
posts, really Apple is not care too much single user acts. But i
recommend to install orginal Mac Os version that the machine comes
orginally with or Buy new license... For installing orginal Mac OS
version that themachine comes with he/she can use whatever source
avaible as long as source is the same version.

NO.  You may NOT borrow.

The license says:
3. Transfer. You may not rent, lease, lend, redistribute or
sublicense the Apple Software.

Operative words there:  NOT and LEND.

Howdy,
  I don't think Baha is a native English speaker.  Cut him a little
slack on the grammer.  He is probably much better in English than we are
in his language.
 The funny part to me is that everyone here is saying the same thing,
and then saying Baha is all wrong.  Everyone says you can reinstall the
same version of OSX that came with your machine and you don't need to
buy a new license to do that.  That is all I ever took Baha to be
saying.

For the most part, Apple doesn't seem to be into the whole 
RIAA/MPAA-style customer hatred power trip.  eg: They seem to ignore 
the small guys, who do the gray market stuff such as selling pulled 
media on venues like eBay and LEM Swap.  But the anti-piracy climate 
of today is a far cry from yesterday's.  Betcha if they were shown 
someone like that today, producing 100+ copies of the shipping OS, 
they'd nail 'em.

My comment is a bit of a tangent, but still pertinent, I think.

Some years ago, I bought Jaguar install disks via e-bay.  As it turns  
out, they were home-made copies with paper labels on them.  I  
complained to the seller first, who said he thought they were  
legitimate since he didn't make them himself, but bought 100 sets of  
them from someone else.I complained to e-bay and Apple.  Neither  
one responded to any of my e-mails, and the guy was still selling  
software on e-bay at least a year later.

So. .  . Apple doesn't seem at all interested in protecting their  
license.  (Oh yeah, this was when Jaguar was still being sold in the  
stores, I should have mentioned.)  After all, they let such a  
flagrant violator (not even an anonymous pirate, but an e-bay seller)  
get away with it.

This certainly doesn't justify what Baha Ata has been saying.

The physical media is just a part, like any other component in the 
system.  There is no legal requirement that anyone ever sell you any 
used product that's 100% complete.  It would be nice if resellers

Poor english aside, correct.  Every Mac includes a NON-TRANSFERRABLE 
license for its ORIGINAL software.  When you upgrade the software, 
you are buying a NEW license that IS transferrable.  But still, the 
ORIGINAL license stays with the hardware.

it maybe OEM licensed Apple Software... I am not sure on it because i
have not seen any OEM license for Mac OS since today. But in Windows
world it can be like that. You can install from OEM license and do not
give or "not obligated to give" license or CD as seller.

it is not software piracy. As long as you have your backup cd. .That
machine has its 10.2 as orginal manufactured system. You may install
it whatever source you found. It is not needed licence as long as you
use 10.2. Rapidshare or other way of sharing networks is not illegal,
if they illegal all of them are closed down already. How you use them
is legal or illegal! Thats the important difference. You may call
Apple or Microsoft. If you have a OEM licensed computer you may use
same software version for reinstallation from whatever source you can
find.

Apple. Some folks misunderstood it. Other versions need license. I

Simple, if you have a Apple computer orginal manufactured system is
yours. Your apple machine is enough to show it. Orginal manufactured
system you may have from your friend or avaible download... as
Microsoft licences... If you have license and lost your cd... You may
use same kind installation cd or DVD from your friend or other sources
even you can download it. It is legal. But if you cannot find it or
wish to upgrade, as you say you will buy it. Have look in Ebay or
somewhere as you mentioned retail store... Before buy please consider
your CPU and compatibility... Ram, Mhz, Model...

Well I plan on making a carbon copy.  However being that it is a used machine I 
was hoping to completley erase it and reinstall 10.4.

Personally, I consider having BOTH an external backup AND a 
boot/installation disc of the operating system(s) one is using to be 
ABSOLUTE NECESSITIES.

My question is, why does he need the disks at all?

If the issue is having a disaster backup, he's better off making a
backup of his whole hard drive. That doesn't require a copy of the OS,
it takes a backup disk drive and a copy of Carbon Copy Cloner
donationware/freeware instead.

Jeff,

two answers.

