Hi,

Finally an update on the Goa paid news story. An interesting one. A
criminal defamation complaint under section 500 of the Indian Penal Code
has been filed against me at a trial court in Goa following the paid news
expose in October.

A source was kind enough to give me a copy of the complaint filed against
me. Interestingly the defamation case has been filed by Tulsidas Dessai,
Herald's marketing manager, who struck the paid news deal with me on phone
and email, while I was posing as fictitious budding politician 'Bernard
Costa'.

Please find the nine pages of the defamation case below, which was
incidentally filed on 11/11/11. ;)

A legal source gave me a copy of the complaint a couple of days back.

It is not correct that Mario  was behind the Utterly Butterly
Delicious Amul ad. It was created by DaCunha Associates, headed by
Sylvester Da Cunha, a Goan who is an icon in India's advertising
world. The Amul girl was created by Eustace Fernandes. I am not sure
if he is Goan. He died last year, at age 75.

If you have seen enough of Mario's artwork, then you can see that the
line strokesin the Amul girl are different.

This Golden Jubilee of so called Goa's Liberation is a painful reminder of
how Goans have been fooled, by the Indian (particularly Congress)
Government. The promise to preserve Goa's Identity, by late PM Nehru was
never honoured by him or his predecessors. At 50 years, it looks more like
the liberation of Goa from Goans and the illegal exploitation of the
state's resources and destruction of its environment by the Centre; in
co-ordination with their Goan Corrupt political stooges.  One can easily
see how beautiful Goa and its
environment/beaches/identity/standards/cleanliness etc  have deterioated
over the last 50 years. So Goans, should we celebrating or protesting at
this Golden Jubilee of the so called Liberation?

William de Curtorim was not only a fearless political or fast (jet speed) 
singer , he was a genius in ‘on the spot composing’  too. 
 If he was called back 5 times, each time he would sing different verse thus 
composing it then and there (no repeats). 
He could compose on any thing or anyone may be the person sitting in the 
audience, member of the band etc 
if he sees someone sitting alone in the front rows, he would mention him or her 
too.

COMMERIAL DIVISION OF HIGH COURTS WILL BRING IN MORE FOREIGN INVESTMENTS


If foreign investments have to be brought to India, then, India has to 
make a conducive atmosphere and, constitution of commercial divisions in 
High Courts is a step towards that said Mr Shantaram Naik M.P. in the 
Rajya Sabha.


Mr Naik who initiated the discussion on the Congress side said that 
every agreement or MOU that may be signed by foreign companies may be 
followed by consequential litigations as, words have limitations in 
expressing intentions of parties. These matters are to be resolved speedily.


Mr Naik said that investments will bring in more money and suggested 
that a portion of the money can be reserved for building infrastructure 
for the courts.


He also suggested that court fee for commercial litigations should be on 
a higher side and that parties should not be allowed to get relief of 
crores of rupees by paying a court fee of few hundred rupees.


Mr Naik also suggested that lawyers must be made to pay 10% of their 
hefty fee charged by them in commercial litigations in the development 
of infrastructure for the courts.


Mr Naik said that concept of commercial division will not make any sense 
unless more judges are appointed. He also suggested that Supreme Court 
too should have a commercial division as appeal from High Courts in 
Commercial matters will lie in the Supreme Court.


He said that there are only six high courts which have original 
jurisdiction and hence more high courts will have to be vested with 
original jurisdiction to dispose of commercial litigations.


Brushing aside the criticism of Commercial High Courts that the 
Government has bothered to give special treatment to elite class of 
litigants, Mr Naik said that since independence, courts like tenancy 
courts, land reforms tribunals, rent tribunals etc. have been 
established to deal with cases of common man.

A full stop for the ‘jet speed singer’

TEAM HERALD

PANJIM: Well-known veteran tiatrist William de Curtorim died at his 
Curtorim residence on Sunday evening.


William was running a fever for the last few days and also suffering 
from low blood pressure. He breathed his last at about 7.30 pm following 
a massive heart attack.


Known in tiatr circles as the ‘Jet Speed Singer’ of the tiatr stage due 
to his breath-style rendition, William mesmerized audiences with his 
hard-hitting solos exposing misdeeds of local politicians fearlessly.
He was not seen much in action lately as he was ailing for the last 
several months after he met with a serious road accident. He was last 
seen in action in Lawrence Fernandes’s tiatr “Hem Oxem Kiteak?”.
His funeral will be held on December 13 at 4 pm at St Alex Church, 
Curtorim, after the mass in Carmel Chapel (Carmi-copel) Curtorim.
Expressing shock over William’s demise, Tomazinho Cardozo stated that 
the Konkani stage has lost a “fearless” artiste who could take on any 
powerful personality.


