Caitu's bid to 'oust' citizenship issue from court failsTNN | Jul 17, 2013, 04.45 AM IST0comments0inShareShare MoreAA Ads by GoogleREAD MORE Rajiv Gandhi PANAJI: In a significant order, the high court of Bombay at Goa recently dismissed an objection raised by Benaulim MLA Caetano Caitu Silva and allowed Valanka Alemao to produce a central government declaration stating that the MLA had ceased to be an Indian citizen on the date he filed his nomination for the assembly election in 2012.Alemao has relied upon a communication dated March 18, 2012, addressed to the external affairs minister and a communication by the private secretary to the external affairs minister dated February 2, 2012, which, according to Alemao, confirm that Silva was a Portuguese citizen since August 21, 2010.Silva, who contested on the Goa Vikas Party ticket had filed an application seeking rejection of a petition filed by Alemao, who he had defeated in the March 2012 election.Alemao stated in the petition that Silva got his birth registered in the civil registration office at Portugal on August 21, 2010, and as per that country's law, this amounts to acquisition of Portuguese citizenship and hence Silva could not contest the election.Dismissing Silva's application, Justice A P Lavande observed that even if it is held that the issue regarding citizenship is within the exclusive jurisdiction of the central government and the court has no jurisdiction to try the issue yet, Alemao must be given an opportunity to produce the central government declaration sating that Silva had ceased to be an Indian citizen at the time of filing his nomination.The high court observed that the petition filed against Silva on grounds that he was not an Indian citizen on the date of filing of the nomination, cannot be dismissed on the ground that it is only the central government which can decide the issue.Senior advocate S G Dessai, who appeared for Silva, contended that in terms of Section 9(2) of the Citizenship Act, 1955, the question as to whether a person has acquired the citizenship of another country, shall be determined by an authority prescribed under the law and, as such, the high court has no jurisdiction to decide on citizenship. Dessai stated that as per the Citizenship Act, Silva is an Indian citizen.On the other hand senior counsel J E Coelho Pereira, who appeared for Alemao, submitted that the high court has powers to decide any issue arising in the election petition, including the issue of citizenship.Passing the order, the high court said, In the case of Bhagwati Prasad Dixit Gorewala vs Rajiv Gandhi, though the apex court held that the high court trying the election petition can declare Indian citizen as having acquired citizenship of foreign state only on the basis of declaration made by the central government, the apex court observed that if such a declaration made by the central government is produced before the high court trying the election petition, the high court has to give effect to it and if such a declaration is not forthcoming, the high court should proceed on the ground that the candidate concerned has not ceased to be Indian citizen.

Feast of Mount Carmel, Carmelite Monastery, Margao Feast of Our Lady of Mount Carmel celebrated today 16th July, 2013. Feast Mass at 5pm. About 25 priests concelebrated Mass. Main Celebrant was Fr. Francisco Carvalho Believe me or not, I really thought Bentina (scapulars) is a tradition of Goa only, being originated from Goa (As in Colva Fama Holy Chords also known as Betina). Infact, Scapular dates back to 13th Century where Our Lady of Mount Carmel appeared to a Priest of Carmelite order (now St. Simon Stock) on 16th July 1251 and gave him the Brown Scapular. Hence, the feast is celebrated on 16th July every year. My bentin did have a picture of Carm(i) Saibinn though and I now (Today) know the reason why. Earlier, Bentin means Carmi Saibinn. Later on we also saw Pictures of St. Francis Xavier etc. There were two types of Betina – One plain dark thick brown (no Picture) and the other with plastic coated picture, chord or thread being comparatively thinner, these lasted for shorter period than the plain one. I remember, we even had Carmi Saibinn Statue in our Olotor and during litany etc we did sing an orasao or hymn in Her honour. Extra During wedding time, little statue of Carmi Saibinn was placed in a tray / Plate and was kept on the table where ‘Dennem’ was on display to public (Dennem = the things the parent gave to daughter to carry the same to her new home in-laws – Clothes, ornaments etc., a part of dowry. Often, this little statue also formed part of Dennem which means the bride will take the statue too. The same tradition also applied to when the Tailors at home start their cutting/stitching work of bridal gowns etc. Again, people were invited to see the clothes ‘sallo’ Invite the neighbours thus - Aiz amger Sallo katortai... The tray with statue was place on the table where clothes are kept for display. Don’t know if this tradition was also prevalent elsewhere in Goa. Since you have already submitted your report to the Secretary of D.O.T Delhi and you being an IIT in Electrical Engineering field at Powai Mumbai, I would like to know what was the response from the Secretary D.O.T and what steps they have taken to safeguard the radiation especially for those towers which are at close vicinity among themselves. I have gone through your vast report and found that there was less work done by you on overlapping radiation to each other on account of many towers erected in close vicinity as we have in Goa especially in D.Paula sector. I am an electronic engineer in the field of Industrial electronics as one of my main subject and I would like to follow up the work which you have already carried out as lots of research work was done by you. Prof Girish , my interest in this field of radiation is because we have already several cancer patients in D.Paula and allegedly they are been told by the doctors that it could be cause of radiation from the cell towers erected closely and most of these patients are coming within the same locality and not from the very close area of the tower which may be falling on dead zone radiation or it could be the field strength is much weak than of those areas where the cancer patients already been diagnosed. Can you suggest some latest equipment to measure these radiation