1) AFAIK, the official retail Tiger Install DVD is useable all over the
world.
Tell you something: In febr. this year, a friend from Sacramento visited me.
He has the first iBook G4 800 MHz. He had Panther installed, bought a Tiger
DVD here in Amsterdam and did an archieve and install. Worked flawlessly
here. He is back in the States now and I have not heard any complains.
Next: I have ae a QS '02 800 MHz with 10.4.11 installed from a retail Tiger
DVD. I have 4 users installed each with another language: English, Dutch,
German and French and fast userswitching. No problem.

2) Well I don't believe one of my local dealers/resellers will be interested
in selling and sending, to much hassle for a deal of this price! I believe
finding a dealer/reseller in the USA will be more efficient. Give it a try
and with having no success let me know. Wednesday I'm going to Belgium till
june 7 but after that time I'll can buy one and send to you.
Just let me know.

two questions.

 

I1) s it safe to assume that OS X 10.4 shipped as one product - meaning there 
was not different versions for US/Netherlands/Japan, etc?  I assume this is a 
simple check box for the language one prefers on the install?

 

2) Does this dealer have a website that I may purchase from - assuming the 
above is true?  Keep in mind I am in the States.

1) Very good tip of course! Search for a retail Tiger CD or DVD or place a
wtb (= want to buy).
2) You also can try  and do the same.
3) If there are off. Apple/Mac dealers/resellers in your neighbourhood,
visit them and see what they have in their "new, old stock".

Completely agreed about what the Apple Store is offering. Apple sold their
complete "new, old stock" to the official dealers/resellers. So the
dealers/resellers are the place where you can buy this. Besides internet oc,
but with dealers/resellers you can be sure to get legal and sealed
materials, you see it, pay for and walk home with the stuff. No hassle with
internet-pre-paying, waiting for sending and hoping it's no bs-stuff.
And I myself never use the Apple Store. During my daily, age-related (65)
obliged, walk (around 6 km = around 4 miles), I can visite 3 off. Apple/Mac
dealers. They have all the Apple Store will offer, but also instantly AND
mostly cheaper AND the nearly complete "new, old stock"!

That is a dealer that has "new, old stock" on hand, not Apple itself.  
Many dealers probably have some around they would still like to dump,  
even for 10 Euros or less. This is stock that they either have had  
sitting around, or from a company that upgraded and still had these in  
the storage room and gave them to the dealer.

If you go to the Apple store and look for Apple software, they only  
list 10.5.6 and 10.5.4 Server. Searching for 10.4 in the Apple store  
turns up no hits.

Well Bruce, that's quite different here in The Netherlands. Two weeks ago I
just bought a brandnew, sealed in the box, Mac OS X Tiger (includes Xcode 2)
Install DVD, Version 10.4 2Z691-5305-A from an official Mac-dealer for € 10
= ± US$ 13. I was the 2nd person in this year who asked him for a Tiger
Install-DVD and he still has around 25 of these.

Going back to the original restore disks, if you could find them,

from Apple too... but rapidshare is ok... if you install your orginal
system.. license is your eprom... so it is not license issue for
mac install mac system on orginal manufactured system is ok so
you may look any where as site as long as you install orginal
manufactured system :)

Horrible advice. Either monitor ebay and find restore cd's that shipped with
your computer or go and buy 10.5. Why would you condone software piracy.

I think my only options here are to see if Apple still has the original restore 
discs - however its probably not 10.4 which is what is on the machine.

Bruce I believe was only commenting on the full retail 10.4 option.

I do have system restore discs for my wife's iMac, which is 10.4, however i 
read those will not work.


Macofalltrades and powermax both state they they will provide the discs where 
available - i assume there must be some loophole in regards to the purchase and 
sale for old used machines.

If they're reselling computers with the OS installed they're obligated  
to include the disks; otherwise they're pirating the software, as a  
commercial entity.

This knocks Macofalltrades down a hell of a lot in my estimation.

The above is a complete load of codswallop. Do NOT rely on this  
person's advice.

No your license is NOT your eprom, and if you go to the Apple store  
they will gladly sell you a copy of OS X 10.5, and I'm 99% sure that's  
ALL they'll sell you.  You won't be able to get a copy of 10.4 from  
them.

As with most computer software the license is either the installer  
disk or official paperwork that states you are in legal possession of  
one license to use this software, and outside of a corporate  
environment, you're not going to see the latter.

Purchasing a used copy of software is legal, and is the way to get  
older Mac OSes.

I had someone from work who lost his system restore CD for his HP computer
and HP charged him around $15, so I'm guessing aroud $25.

of restore discs is better than none.
