NGT will hear Tiracol residents, Goa Foundation appeal against Leading
Hotels Ltd on Feb 6

The NGT at Pune today issued notice on an appeal filed by three Tiracol
villagers (Anthony Mendes, Juze Godinho and Agnel Godinho), together with
the Goa Foundation, challenging the environmental and CRZ clearances given
to the Golf Course Resort project of the Leading Hotels Ltd. Proposed at
Tiracol village, Pednem, Goa.

The appeal has been fixed for purpose of interim relief on stay of
construction or development on February 6, 2015.

The appellants are challenging the CRZ clearance dated 9.12.2014 issued by
the Ministry of Environment & Forests under the provisions of the CRZ
Notification of 6.1.2011 in respect of a golf course resort project sought
to be constructed in the village of Tiracol, Pednem, Goa.

Since the CRZ clearance is one of the conditions imposed through the prior
environment clearance (EC) granted by the SEIAA, the Appellants are also
challenging the environment clearance dated 12.4.2013 granted by the SEIAA
for the same project of the Leading Hotels.

Grounds for the appeal are:

a) The CRZ clearance is issued in violation of direction issued by the High
Court in its judgement dated 13.10.2006 in WP No.422/1998, since the area
is not earmarked for purposes of location of a resort.

b) The CRZ clearance is contrary to the CRZ policy of the State, which is
to allow resort projects only in settlement zone, pursuant to the judgement
of the Bombay High Court in Writ Petition No.422/1998.

c) The CRZ clearance shows no recognition that part of the the area is
forest; wrong information has been supplied by the respondents to the MOEF
in respect of the forest existing on the lands requisitioned for the
project.

d) Tiracol Fort, which is demarcated CRZ I and setback line has not been
considered. The existence of this CRZ I heritage site is not mentioned in
the CRZ clearance, let alone safeguards imposed.

e) The CRZ clearance is based on a faulty and manipulated EC. The EC has
been granted by the SEIAA in a fraudulent manner, without the approval or
recommendations of the SEAC and in fact it is contrary to the actual
recommendations of the SEAC. Further, the EC has also been granted for
establishing a resort on Survey Numbers that have been specifically
identified by the North Goa District Forest Committee as private forest and
this fact is nowhere represented in the EC, which means the EC was granted
without even awareness of existence of forest on the project land.

f) The establishment of a golf course on lands which are intermingled with
and adjacent to the agricultural lands of the appellants will adversely
affect these lands and also the environment of the village settlement in
which they reside, including its water resources and fishing grounds and
these aspects have not been considered at all either by the MOEF’s Expert
Appraisal Committee (EAC) on CRZ while granting the CRZ clearance, or
earlier, by the SEAC or the SEIAA while granting the EC. Entire area
including the lands of the appellants have been considered as part of the
area for CRZ clearance/EC without their consent or knowledge.

It may be recalled that a petition filed against the Golf Resort Project is
pending admission before the Bombay High Court, Panaji bench. It is
scheduled to be taken up on January 12, 2015.

The NGT also adjourned hearing on the Tiracol bridge petition to early
February, in view of stay already granted, and in view of the fact that the
State Government sought time to file a counter to the affidavit filed by
the Goa Foundation on 1.1.2015. Goa Foundation counsel, Mrs Norma Alvares,
produced a new notification issued by the Ministry of Environment amending
the CRZ notification issued in November 2014, which had not been taken into
account by the Ministry itself when it filed its affidavit before the NGT.

Global Goans Cell under the Chairmanship of Qatar based, Simon D’Silva. The

GPCC president Luizinho Faleiro said that remittances from Goans who are
working in 43 countries – mainly Arabian Gulf, has given a big push to the
state economy but expressed regrets that the funds deposited in banks are
being diverted for investments in other states.

Faleiro said that migration to foreign countries has been one of the
biggest push factors in the economic advancement of Goa during the last
three decades. He also said that migration of people to foreign countries
for better prospects has been a dominant feature of the state.

He said that the remittance-induced changes have been felt in almost all
the sub-sectors of the economy. The positive impact of remittances is seen
in bank deposits, housing, real estate and the purchasing power largely in
rural households.

Luizinho said that factors such as decline in agriculture, lack of
sufficient employment/professional opportunities in Goa and urge for higher
and stable earnings have influenced Goans going abroad. Of late, there is
an unhealthy perception gaining ground that “Niz Goenkars” can make their
future only in foreign countries, he added.

