CP1: Floriano (Lobo) is a 'doubting Thomas' and always skeptical
regarding your ambitions, claims and promises.

JC1: I'd say that Floriano is absolutely unjustified in being
skeptical of any politician who has kept his promises and whose claims
have been verified as being true. Now, I am sure that Cecil will
provide a list of these politicians.

CP2:  He (Floriano) is also skeptical of the viewpoints and claims of
every political party, organisation and individual other than himself
and his little group.

JC2:  I do not expect Floriano to be skeptical about his own politics,
or you (or me) about our respective businesses/professions. It is for
others to comment, surely, based on their experience with our
performance.

My personal experience with and opinion of Cecil is that he is
absolutely trustworthy. If he promises to do something, he will
deliver in a timely manner. I have said this a zillion times antes. My
personal experience with and opinion of Floriano too is very similar.

It is also my view that both Cecil & Floriano will have the same
success at the ballot box (if they ever contest in the near future) as
Aires has been having and is likely to have. [I am excluding PTA and
like elections]

I also 'agree' with Cecil that Floriano is very unreasonable in being
skeptical of "every political party & organisation". After all, the
Goa politicians have a record (for the past 50 years at least) of
which we all should be very proud. Ain't that a fact?

claims and beliefs he gets into a tizzy.

JC3: But does he "curse" when that happens? My G-chat was asked if
Cecil gets into a tizzy under such circumstances. My kumbakt G-chat
only said 'Hic!'

CP 4: Floriano's intentions are the best but his over-ambitious
attitude and bull headedness in the face of even the slightest
criticism has led to his being ROUTED in every election he has
contested. His attitude has even often resulted in his
(party's/group's) candidates personal goodwill being eroded in their
own constituency.

JC 4: I am not an expert on the presence of "goodwill" in the field of
partisan politics. So, I will not comment.

About the "rout", I doubt it has anything to ONLY do with
"over-ambitious attitude and bull headedness". I know some genuine,
capable and very decent individuals (e.g. Tony Correia-Afonso) who
have been "routed" at the polls.

Those who fail to understand the effect of "partisan politics" and
"triangulation of votes" in elections, should consider 'Stand-Up
Comedy''.

CP 5: For example Julius Pereira has a lot of friends in Aldona who
MIGHT have voted for him, but the fact of him being 'supported' by
Floriano will work against Julius rather than for him.

JC5: I am always impressed by the words "Might Have Voted"; Besides,
speculation is such a delightful profession.

CP 6: Incidentally (doubting) St. Thomas is the patron saint of Aldona

JC6: Before the Feast day of St Thomas becomes an issue like that with
the SFX feast day, I'd suggest the following: NEVER MIND what is
written wherever, St Thomas is ONLY the patron saint of the Aldona
Church and it's (her) parish, NOT of Aldona.

That fact and the possible triangulation of votes (or even
quadrangulation) will decide which candidate will win the Aldona seat.

I doubt that the doubting Thomaswallas will have much of a say in the
process. They are more likely to be caught up in internecine
kestauvam.

