"3.1 Intellectual Property Whatsoever then he removes out of the state that nature hath provided, and left it in, he hath mixed his labor with, and joined to it something that is his own, and thereby makes it his property. -- John Locke. Two Treatises on Government. 1764. The implicit point of view contained in this essay is a Lockean one. Producing a piece of software requires taking the state of nature, the common heritage of software tools and techniques, and using them to fashion something new. To the extent that programming involves labor and thinking is certainly labor, ask any student a piece of software is [intellectual] property. To the extent that invention requires labor, an invention is property. This state of affairs is recognized in intellectual property law, such as copyright and patent law." -- Doug Palmer, Why Not Use the GPL? Thoughts on Free and Open-Source Software. 2003. Correction: It's a fake blanket designed to induce people into treating patents, copyright, trademarks AND PHYSICAL PROPERTY, instinctively, as one and the same thing. Also, it could sway courts, which is rather more serious. IANAL, but I've heard now and again that the Americans are incapable of passing a law to invalidate existing software patents, because their judges are apt to view it as "confiscation of property", which their constitution forbids. No. It's a fake blanket designed to induce people into treating patents, copyright and trademarks, instinctively, as one and the same thing. Considering they're completely disparate monopoly rights, there's no blanket. Trying to find one only leads into confusion that plays well in the hands of those who would have monopolies on thought itself if it brought them more money and power. IP Newsflash
Hi, a lot of visitors have provided me with useful insight on how to improve IP Newsflash. I have not forgotten about your input and instead have worked hard to implement most of your suggestions. The completely redesigned website is now available at http://www.ipnewsflash.com Here are some of the new features: - full cross-compatibility with Firefox, Netscape, Opera and Internet Explorer - choose the content to be displayed yourself (e.g. only english press and USPTO-related caselaw and notices) - choose the content to be included in your newsletter (e.g. only caselaw of the European Patent Office and german press) - Export patent family search results to Excel, Word, or as a raw XML file - use RSS feeds in XML format on your own website or with your newsreader (press, caselaw, notices, and books) - use IP Newsflash content on your own website - submit your own stories For some of the new features you have to register (personalized website or newsletter). Please review the new website and let me know what you like and what you dislike and what should be improved. Best regards, claessen ___ Gnu-misc-discuss mailing list Gnu-misc-discuss@gnu.org http://lists.gnu.org/mailman/listinfo/gnu-misc-discuss