Faleiro also stated that earlier Goans migrated for employment with firm
roots in Goa. The trend nowadays is to emigrate for good and final
settlement. The threat to identity and demography lies in this trend, he
stated further. The sustained international migration has led to the
development of ‘remittance-economy’ in many parts of the Goa, particularly
the coastal talukas of Bardez, Salcete and Tiswadi.

Emigration has been a dominant feature of the Christian community in Goa. A
large numbers of Goans working abroad are now returning back to the state
especially from Gulf countries. The returned emigrants face lot of problems
back at home like social, cultural, economic, psychological and health
related.

Faleiro also said that earlier industry contributed a large chunk to the
state economy followed by mining and tourism, but of late “money order” has
been main contributor to the deposits in the bank which only a minimum
amount was lent to the borrowers in the state.

Faleiro said that a study conducted by him has revealed that Goan emigrants
were spread in 43 countries of the world. Faleiro further said that his
study has also revealed that nearly 54 percent of the amounts received from
abroad were used for day to day household expenses, 18.2 percent for
education, 15 percent for debt

 A northern-Italian miller in the sixteenth century, known as
Menocchio, literate but not a member of the literary élite, held a
number of unconventional theological beliefs. He believed that the
soul died with the body, that the world was created out of a chaotic
substance, not ex nihilo, and that it was more important to love one’s
neighbor than to love God. He found eccentric justification for these
beliefs in the few books he read, among them the Decameron, the Bible,
the Koran, and “The Travels of Sir John Mandeville,” all in
translation. For his pains, Menocchio was dragged before the
Inquisition several times, tortured, and, in 1599, burned at the
stake. He was one of thousands who met such a fate.

Western societies are not, even now, the paradise of skepticism and
rationalism that they believe themselves to be. The West is a
variegated space, in which both freedom of thought and tightly
regulated speech exist, and in which disavowals of deadly violence
happen at the same time as clandestine torture. But, at moments when
Western societies consider themselves under attack, the discourse is
quickly dominated by an ahistorical fantasy of long-suffering serenity
and fortitude in the face of provocation. Yet European and American
history are so strongly marked by efforts to control speech that the
persecution of rebellious thought must be considered among the
foundational buttresses of these societies. Witch burnings, heresy
trials, and the untiring work of the Inquisition shaped Europe, and
these ideas extended into American history as well and took on
American modes, from the breaking of slaves to the censuring of
critics of Operation Iraqi Freedom.

More than a dozen people were killed by terrorists in Paris this week.
The victims of these crimes are being mourned worldwide: they were
human beings, beloved by their families and precious to their friends.
On Wednesday, twelve of them were targeted by gunmen for their
affiliation with the satirical French magazine Charlie Hebdo. Charlie
has often been aimed at Muslims, and it’s taken particular joy in
flouting the Islamic ban on depictions of the Prophet Muhammad. It’s
done more than that, including taking on political targets, as well as
Christian and Jewish ones. The magazine depicted the Father, the Son,
and the Holy Ghost in a sexual threesome. Illustrations such as this
have been cited as evidence of Charlie Hebdo’swillingness to offend
everyone. But in recent years the magazine has gone specifically for
racist and Islamophobic provocations, and its numerous anti-Islam
images have been inventively perverse, featuring hook-nosed Arabs,
bullet-ridden Korans, variations on the theme of sodomy, and mockery
of the victims of a massacre. It is not always easy to see the
difference between a certain witty dissent from religion and a
bullyingly racist agenda, but it is necessary to try. Even Voltaire, a
hero to many who extol free speech, got it wrong. His sparkling and
courageous anti-clericalism can be a joy to read, but he was also a
committed anti-Semite, whose criticisms of Judaism were accompanied by
calumnies about the innate character of Jews.

This week’s events took place against the backdrop of France’s ugly
colonial history, its sizable Muslim population, and the suppression,
in the name of secularism, of some Islamic cultural expressions, such
as the hijab. Blacks have hardly had it easier in Charlie Hebdo: one
of the magazine’s cartoons depicts the Minister of Justice Christiane
Taubira, who is of Guianese origin, as a monkey (naturally, the
defense is that a violently racist image was being used to satirize
racism); another portrays Obama with the black-Sambo imagery familiar
from Jim Crow-era illustrations.