All changes for that matter are looked upon with suspicion, as the
status quo is more acceptable. There is a myth weaved around that
politics and religion do not mix. In nature too that are examples
antagonistic to one another, but humans are the greatest adjusters to
circumstances and circumstances as and when the situation demands
Another  popular myth is that good people should not enter politics as
politics is very dirty game Thus the politicians  ensure that they
have no real challenge to deter them and the field becomes their
fiefdom .What exactly  are the actions, behaviours, utterances, that
will and can interfere with his religious duties and as the minister
?Politicians, at best dig into the past of the individual and try to
malign, defame and publicly portray and paint the contestant with
derogatory remarks There are  incidents in the life of every
individual , which may no be in public domain and can cause
embarrassment to his personality, character and profession are we sure
that the priest , who has dared to take the plunge not afraid of any
hidden life? Can anyone  suggest or point or out any charges of
misappropriation,insubordination, glaring misconduct unbecoming of his
priestly life ? As an MLA one is supposed to be able to understand
legal intricacies, take part in debates, propose amendments, look into
the interest and development of his constituency, be able to meet and
listen to his voters, bargain hard with the Govt in power with the
needs of the people at large, stand against any legislation
detrimental to the society The priest is not expected to be self
motivated to enrich himself or behave in the manner to loot, cheat and
be a party to defraud the exchequer He is not expected to be bribed
and maintain dignity, decorum, character and which characteristics
become a hindrance to the political, rogues and scoundrels and are we
afraid for the priest that he will be contaminated also or be
swallowed by the black hole of corruption, nepotism, blackmail et.al ?
Is any one in doubt about his zeal for social commitment and passion
for the needy and good of the people of the state, irrespective of his
belonging to  to any particular religion and is that the greatest dis
qualifications? Are the priest involved in priestly ministry 24 hrs a
day ? Is the politics 24  hrs a day involvement
The Assembly sessions are held in the after noons and for a limited
period twice in a year not lasting for about 15 days each. If elected
he can request to be relieved of exacting duties and posted in a
situation , where his presence is not demanding , or may be posted on
the staff or some other duties In the Diocese we have priests who act
as the Principals of Colleges,heads and managers of the schools and
not f devoted full time to their priestly duties, as it should have
been The Jesuits too are in pursuits of Education
and work part time as priest. Are`nt  the politicians engaged in
business pursuits ,devoting scant time for this work? Principals ,
headmasters and teachers from diocesan schools have in active politics
at all levels, though it is forbidden for the the Govt employees Is it
that they  are neglecting one at the cost of other ? How many
politicians are  full time actors ? Politics is not supposed to be a
profession , though to day it is designated as one of the most
lucrative office The priest is also a member of the society, has
emotions and feelings for his neglected and uncared for members He is
both a member of the society and a priest to serve his flock
 ?t is a matter for the  priest to deal with his obligations,vows towards
his ecclesiastical authority or his order to convince them or leave his calling
and it is not up to any one to cast aspersions
on his ability or commitment There are many priests , who got married
and left the priesthood,others gone stray and still continue, still
others have defied the authorities, and many have been forgiven and
reinstated  There are priests who have defied the authority, left the
diocese and are continuing as priests , in spite of refusal of
permission by the authority
What about the priest who take tainted money, approach the politicians
for the work of the church and temples for all activities? What about
those who actively/ indirectly canvas for candidates, seen moving,
associating with them ,appearing on the stage of meetings of the
politicians? Are they ever censored ,or even reprimanded by the church
authorities
we are clamouring for change, and it can come even with one person did
not Christ bring about a revolution in the thinking of the rulers and
the religious heads of the times?
Don`t our ecclesiastical authorities have yearly meeting at which
politicians attend and are sermonised  ? Whom do all the religious go
to . when they are faced with problems affecting their religious
interests and concerns of the flock Is it o.k for the religious to
mount attacks on the Govt on social issues? we do not want the priest

contribution of the Christians, and worse barring a few very little is
understood by those whose entire being appears to be propped up by that
music. The point is simply that very few understand how influences,
mentorships, resonances and other phenomena lead to satiation in ones
being. It is such awareness, which have made your music heroes who they are
in your eyes today as also the confusion as to what constitutes influence
which help one forge new perspective albeit often with the same raw
materials.

So why is that? Give that a thought. A clue: The modernity that many of us
imbibe so comfortably has come at a price in many ways on the part of a lot
of specific and rigorous productivities on the part of others, who are not
in the majority. They are part of India’s minorities. This is not baseless,
nor is intended to take the shine away from the big names; rather, it is to
draw attention to the base on which ones heroes stand tall in our own eyes.

COMMENT:

The incidents mentioned on Leo Lawrence's book would have benefited
from better referencing. I can understand the need for privacy as  the

alleged incidents in the home of Patracar Noronha i.e. Saligao (one of
them reportedly in the school there)BUT the one which can be
verified is relating to a certain Germano de Souza, a school teacher

circa Feb 16, 1962 and in the Current (DF Karaka). Leo Lawrence
laments the silence on AIR. He must have been nuts to expect anything
better.