“William was a tiatr artiste, basically a singer and used to sing very 
critical songs exposing the misdeeds of ministers,” Cardozo told Herald.
“He was even assaulted sometimes, but as a singer he was fearless, 
exposing corruption,” he said.


Cardozo further said that he has written and directed many tiatrs 
besides singing. He also has to his credit audio albums.


“He was hit among the tiatr lovers as people would appreciate his songs, 
especially the political ibe ,” said Cardozo.

Thanks for that sad yet lovely picture Nigel. A fitting tribute to Mario 
Miranda.

There was an age when Bombay's best were all Aunty's customers without 
exception.

They were mostly Goans and their hangars-on, in advertising, in education, in 
music, in sports, in drama, in publications, in food and catering and not least 
in English drama and Konkani tiatr.

It was a golden age for Bombay and it was mostly Goans that provided the color. 
It was as if God had said "I shall henceforth dilute your identity in your 
homeland, disperse you to the corners of the earth, and make you strangers to 
each other. But first I shall give you the miracle of the wine. You shall drink 
it and make others wonder at your talents. From the gutter this drink will be 
but it will give you long lives". 

That is what happened. The Goans and their friends went to the places where the 
miracle wine was, they partook of it in plenty, they created genius and wonder 
with their pens, in the fields, in the classrooms, wherever a tune could be 
heard, a sports track seen or people gathered to be amused.

They should have died horrible deaths if you knew what their wine was made 
from. But God had turned it into a nectar and they all lived long and peaceful 
lives, their ends as peaceful and innocent  as the genius with which they were 
blessed.

The complaint Tulsidas accuses me of doing the paid news story "out of
sheer frustration" by using "the facilities of the internet to start

His famous (or rather notorious) blog for some time was titled
'penpricks'
where he freely indulged in mud slinging against one and all".

This blog www.paidnewsingoa.blogspot.com has also been described a a
'nefarious activity' by the complainant.

Tulsidas also claimed in his complaint that the conversation about the paid
news deal never happened.

For more untruths, you could read the scans themselves on the
blog.


This criminal defamation complaint amounts to clear intimidation of a
whistle blower, exposing an unethical practice, in this case the phenomenon
of paid news.

I will contest this bullshit.

While most places try to preserve, improve and beautify their city and
heritage spaces, the City Corporation of Panaji seems more interested in
just the opposite. The idea of having public Sulabh toilets for tourists
along the 18th June Road is akin to having a toilet in the entrance hall of
one's house for visitors! Even worse is that recently a public Sulabh
toilet has been installed very prominently in the Azad Maidan just a few
hundred metres away from the Martyr's Memorial. Strangely enough, there
already exists another public toilet not far away, just close to the ferry
wharf. Or is it that, at a time when we are celebrating 50 years of
liberation, this is what the government wants to convey - their opinion
of Goa's martyrs and freedom fighters. Citizens should protest that all of
Panaji's gardens and public spaces should be preserved and not disrespected
or desecrated.

Over the years we have had some very commendable Judges while a few black
sheep have tipped the scales by bringing disrepute to the temples of
Justice.



One very outspoken and distinguished Bombay High Court Justice B H
Marlapalle 
retired
recently. We have witnessed him being a very firm, knowledgeable
and a no-nonsense Judge. A principled ethical judge, he vacated his
official residence and even surrendered his official vehicle a day after he
retired.  Justice Marlapalle has set a new benchmark despite the existing
norms permitting a Judge to retain the official accommodation and vehicle
for three months after retirement.



Justice Marlapalle’s gesture is in stark contrast to Judge Nelson Britto
whose police security at his residence at Porvorim continued well past his
retirement.  It was only withdrawn when a complaint was made to the
authorities of the unlawful and unnecessary burden to the State exchequer.




While Justice Marlapalle’s example should be emulated by others, there are
those  who just cannot live without that red beacon and accompanying perks.
They start lobbing for their post retirement posting well in advance. This
does not augur well for a Judiciary that has to be otherwise free and fair
and not at the mercy of the politicians for plumb post retirement
positions.

How do you censor a teashop?

Spokesmen do not speak for themselves; they are their masters' voices,
or they don't remain the voice for very long. Ministers, similarly, do
not propose dramatic, or drastic, policy options without implicit
clearance from their boss. This is standard practice. Kapil Sibal is
not solely responsible for the proposed censorship of social media,
currently the most effective communication system on the net.