On Thursday morning, the day after the massacre, I happened to be in
Paris. The headline of Le Figaro was “LA LIBERTÉ ASSASSINÉE.” Le

As judicial independence of Judges rests entirely on maintaining an
incorruptible detachment from the government of the day, that glittering
certificate given to Prime Minister Narendra Modi last week by the Chief
Justice of India H.L.Dattu was very improper and uncalled for. Is he
warming up to corner a Governorship like his predecessor P Sathasivam when
he retires on 2nd December this year? In certifying Narendra Modi as “a
good leader, a good human being and a man with foresight” the Chief Justice
of India has clearly breached the Lakshman Rekha.



The Constitution of India is very clear on the roles of the Judiciary and
the Legislature. While there is need of concerted efforts towards propping
up standards of judicial accountability, there is a very disturbing
disquiet over the slippery slope on which judicial values are slithering.
The highest standards of judicial independence must be ensured by warding
off even the faintest trace of governmental influence on the judiciary. The
demand to keep Supreme Court and High Court Judges away from immediately
taking such post retirement benefits becomes the need of the hour and will
thus ensure that those about to retire, do not run behind those in the
establishment thus giving a death knell to the independence of the
judiciary.


H.L.Dattu is no stranger to Goa and may be even look forward to having his
retirement nest in the land of fish, feni and fun. Those memories may never
fade of his public and private conduct on his four day private visit to Goa
in 2011 from 30th September to 3rd October while he stayed at the 5 star
Vivanta by Taj in Panaji.

*NGT ISSUES NOTICE ON STAY OF SALIGAO GARBAGE PLANT*

On 9 January 2015,
the National Green Tribunal (NGT) at Pune
issued notice on an appeal filed by
the Saligao Civic & Consumer Cell (SCCC)
and the Goa Foundation
against the Environment Clearance given to the Department of Science and
Technology
by the State Environment Impact Assessment Authority
for setting up a Solid Waste Management Facility (SWMF)
on our Saligao plateau above Salmona and the Salmona Spring.

The appeal has been fixed for the purpose of interim relief of stay on
plant construction
on 16th January, 2015.

*Grounds for the appeal:*

Environment clearance has been granted prior to submission of the EIA
report.
The fact that environment clearnace was being issued prior to submission of
the EIA study
was stated in the EC order itself.

Work order had already been issued several months prior to the environment
clearance
and work had commenced at site without completion of the EIA.

Public consultation in respect of the project has not taken place,
though required,
not only as per the EIA notification 2006
but also as per the judgment of the Bombay High Court dated 30.7.2003.

The project has been approved on Sy. No. 47 of Calangute village
which is explicitly prohibited by High Court order dated 30.7.2003
(and confirmed by subsequent Court orders) on environmental grounds.

The SWMF is approved in designated forest area without mandatory forest
clearance.

The appellants have alleged that the Terms of Reference relating to the EC
had not been posted on the website of Dept. of Science and Technology (DST)
as required under the law.
The DST had not put up the EC on its website,
the copy of the EC had to be procured under the RTI Act from the
authorities.

The appeal also sought the Tribunal's direction
for recovery of the amounts spent on 38 individuals
*(including 3 from Saligao!)*
who had been taken by the Goa government to Europe
to inspect garbage management plants there.
The appeal stated that none of the persons were experts in garbage
management.

Appellants are vitally concerned about this SWMF,
having themselves approached the Hon'ble High Court more than a decade ago
to halt the garbage disposal on the Saligao plateau.
The indiscriminate dumping of garbage of the plant
has already polluted the Salmona Spring and village wells.

Born in Lucknow,
India, Waris Hussein moved to England at age nine with his parents. He
studied at Eton, Cambridge and the Slade School of Fine Art. Later he
briefly worked as an actor before being accepted on the BBC directors'
training course. He made his directorial debut on the soap Compact (BBC,
1962-65) but only gained real recognition after helping to launch Doctor
Who (BBC, 1963-89; 2005- ) in partnership with producer Verity Lambert.
Hussein was instrumental in selecting the original cast and establishing
the template for the show by directing the pilot story 'An Unearthly
Child' (tx. 23/11/1963). This already contained many characteristics
that would recur throughout his work: elaborate tracking shots, a
fondness for depicting protagonists isolated from their surroundings and
a special interest in female psychology. This is particularly evident in
'A Passage to India' (Play of the Month, tx. 16/11/1965). One of his few
works to directly address his Asian heritage, it depicts with typical
sensitivity the plight of outsiders on both sides of the racial divide.
After starting in television with work on Doctor Who [1] (1963)
(including directing the very first episode, Doctor Who: An Unearthly
Child [2] (1963)), Hussein moved on to film, directing such legends as
Lord Laurence Olivier [3], Dame Bette Davis [4] and Joan Plowright [5].