Is this post meant to tell readers about judges and judgments? A sort of 
"professor to law students class"  on the desirable virtues of the Bench?

Aires' concerns about these matters are universal. They are not restricted to 
Goan or Indian judges alone, except for the part about judgments being written 
by senior counsel or in ministers' offices. That doesn't happen anywhere else.

It looks to me that Aires is jockeying for a judicial position himself and 
since his posts read more like from the pen of a legal correspondent of a 
newspaper and his activities more like a social activist, me thinks he not on 
the right path to get that position.

Temples of justice are the ultimate hope for those in quest for Justice. In
recent years we have some outstanding young judges appointed but with no
transparency and accountability in the selection process over the years
some judges lacking legal acumen have also creeped into the system. We have
some judges in the subordinate courts who even after a decade of donning
that position continue to display their sheer ignorance of law and legal
procedures coupled with utter gross arrogance. Sometimes only after years
such judges are sacked or compulsorily retired. But what about the damage
they have done to the institution by dispensing injustice through their
poor judgments during those years they held office.



There is no clear cut formula for writing a judgment. In the writing of a
judgment the supreme virtue for every judge however should be clarity and
precision. Nobody being above the law, judges should while dispensing
justice be blind to the social status or financial standing of the parties
to the litigation.  Caste, creed and other considerations should not be
taken into account except the Rule of law. Judgments cannot be tailored to
benefit the rich, powerful or the influential. There should be consistency
in the manner in which judges interpret the law. Under no circumstances can
Courts be casinos where the litigants gamble their luck to secure favorable
orders.

Some judges may regard it as derogatory, to have to listen to a subject on
writing judgments which they consider themselves to have mastered. However
as the subject goes to the very core of the judicial function it is an
issue worth debating.

A judge while battling with varying facts of the various statutes involved
and the differing perceptions acquires skills of his own. Eventually, it is
experience that enables the judge how to go about the job. There are gifted
judges who stand above others in writing judgments.



Judges whose judgments are too brief shift the entire burden of giving
reasons on the appellate Court. Some of these judges glorify their disposal
statistics. The percentage of appeals filed against their judgments and how
often they are reversed is apparent. Quality can never be sacrificed for
quantity. The foremost duty of every judge is to deliver a well reasoned
judgment. There are also some other judges who err on the other side by
their lengthy and confused judgments. Some training needs to be given to
newly recruited judges so that they can write lucid and rational judgments
with clear cut findings. At the start of one’s judicial career some judges
rightly adopt the traditional way of writing judgments. Years of experience
and a little innovation can improve the quality of their writing.

Some judges reproduce the entire pleadings page after page, in their
judgments, extracting the contents of each document and then reproducing
the entire evidence. There is no way of knowing how the conclusions are
reached. It is expected that the Judge gathers the relevant pleading,
documentary evidence and oral evidence under each issue and draws his
conclusions. That is what makes a good judgment.

The quality of a judgment depends upon the quality of arguments addressed.
But an incomplete or inartistic argument of a lawyer is no excuse for
producing an unsatisfactory judgment. Judges have a moral and legal duty to
make up for the shortcomings of the lawyers who argue before them. A
certain minimum amount of research by the judge is needed. In the past lack
of a good law library at home or even in the Court was a handicap for the
judges in the subordinate courts. Today most courts have a law library and
even personal libraries for the judges.

No judge should think that the sheer length of his judgment or its physical
weight will be an index of quality. The quality depends on the presentation
of facts, discussion of the issues of both fact and law and the quality of

[Goanet] Canadian Catholicism, and Goans in Canada (a talk in Porvorim)

Dear Frederick,
I listened to part of this audio and in particular to the question you raise. I 
feel your question of why Goans are migrating in bulk and the impact that has 
on Goa, is misplaced. The speaker cannot have an opinion of this issue. He 
comes from Canada. This is an issue you should raise with a Goan politician at 
an election rally. The answer to your question is simple. It is lack of 
opportunity in Goa - this isn't a new phenomenan. It has been happening for 
nearly two centuries now. And it will continue to happen until Goa or indeed 
India can create adequate opportunities. You have to remember, we live on a 
sub-continent with over 1.2 billion people. It is impossible to create wealth 
for them all, and as a result many will immigrate. Let me reiterate, that many 
of those who migrate to England atleast via the Portuguese Passport route and 
in the current economic climate lead below poverty-line lives here. But despite 
this, they are willing to migrate
 because the alterative in Goa is far worse for them. Those who migrate to the 
Gulf or Toronto maybe enjoying more material success.
 