Censorship is generally the last temptation of self-delusional
governments who want to console themselves with the illusion that
their error is not misrule but vilification. The alibi for censorship
is always national interest, of course. During the Emergency the
government promoted whispers that CIA had bought out those journalists
who did not crawl at its command. Now that KGB has died along with the
Soviet Union, and CIA has become a bit of an ally, such insinuations
do not wash. These days, the cause becomes communalism when what you
really want to do is erase cartoons that demolish the sainted image of
party leaders. This is an apt moment to stress that Indian media has
rarely, if ever, hurt religious sentiments. When Europe was busy
printing scurrilous images of the Prophet of Islam in the name of
freedom, Indian media knew that freedom is not an excuse for
irresponsibility.

Delhi's transitory rulers have become more clever, if not wiser. They
think they can get away with surrogate censorship, by twisting one arm
of media at a time, often through direct executive authority, or by
the more palatable solution of ego-inflation or bank balance
generosity. Individual journalists are pressurised through instruments
of investigation in order to silence criticism. Owners of media feel
the icy hand of power on their neck, sometimes disguised as a pat on
the back. There are rewards for being faithful, from baubles to
material benefits, although the number of reward points required for
payoff does tend to keep rising. Media managers and writers know this.
Those who can't stand the heat get out of the kitchen — and walk
straight into the air-controlled comfort of the politician's drawing
room. Others, who honour the dharma of journalism, do not make a fuss
about discomforts or denial.

{ The Government of India will soon discover that the net does not
bend as easily as some of its collaborators in private sector
communication.}

Ministers can get addicted to bullying even when the environment is
peaceful. When the weather becomes turbulent they slip into a war
mentality. William Westmoreland, the only American general to have
lost a foreign war comprehensively, consoled himself with the
explanation that Vietnam was the first war in modern times fought
without censorship. He told the Washington Post that "Without
censorship, things can get terribly confused in the public mind." This
is what worries the powerful most, that people can get "confused" by
the truth. They want to eliminate debate, questions and consequent
accountability because their greed for office is limitless. They
sanitize media under their control, like Doordarshan and All India
Radio, thus castrating its credibility. Then the scissors come out for
media they do not control.

If censorship of the net was nothing more than a technicality —
switching off the servers, for instance — it would have already
happened. A democratic government does not, however, have the
arbitrary authority of a Muammar Gaddafi or Hafez Assad, or the
anonymous muscle of a Chinese Communist Party. Artificial arguments
have to be used. But the Government of India will soon discover that
the net does not bend as easily as some of its collaborators in
private sector communication. The miracle of social media is its
unique combination of individual voice and mass audience. It is a
conversation with millions. How do you censor a teashop? In 1975 Mrs
Indira Gandhi could imprison the Opposition and pockmark the front
page with blank space, but she could not lock up every teashop. Social
media is the largest teashop in human history.

There remains the vital question. Sibal is the spokesman; who is the
master? Somehow Dr Manmohan Singh's name does not seem to be the
answer. He would not recognise an emoticon.

A pattern can be observed. The Congress is concentrating all its
efforts on the UP Assembly elections, which have become Rahul Gandhi's
pole for a vault into the PM's chair. Serious political decisions are
being made to improve Congress fortunes. Ajit Singh would never have
had any chance of joining the Cabinet had it not been for the
possibility of an electoral alliance in west UP. Rahul Gandhi is aware
that the Anna Hazare movement has made brilliant use of social media
to spread its anti-establishment message. Hazare has publicly blamed
Rahul Gandhi for weakening the proposed Lokpal legislation. The
government can do nothing about Hazare. Is it trying to censor the
internet that carries Hazare's message?

Editor and chief story teller of the Herald, Sujay Gupta is at great pains to 
explain the ‘Bottom-up’ participatory process in his sunday center-spread, 
leveraging his position to bring down the Regional Plan 2021. A man who has 
represented ‘Top-down’ tyranny as a stooge of the Timblos during the agitation 
against their Colamb mine - setting the police on the villagers and filing 
cases against activist Seby in far flung Calcutta … a man who vehemently 
defended his masters during the infamous Ordinance that sought to give favours 
to the Cidade Goa against a Supreme Court ruling deeming their structure to be 
illegal and on public land. This man today preaches participatory process and 
seeks every day to highlight disparaging untruths and rhetoric in his 
newspaper. Or is he doing his masters bidding as a mercenary, because the 
anti-mining stance in the policy document of the RP2021? 
Soter, chief saboteur and rhetoric artist – not going beyond words like 
‘Builders Plan’ and ‘Dump’, where was this man when so many attempts were made 
over the last 4 years to actually work out the real issue of participation 
through inclusion of the 73rd & 74th Amendment to the TCP Act? 
The head of the most rabid village groups, Franky, is a builder himself. Let us 
not forget that the 60FAR that this Plan has introduced towards a less dense 
Goa, has hurt many builders and buyers in the market place, just ask your 
brokers for the real picture. He also has nothing much more to say beyond 
‘Scrap’ and ‘Threat to Goa’.
And what about their figurehead, Edgar Ribeiro? The savior and good soul, who 
actually assisted the Government as Chief Advisor in planning in the 
promulgation of the most draconian Amendment to the TCP Act, 16/16A, that 
allows people and the Regional Plan to be bypassed for projects in the guise of 
PPP. The same man is talking participatory today.
This cacophony should be exposed for what it is – ‘phony’, getting the innocent 
to believe their troubles to be over if the Regional Plan is scrapped. Its been 
done 5 years ago when there was no chance for change, when GBA led a movement 
to scrap the RP2011. 
 