Hussein directed feature films, starting with A Touch of Love (1969),

in the Bronx (US, 1970), the box-office hit Melody (aka S.W.A.L.K.,
1971) which re-unitedMark Lester and Jack Wild from Oliver! (d. Carol
Reed, 1968), and The Possession of Joel Delaney (1971), an unusual and
intriguing New York-set horror tale that was barely released. Like so
many British films of the 1970s, Henry VIII and his Six Wives (1972) was
made to capitalise on the success of a television series (The Six Wives
of Henry VIII, BBC, 1970) and proved to be his final cinema project for
25 years. 

He received a BAFTA award [6] for _Edward and Mrs. Simpson_
(shared with producer Andrew Brown), and an Emmy Award [7] for the Barry
Manilow musical _Copacabana_ [8]__ 

 While considering himself a
British filmmaker, Hussein has worked both sides of the Atlantic, as
well as in the country of his birth, India.

Yesterday (Jan 11) Filomena Saraswati Giese, President of the Joseph Naik Vaz 
Institute, met Bishop Joseph Vianney Fernando of Kandy, a key player in the 
canonization cause of Joseph Vaz, at the 4pm rehearsal for the Jan 14 main 
event. Also present was the Postulator of the Cause. Both of them acknowledged 
and thanked the Joseph Vaz Institute for their efforts over the years to 
promote the Joseph Vaz cause, a role which is now officially recorded at the 
Vatican in the Joseph Vaz files. Today representatives of the Joseph Naik Vaz 
Institute, Filomena Sarawati Giese and George Pinto met with the Sri Lanka 
Ministry of Mass Media who warmly welcomed them and whose kindness was greatly 
appreciated.

Security is now blanketing much of the city as the Pope's arrival is a day and 
half away. Security is very heavy along the Pope's route with the military, 
police, and undercover agents in full force.  Navy boats are patrolling the 
waters behind the GALLE FACE GREEN venue where the canonization mass will be 
held and which backs up against the Indian Ocean.

Science and art. Performance, philosophy and design with an emphasis
on interactive education along with barrels of fun. These are the
ingredients assembled for a homegrown international initiative that
will brighten up Panaji next week.

The Story of Light Festival (January 14-18, thestoryoflight.org) is
the product of unusually collaborative thinking, and a global team of
young people coming together to create something totally unique and
visionary.

The idea first developed when a group of friends from around the world
gathered in Goa for the 2012/2013 year-end celebrations at the home of
Nash Paul D'Souza in Maina, Socorro. The host is a graphic designer,
his friend (and new Goa resident) Jaya Ramchandani studied physics and
astronomy, and is passionate about "informal" science education. Along
with others, the creative pair dreamed up an idea to mock up D'Souza's
house as the human digestive system just for fun, to invite the
neighborhood to walk through "what happens to a 'pao' once you eat
it". The result was a big hit in Maina.

Back again for the following New Year, D'Souza, 34, and Ramchandani,
32, started to think about another science-meets-art project that
could reach even more people. Some time earlier, Ramchandani had
participated in a conference in Poland where she viewed presentations
from UNESCO about the International Year of Light in 2015. This became
the seed for the plan for The Story of Light Festival, which the two
friends took to the corporation of the city of Panaji's commissioner
Sanjit Rodrigues, who responded enthusiastically and offered CCP
support.

The Story of Light website went live in July 2014, and an impressive
team of participants, supporters and volunteers from around the world
started to coalesce, everyone galvanized by the festival mission to
dream up "interactive installations, conduct unique workshops and hold
performances right on the streets" of Panaji, "to unravel all the
mysteries of light". Universities and research institutes raised funds
to participate from Japan, Italy, USA and UK, the Netherlands,
Portugal, Philippines, Argentina, Brazil and the Czech Republic, as
well as from across India.