And above all, migrants know that the lives of their children will be 
considerably better simple because Goa has thus far failed miserably in 
leveling in the playing field through its education system. Those born to 
wealth, those born to caste privilege continue to do well but those who fall 
outside the ambit of inherited priviledge seldom can break the vicious cycle of 
poverty, other than through migration.

COMMENT:

Rajan Parrikar's point is valid indeed! In Dec 1961, we were handed a
clean, beautiful land. With proper planning, we could have had it all.
We could have created self-sufficiency and jobs by providing
incentives and implementing latest trends in industry, agriculture,
floriculture, power generation, etc. Provided incentives to farmers
and to local craftsmen to produce items of world-class quality.
Brought in only non-polluting industries beneficial to Goa, managed
by, and employing, Goans. Given incentives for exports from Goa. Had a
controlled tourism industry. Encouraged educational institutes,
professional training and sporting activities. Made rainwater
harvesting mandatory by every household that would take care of all
our needs for  water. Developed infrastructure like roads, proper
pavements for pedestrians, street-lighting, parks, gardens, green
spaces and an efficient garbage management system in cities and
villages. Regulated the construction industry.  Maintained our
traditional communal harmony and nutured pride in our common religious
heritage. And most important of all, obtained special status for Goa
to protect the interests of our land and our people.

But all of us know what we have instead. In 50 years we have turned
Goa into a cesspool of shame that I need not further describe.  But
unlike Rajan, I still have hope.  If we Goans of all communities
unite, we can still stem further decay, turn things around.  We must
persuade those activists who have been fighting for Goa for so long to
stand for elections. If enough intellectuals come into the government,
environmentalists, heritage lovers, womens' rights activists and
others who have been fighting against the many wrongs in the system,
we can bring about a change. On our part, rather than falling for
cheap promises and temporary material gains, we must vote them in. And
thus halt the destruction of our beautiful land.

In his sincere efforts to dislodge Dayanand Narvekar, Floriano and
like-minded people seems to have done the right thing. Cecil speaks
from ground level and his speculation that Julius could fail because
of Floriano's supprt should be read with alarm. The people responsible
for putting up Julius should have studied the effect of Floriano's
support on Julius's chances of dethroning Narvekar.
We still have to wait to see if the other parties or individuals will
join the fray. It's too early to predict any candidate's prospects.
I have said here before that Su-raj party's roadmap leads to
Floriano's house, not into the hearts and minds of the electorate. I
mean no personal offence to Floriano who is indeed a true-blood Goan,
notwithstanding his anti-India stance, but that's not enough to make
an impact in Goa's politicsw. Why Floriano went to Dr. de Souza and
got rebuked is something I fail to understand. The Trinnamool Gongress
is an unknown factor. Didn't we hear here that Su-raj is an "internet
party."

Given that Goanet is primarily about matters relating to Goa and Goans, I
do not wish to prolong my conversation with Roland Francis on the matter of
the 1964 Zanzibar Revolution unduly. However, I would make a couple
of brief comments in response to his last submission.