field strength so that I could furnish the data for further research if the Government of Goa, may acquire these meters. We have also a Manipal Hospital nearby who treats Cancer patients but they are not been able to give us evidence that these cases whether they are on account of radiation hazards. I shall be grateful to be in touch with you and get more evidence as much as information as possible on this subject and may be I could be of some help to our Government of Goa, to explore and control the health hazards on account of these towers coming up all over Goa. Bihar Tragedy The mid day meal all over the country is a concern for the safety of school children . Mostly the students from the poor strata are vulnerable to these tragedies The heart wrenching scenes of cries of parents of 22 dead students in Bihar are unnerving. More are still in critical condition lying in the hospital and the figure may rise further. The whole area from where the children come is in mourning the unbearable loss of young ones, These incidents are repeated in various parts of the country , including much advanced developed state of Goa, fortunately deaths have been precluded here The parents are wary of the meals supplied in Goa and ask their children to refrain from enjoying the meals. The intentions of mid day meals are laudable, to ensure regular attendance and also to maintain their nutritional intake. Besides in a two session school timing mid meals are a boon to the poor, who may have to travel on foot long distances. The profit motive of the self help groups leads to indulgence of spurious food and even uncooked meals are infested with insects , lizards, snakes, rats, excreta cockroaches etc. The amount budgeted for each child is woefully in adequate The hygiene of the room used to prepare the food is most undesirable The life of the poor are expandable in vote bank politics and their deaths do not matter, and will be mere statistics The poor cannot rant the air, as their cries will be sooner or later be ignored with impunity The politicians are quick at finger pointing , while the basic issues are given a go bye, It appears the food was stored along with pesticides and fertilizers and the contaminated oil is likely the culprit, The event was waiting to happen any time The negligence and irresponsibility of those involved in the safety of mid meals is pathetic and condemnable If the administration of the scheme is unsafe enviable then ii would be better to offer substitutes ..Either give students food allowance or ration to the parents or serve ready made nutritional snacks from factories. At least the safety will be taken care off .Alternatively the parents of the school students, by rotation could prepare the meals in hygienic surroundings .The profit motive will be obviated and parents will be extra cautious about the safety of their children. The mid meals are a poll gimmicks wooing the poor .Nobody is bothered about the administration and hygiene .Besides there are regular leakages of supplied quotas, being diverted to open market for profit Even detected cases of misuse are not pursued due to political interference and pressures to hush up the matters A review of the scheme is a must and if administration and hygiene cannot be ensured, then precious waste of resources must be stopped Nelson lopes Chinchinim

This is how Mr. Kurupati Dwarkanath Row, the new Chairman of Goa Public Service Commission is related to Chief Minister Manohar Parrikar. Kurupati Dwarkanath Row’s wife was a Dharwadkar (before marriage to him). Her brother Girish is the co-brother (saddu) of Chief Minister’s brother Avdhoot Parrikar. Avdhoot Parrikar’s wife and Girish Dharwadkar’s wife are sisters of the Caro family. Their third sister is married to Dr Vinay Prabhu Desai, whose daughter is engaged to Chief Minister Manohar Parrikar’s younger son Abhijaat Manohar Parrikar. This could be the only reason the entire selection process of Kurupati Dwarkanath Row to the very high constitutional post of Chairman of Goa Public Service Commission took less than 8 hours. A note was moved by the Personnel department at the Secretariat on 27th February this year that Chief Minister Manohar Parrikar had recommended and suggested the name of Kurapati Dwarakanath Row for the post of Chairman of Goa Public Service Commission. The note was approved by the Under Secretary, Additional Secretary, Chief Secretary and the Chief Minister on the same day. The proposal was also approved by the Cabinet meeting held on that very same day. The Supreme Court will now take a call on whether Row’s appointment was in accordance with law. I have nothing against Kurupati Dwarkanath Row. Infact I remember with nostalgic memories in the late 70’s buying chunky beef from Kurupati Dwarkanath Row’s mother who then ran a thriving beef shop (BEEF STEAK) adjacent to the Main post office in Panaji. The quality of beef was remarkable. In those days there was no Goa Meat Complex. And Dr. Manohar Parrikar was also not around to advise us on health grounds not to eat beef. That his hidden anti- beef agenda as advisor of Govansh Raksha Abhiyan (GRA), has now been exposed is another issue. In the first days of May, hundreds of families will be united in the first of many sweaty *abraços *as they wend their way to their villages from the ships jetty at Panjim or the railway station at Collem, Margao and Vasco da Gama. It is a time for feasts and matchmaking,for weddings and funerals. It is the month of nostalgia, the month of many juices. Everything flows. Rivers, gastric juices, sweat, tears of joy and sorrow. Wine flows into goblets, mango juice flows down the chin, caju juice over shirt-fronts, while on beaches and hills, girls are serenaded to the sounds of a million guitars. You could come by ship, as most people did. Fatorda in the early part of the century was part of the Margao constituency and the elite of Fatorda considered themselves as part of the Margao elite. Although, the ancestral house no longer exists, the neighbouring house is a fair indication of what it would have looked like; built in a style typical of twentieth century architecture, a flat structure with a sloping, tile matted roof, fronted by a huge garden space at the bottom of which lies a wall with an imposing gate, facing the hillocks, which even today are thickly forested, home to monkeys and vagrant peacocks.