D'Souza and Ramchandani were told they would have no problems funding
the festival if they moved it away from Panaji. One sponsor offered to
bankroll the entire event if Goa was replaced by Mumbai or Delhi. But
Ramchandani says, "The world goes where intention goes. It's all about
what kind of information goes out from where and to what audience. We
wanted to present science and art in an innovative way to this
society, in Panaji, in Goa, even if it meant a smaller budget,
crowdsourcing, and putting in our own money."

There is an infectious, utterly charming spirit at work at The Story
of Light Festival that is hard to resist. There is no money for
hotels, so all the scientists and artists (99 of them) are cheerfully
living dormitory-style in rented houses. Everyone is pitching together
to accomplish an ambitious schedule: a wide range of performances,
workshops, talks and 33 public installations spread throughout the
city from Goa Science Center to the public staircase leading up
Altinho to the High Court.

Jaden Hastings and Melanie King will work with festival-goers to make
the world's largest cyanotype (a kind of photographic print) in the
surf at Miramar. On the Mandovi promenade, dancers Flora Barros and
Samira Marana will perform in a life-sized camera obscura, while
nearby, Gene Kogan and Alec Schachner created "an immersive
interactive audiovisual environment" to "invite the viewer into space
where every movement generates light and sound".

A giant star suspended in front of Panaji church by Vishal Rawley will
light up and rotate if passers-by correctly answer quiz questions on
light. Exhibits in the Old GMC building and other locations take
inspiration from bioluminescence, photosynthesis, rainbows, and other
aspects of light. There are several events meant especially for
children, as well as workshops on solar cooking, illuminating the
mind, light painting and light bending, and 'Opticks' where images
submitted by the public will be transmitted to the moon and back in
real time!

The Story of Light Festival neatly illustrates what can be
accomplished in Goa with enthusiasm, camaraderie and old-fashioned
good ideas, even in the absence of grand budgets. At the precise time
that state agencies are touting absurd schemes like 'amphibious
tourism' and 'hot-air ballooning' and doing nothing to stop a
grotesque 'floating hotel' from joining the deeply unpopular casinos
that already pollute the Mandovi, Nash D'Souza, Jaya Ramchandani and
friends are illuminating a much better, far saner and more sustainable
way to get the world's attention. They deserve both congratulations
and support.

[Goanet] THE WAY AHEAD FOR GOA

Over the last three years Manohar Parrikar kept fooling the people of Goa
by falsely claiming that the State coffer was very healthy with nothing to
worry. However that the State exchequer was heading towards bankruptcy was
always an apprehension and it is now official.



The very casual recent office memorandum issued by the Government on
economy measures and rationalization of expenditure is no solace or
solution to the deep financial crisis the State finds itself embroiled in.
Fiscal accountability and responsibility has to be an ongoing sustained
process and cannot be a short term measure.



The Government needs to start with slashing the very exorbitant fees of
eight lakhs a month being paid to Advocate General Atmaram Nadkarni by
bringing it on par with other states to a maximum of one lakh.



Instead of the current jumbo cabinet of twelve, Goa can be well governed by
just five Ministers.  With the bureaucracy already over bloated there needs
to be a total ban on any further recruitment. The services of unnecessary
consultants and advisors appointed with a plum salary in various
departments must be terminated. Needless public functions should be avoided
as there is no need of one to lay the foundation stone or inaugurate
drains, culverts and public toilets. Wasteful expenditure on newspaper
advertisements must also stop.



Quality control in all public works must be strictly ensured to avoid
recurring expenditure. Government departments including Ministers must use
modest budget cars instead of the current swanky and expensive ones. Those
government schemes which have ended up being vote bank gimmicks cannot be
allowed to burden the tax payer.



Pointless Corporations created to rehabilitate politicians need to be wound
up. The use of existing government owned buildings needs to be optimized
before hiring private premises. Government owned vehicles should be first
put to utmost use before without reason hiring private ones.



To elicit suggestions and opinions from the people on the way ahead to pull
Goa out of this financial disaster, Chief Minister Laxmikant Parsekar
should have an open public interaction at each of the 12 talukas.



Due to the follies of the government we have landed in this fiscal
upheaval, however now it is the duty and responsibility of every Goan to
work towards restoring Goa back on the road to economic prosperity.