As regards Mwalimu Julius Nyerere, then Tanganyika's President, whilst he
was very close politically to Zanzibar's Afro-Shirazi Party (ASP) (the
post-Independence/pre-Revolution Opposition party) and would clearly have
been a significant "supporter and backer" of the Revolution once it had
occurred, I do not believe that he would necessarily have been instrumental
in promoting it actively, though, it would be safe to assume, he would have
been kept advised by his Zanzibari friends about what they were planning.
Zanzibar's Revolution - the timing of which is a matter for debate - was an
entirely indigenous affair

Mr Francis correctly points out that I made no mention of John Okello. That
is because reference to Okello in my previous submission was irrelevant to
the issues I was addressing. I believe that Okello was a transitory figure
and a player of lesser significance in the Revolution, which is why he was
despatched unceremoniously into oblivion so soon after the
Revolution. Whilst the self-styled 'Field Marshall' clearly did lead a band
of fighters, he was by no means the sole or critical planner of the
Revolution. That role was carried out by the ASP and critically by what Mr
Francis refers to as "Babu and gang" in close collaboration with left wing
elements in the ASP and the Zanzibar and Pemba Federation of Labour. As I
said in my previous submission, the Umma youth provided the spine to the
revolutionary effort. My view is that Okello, a Ugandan, was used to make
the initial announcements on Radio Zanzibar because of his mainland accent.
This was intended to deflect blame from the ASP/Umma/ZPFL elements - the
real authors of the Revolution, in case it had failed. This is why Babu
absented himself from the island on the day of the Revolution.

As regards Goans in Zanzibar, it was unofficially estimated that we
numbered about 850 in 1964. Sadly and very tragically, five Goans were
killed during the Revolution. In his book, *The Peoples of Zanzibar *(1920)
Geoffrey Dale amusingly writes: "There are also numerous Goanese from the
Portuguese Colony of Goa and from Mazagan in Bombay. They are Roman
Catholics and form the principal element in the congregation in the Roman
pro-Cathedral. They are a most useful portion of the population rendering
valuable services as cooks, bakers, washermen, shopkeepers, photographers,
doctors and clerks. Such names as Souza, Silva, Gomez, Diaz and Fernandez
are very common. They affect European dress.With very few exceptions they
are the only Christian Indians in Zanzibar, and although some of them are
prone to drink, the services of the Goanese population could ill be spared.

Dear Silvan,

The reason I post images in large sizes is that I want people to enjoy 
them (or not, depending on the person).  This leaves them vulnerable 
to stealing (despite the digital tracker).  I could imprint my copyright 
label directly on to the image, but that would take away its appeal.

It is very easy to link to a blog post and that should be the preferred
way of directing someone to the image(s).  One can use someone
else's work in a limited context under the "fair use" clause, especially 
if it is going to be used for educational or some non-commercial
purpose, but every effort has to be first made to seek permission.  
And the original source must be cited when known, without exception.

These Indian publications have (a) stolen my images and (b) not
cited their source.  They are shameless.

PS: Mr. Prabhudesai did write to me expressing regret.

Francis, Personally, I'm finding the debate very interesting, and I'm sure
it did affect the Goans who stayed there too. So why not carry on the
discussion, please?

In the past, Goanet has focussed on issues of Goans in Pakistan, Kenya and
East Africa (a little), the Gulf, Burma of the yesteryears, Bombay... so
why not add Zanzibar and Tz to that list? FN

PS: As a student growing up in the Goa of the 1970s and early 1980s, I was
much influenced by the essay of Mwalimu Julius Nyerere, titled "So That Man
May Be Liberated". (Couldn't find a copy of the same online though, but I
probably have a paper copy somewhere in my cluttered files... if anyone
knows of one online, please point to it.) At that time, it meant a lot for
me to understand how Catholics in different parts of the globe (not just
affluent southern Germany or conservative US) were coping with religion and
politics in a fast-changing post-colonial situation.

The incidents mentioned on Leo Lawrence's book would have benefited
from better referencing. I can understand the need for privacy as  the

them reportedly in the school there)BUT the one which can be
verified is relating to a certain Germano de Souza, a school teacher
from Calangute.

There are references to editorial-articles in the Free Press Journal
circa Feb 16, 1962 and in the Current (DF Karaka). Leo Lawrence
laments the silence on AIR. He must have been nuts to expect anything
better.