It may seem fashion to do again for those with no imagination, vested interests 
and clear political ambitions. Evidence is enough in the sheer volume of 
submissions for ‘Corrections’to the TCP office in self interest. The key 
difference between RP2011 and the current RP2021 is that there is still scope 
for change. 
 
To rally against something without reading details, without even attempting the 
channels provided for change smells of RAT. We have seen Mullahs issue fatwas 
without reading content, we have seen all manner of corrupt spiritual leaders 
and politicians twist facts and hide under rhetoric for their own ends, and 
lead us into the dark ages without reason. 
 
The current Regional Plan bashing is too early for its time, and is wrong, 
steering us away from real devils. 
 
The greedy shout the loudest, the wolves drown reason with their howling. Do 
your homework, and be careful whom you trust before the elections is all I can 
say.

Dear Petronela,
First of all, such a splendid name! About what you say: You are being too
humble. To be precise it is a brief homily, a sermonette and furthermore, I
have received the word. I am happy it was directed at me.and shared on
Goanet.

It is what it is; so, you must not diminish its import, by saying it is not
a sermon by negating even the diminutive (sermonette), a brief sermon (like
on the Mount), or as you put it--a simple clarification. For the sake of
clarification, you are not being patronising either, but speaking what
stirred you. Amen.

What I appreciate is that my post triggered a concern for salvation, and
mine at that. Messages comes in strange ways, and via intriguing
messengers. People like me are among the gentler pit bulls of the Goan
diaspora, and it is better we stay that way. You see, I am blessed. Indeed
I am. We do not hurt but tend to correct, and usually very gracefully. It
is a grace that very few possess although I will never equal them in
privilege, station and wealth. But that should not concern you.

I have a tendency to tell people what they must and must not do, and indeed
not by virtue of imagining myself being sainted. Perhaps, its on account of
feeling inspired, or just perhaps being cursed. I accept both. Rest
assured: I regard that you were inspired and am considerate of the message.

That piece I posted to which you responded, was meant as it suggests, the
word being invoked outside of Goa, and something that is food for the
soul--the soul here on earth. Goans are brilliant; they do not need me to
tell them the gospels--but I post my two bits as a way of my being Goan
eyes on the outside. It was also intended to show the spine that others
elsewhere in the world are summoning on a day-to-day basic--a moral spine
that is. It would have added to the trajectory of that post, if that piece
and the thoughts in it proper, rather than only those words of dissonance:
Where were you when they crucified my Lord?, were seen in the Goan
socio-politco economic context. It is important to consider that.

But I still appreciate your seeing through it--in me, a vessel that must
change as per plan. Many people want me to go to heaven. I do not argue on
that. Different indeed we all are, but a bit about myself: I am a
Christian, who relates to other paths, walks in Sanathan awareness, and Ko
Shinto via Shodo. If I was to think in terms of saints there are six saints
named Venantius surrounding me! That not bad for a kid east of the railway
tracks.

Its not too often that Goans show that kind of concern or anything
significant to me. Perhaps its because I live in a foreign land, engage
with a life kind of on the edge, living generally outside of many hallowed
mores, yet always considerate. I also do not have patience for players who
consider me an ace in the hole.

Dear JoeGoaUK,

It is not correct that Mario  was behind the Utterly Butterly
Delicious Amul ad. It was created by DaCunha Associates, headed by
Sylvester Da Cunha, a Goan who is an icon in India's advertising
world. The Amul girl was created by Eustace Fernandes. I am not sure
if he is Goan. He died last year, at age 75.

If you have seen enough of Mario's artwork, then you can see that the
line strokesin the Amul girl are different.

This is what I remember and on internet.
Eustace Fernandes, the creator of the Amul girl, passed away at the age of
75. He is again the finest remembered as a cartoonist and an illustrator for
his very cute creation of the Amul girl, dressed up in polka dots with blue
hair and orange face, which ruled the hearts of millions of Indians, since
1966. The ad became a roar with the tagline 'Utterly butterly delicious
Amul'
