SB05-28 GOES TO GOVERNOR
Yesterday, May 5, the Senate concurred with the House amendments to SB05-28, 
and the bill was passed on an 18-16 party line vote, with one Senate Republican 
excused. The next stop is the Governor's desk.

SB05-28 would add sexual orientation and transgender status to the list of 
characteristics for which a person may not be discriminated against under state 
laws applying to employment.

The Governor has three choices:
1.  He can sign the bill and make it law;
2.  He can choose not to sign the bill, which means that after 10 days while 
the legislature is in session, or after 30 days when the legislature is 
adjourned, the bill automatically becomes law.
3.  He can veto the bill.

If the Governor vetoes the bill, there will not be enough votes to override his 
veto, and the bill will die.

ACTION
â   It is vital that you contact Governor Owens and urge him to sign SB05-28. 
(See below for relevant contact information.).
â   Urge friends and family members to do the same.

TALKING POINTS
â   Status-based employment discrimination is inherently unfair, whether it 
is due to race, religion, age, disability, sex, sexual orientation, or 
transgender status.
â   SB05-28 would put the focus of employment policies where it should be â 
on job performance.
â   SB05-28 would provide the same legal protections that are now available 
to other classes of individuals that have historically been victims of 
employment discrimination.
â   The amendment includes groups who are NOT covered under federal law.  
Currently, it is perfectly legal to for any employer in Colorado to 
discriminate against these groups.
â   Polling shows that the vast majority (76%) of Coloradans and Americans 
support a ban on discrimination based on sexual orientation.  (See POLL RESULTS 
AND DEMOGRAPHICS below.)
â   SB05-28 has been endorsed the stateâs leading conservative newspaper,

POLL RESULTS & DEMOGRAPHICS
Gill Foundation/Ciruli Associates Colorado Civil and Human Rights Survey: 
According to the poll, 76 percent of Colorado citizens responding answered that 
they strongly or somewhat support the legal protection of gays and lesbians 
from discrimination in job opportunities. Other initial results indicate:

For reference, the general demographics of the respondents break down as 
follows:
â   Political affiliation: Republican: 42%, Democrat: 36%, Independent: 19%
â   Age: 18-34: 17%, 35-44: 19%, 45-54: 26%, 65 and over: 19%
â   Income: Under $20,000: 10%, $20,000-$49,000: 30%, $50,000-$74,999: 18%, 
$75,000 or more: 24%
â   Gender: Female: 52%, Male: 48%
â   Voting District: District 1: 12%, District 2: 15%, District 3: 14%, 
District 4: 14%, District 5: 15%, District 6: 18%, District 7: 12%

The Gill Foundation/Ciruli Associates Colorado Civil and Human Rights Survey 
was a telephone survey of 900 adults, selected randomly from a sample of 
statewide registered voters who voted in the 2000 presidential election or are 
newly registered since November 2000. Telephone interviews were conducted from 
9/26 to 10/8 and from 12/5 to 12/10, 2002. The statistical range of accuracy in 
19 out of 20 cases is +/- 3.3 percent for a sample size of 900.