There is a dust storm raised in Goa about a priest fielding himself as
the candidate in the forthcoming elections to the state We are
determined to make decisions for others, in stead of leaving to the
individual concerned. I wonder how this information will be digested
in true spirit without  being offended. In U.S.A. the Roman Catholic
churches are appointing Deacons They are married people. They
officiate at the celebration of Eucharist and preach the sermon too
They assist the Pastor in duties allotted to them They are nominated
by the Pastor and undergo par-time training for about 3 years. They
are however not permitted to hear confessions and administer extreme
unction If widowed, they cannot remarry .If unmarried, they cannot
enter into the sacrament of Marriage It is a voluntary service without
any official remuneration We are still to hear about such reforms in
operation since long The liturgy of the mass has also  undergone
substantially meaningful changes. Eucharist is also administered in
both forms , regularly to those who desire The Eucharistic ministers
are not attired in any special attire and are a part of procession at
the mass They also are permitted to carry the Eucharist to the sick.
Are we ready and receptive  to usher in such reforms with openness?

While you are enjoying those near-zero temperatures, I thought I'd provide
you with some reading material.

re #1: Please note that deacons, like priests, are ORDAINED (not
appointed), and that EVERY priest is ordained a deacon before he becomes a
'permanent deacon' i.e. a priest.

ALL Catholics are called upon to act as 'deacons' and LIVE like Christ
(i.e. Christians). It is only the ordained deacons and priests who take
certain vows & receive (what are known as) Holy Orders.

The deacons (you are referring to) are usually older men (some married) who
have chosen to assist the priests in some of their religious duties. This
has come about because of a shortage of priests - which has many reasons
including the fact that in 2012, the vetting process has made it very
difficult for anybody and anybody else to become a priest.

Younger men who choose to become deacons are one's who are testing the
waters. Needless to say, it is personally testing to be a good priest (or
sadhu or swami). It is also both emotionally and organizationally easier to
leave while still a deacon. Hence the "testing of the waters".


re #s 2 & 3: It must be noted that Canon Law explicitly forbids priests
from holding political office. That is why President Aristide of Haiti had
to leave priesthood in order to run for office. (There are other examples)

I suppose, the Church (already burdened by other issues) does not wish to
get caught up in the ghuspott politicians get into in order to get elected
and in order to move up the ladder.

If you review Aristide's history before and after entering politics, you
will see a total dichotomy. I believe that the Church and any impartial
observer will realise that Canon Law is right about this ban.

I repeat, unfortunately, in today's world, Partisan Politics is NOT for
decent people.

Nobody is forcing Fr. Bismarque to remain a priest. But if he chooses to
remain a priest, he must abide by the terms of priesthood.

One cannot have an "Open Priesthood"! Tomorrow, someone will come up to his
wife and say that he would like an "Open Marriage"!

1) Nyerere used to go every morning to mass at St. Peter's, Oysterbay where 
the priest  was the popular Fr. Emilio Lobo.  Fr. Lobo (yes, a relative) has 
some 
real interesting stories to tell and I can give you his contact the next time I 
hear 
he is in Panjim.


2) Catholics in Tanzania can and do marry several wives. The first wife is 
married 
in church. Since the church will not allow a Catholic to marry a second wife, 
the 
Catholic man marries his second wife according to tribal customs and then goes
and registers the same with the civic authorities. When filling the marriage
certificate, the registrar has a box where s/he registers whether the 
marriage is a 
"monogamous" or "polygamous" marriage.

A few years ago, when the Catholic Prime Minister died in a car crash, all 
three of
his wives were at church crying and praying for him. Contrast this to the women 
of French Catholic politicians. Every time an ex-President or someone important 
there konks off, you see pictures of the grieving wife leading the procession 
to 
the cemetery, followed by their children. Next is the 
late politicians mistress, 
followed by the children too. This always amuses me. 

Lastly, I have understood that your interest was/(is?) in the events and 
Catholics
of the past. I am more interested in the Catholic's (and humanity) of today and
where we are all heading.

1961 Goa, or 1961 Tanganyika, is the past. I feel what we all should be more 
concerned off, for our children sake, is where Catholism will be in 2061.
