This is not specifically lgbt related, but I thought this piece I had done 
might be of interest to people because it is a question we often get asked 
during GB meets devoted to legal issues: people want to know if it it illegal 
to possess pornography? 


Many queer people have faced problems over this, for example, in what was known 
as the Matunga racket in Mumbai, blackmailers would lure gay men to a public 
place by posing online as other gay men (sometimes forcing an earlier gay 
victim to act as the lure) and offering to meet to exchange porn and perhaps 
more. Then when the victim went to the appointment, a blackmailer posing as a 
plainclothes policeman would catch him and force him to show the porn, which 
they would claim was proof of him being gay and a crime in itself, and use this 
to blackmail the (usually closeted and very vulnerable) victim into parting 
with large amounts of money. 


Which is why the question came up, and the answer the lawyers doing the session 
always gave was that as per Section 292 of the Indian Penal Code, it is illegal 
to sell, import, advertise, make or distribute porn for profit, but simple 
possession with no intent to sell is not a crime. And by extension, watching 
porn in private is not a crime. This was affirmed very clearly just a few years 
back by Justice Tahilramani of the Bombay High Court. 

But not the morality brigade wants to plug this loophole and petition, filed by 
an Indore based lawyer, is in the Supreme Court asking the Court to extend its 
interpretation of Section 292 to criminalise the possession and viewing of 
porn. And from a combination of understandable concerns, like the horror of the 
recent rapes and the links being made to easily available Internet porn, and 
because people don't want to be seen as supporting porn, there may be a chance 
that the petition might succeed. Which would be really stupid and dangerous 
because (a) implementing it effectively will be almost impossible, but (b) it 
will empower a great deal of harassment and blackmail.

On December 12, 1959, a man calling himself Ali RazaSayeedHasan went into Happy 
Book Stall, a small outlet selling books on Colaba Causeway in Bombay, as the 
city was then known, and asked if they had a copy of DH Lawrence's Lady 
Chatterley's Lover.

The book had been in the news recently because, after years of being 
unavailable due to its sexually explicit content, Grove Press in the US and 
Penguin in the UK had recently published unexpurgated editions. The publishers 
were risking prosecution under the strict antiobscenity codes of that time, but 
they judged the time had come for its literary merits to prevail and, in 
separate court cases in the US and the UK, it did.

The cases played a crucial role in helping change laws and attitudes towards 
obscenity in these countries. But the UK decision hadn't been delivered yet 
when the owners of Happy Book Stall decided to import a few copies of the book, 
hoping it wouldn't catch the eyes of the authorities. But it did. Hasan was an 
undercover police agent. He bought a copy from Gokuldas Shamji, one of the 
owners.

The police then conducted a raid, found more copies, and arrested Shamji along 
with his partners, Jamnadas Shamji, Vallabdas Shamji and Ranjit Udeshi (whose 
name, arbitrarily, became the one the case is known by) and produced them 
before the Esplanade magistrates' court.

The Times of India reported sub-inspector Purohit of the Bombay CID saying that 
35 passages in the novel were obscene, and their omission could not have 
"harmed the story", meaning that their inclusion was solely meant to titillate. 
Purohit added that in his personal view "DH Lawrence, though a wellknown 
author, was not one of the six best of the present century."

Law vs Literature
The sub-inspector's literary views show that the authorities knew the defence 
case, as in the US and the UK, would rest on literary merits. And from
