The Gram Sabha is a wonderful exercise in democracy at the grassroots lelel. I take it thatthis Gram Sabha took place in Moira ? When I first came to Goa nearly 14 years ago, my neighbors urged me to attend the GramSabha meeting in Socorro. I was not an Indian National at the time and hence not on the voters list. The Sarpanch chairing the meeting knew me well, and was aware of my status, but allowed me to participate. I even expressed my views about the messy garbage situation in Socorro at the time. As I recall the Gram Sabha meeting it was a raucous affair, with the Panch members squirming uncomfortably in their podium seats. There was a contingent of lathi wielding policemen outside the venue, in case trouble broke out. Attendees expressed their ire on various issues in thevillage. It was a true exercise in democracy with citizens interacting directly with their locally elected leaders. I was impressed. A book was passed around for attendees to sign but it was not offered to me because the staff of the Panchayat were aware that I was a foreigner. At that juncture, I left the Gram Sabha. From Augusto's report, it is evident that things have not changed over the years even though this is in a different venue from the one that I attended. Garbage was an issue that bothered me. I expressed m displeasure to then CM, Parrikarabout the trash strewn along Highway 17 which is the main thoroughfare between Panjjim(or Ponje or Panaji) and Mapusa. This was at an NRI convention perhaps in 2002.Mr. Parrikar promised action within 7 days. He kept his word and on the 7th day the highwaywas litter-free. But on the 8th day onwards little by little the litter increased. The good news is that in recent years I see a gang of workers collecting and bagging the litter along Highway 17. It is markedly cleaner than how I remember it being. In our Socorrovillage, thanks to our dynamic MLA Rohan Khaunte, we now have daily door to door garbage pick up. It I managed by the Panchayat and a fee of Rs. 200/- per annum is tagged on to theannual House Tax, to defray this expense. This is a small price to pay for this great service.Perhaps the Moidekars will take note.

The story does not carry quotes from the ‘victim’ and ‘perpetrator’ but it is insufficient to prove that Mayabhushan has not spoken to (or known) them. However, quotes do lend a story a certain credibility.2. As we have seen, time and again, news of such incidents only cause the woman victim untold grief. There is curiosity about her identity, character and antecedents, and even before a formal complaint has been filed, the jury is out and her name is made mud. Whether she is rendered unemployable is anyone’s guess. The ‘perpetrator’ on the other hand, is let off with a school masterly warning, not to mention a promising career. 3. But the good news is that the law does not regard such impediments as loosely as balcao talk.The Sexual Harassment of Women at the Workplace (Prevention, Prohibition and Redressal) Act, 2013, defines sexual harassment as acts (direct or implied) like: (i) physical contact and advances involving unwelcome and explicit sexual overtures; or(ii) a demand or request for sexual favours; or(iii) showing pornography against the will of a woman; or(iv) making sexually coloured remarks; or(v) any other unwelcome physical, verbal or non-verbal conduct of sexual nature. Punishment: 1-3 years of simple or rigorous imprisonment. 4. Under the above Act, organisations are supposed to appoint their own Internal Complaints Committees, but in case they haven’t, the complainant can approach the Local Complaints Committee appointed by the District Magistrate or Collector. If she is unable to come forward and write out a complaint, the Local Committee is supposed to assist her with it. 4. But as we’ve seen, stigma and humiliation (heaped by both men and women in society) deters women victims of sexual abuse from filing formal complaints. Our courts are also to blame for the shoddy and insensitive manner in which they handle these victims during proceedings. But good news, once again, comes as the Supreme Court’s judgement in B C Deva versus State of Karnataka, 2007, which puts the version of a rape victim above material evidence in proving the crime. http://www.readwhere.com/read/c/6227789 Tourism Travails and New directions Back to the Drawing Board Pamela D'Mello The Goan 17 Aug 2015 After a particularly bad year for the tourism business in Goa, it was interesting to listen to legislators and government explain away the issue and detail their analysis on what they perceived had gone awry with the Goa tourism growth story. The tourism department statistics reveal that charters in the year 2014-15 dropped to 813 with a total of 1,54,047 tourists on board, from 1128 charter flights in 2013-14 with 4,41,543 passengers. Total international arrivals dropped from around 5 lakh arrivals in 2013-14 to 4.41 lakh arrivals in 2014-15. Domestic visitors dropped from approximately 35 lakhs to 28 lakhs in 2013-14 and 2014-15 respectively. For an industry that the government said added some 300 hotels, 84 travel agents, 127 water sports operators, 1583 tourist taxis to existing numbers, the point being made by government was that supply was over-stripping demand and the resultant glut in services on offer was seeing everybody in the industry vying for smaller bits of the proverbial tourism pie. There's bitter irony here, that in a bad year the government should indirectly blame the services glut and over expansion in the sector for the problems of industry --- when it has no qualms about merrily dishing out fresh permissions and licenses without any concern for the region's carrying capacity. That the overload has continued to ridiculous proportions is palpable from the cut pricing on the ground. It's a time when larger outstation corporations and firms with deeper pockets and longer staying capacity, who perceive Goa as one of many investment destinations, are muscling in on the older existing local homespun industry that has for long buoyed the sector. If employment and welfare is the key concern of government (as it should be), then tourism administrators and government would afford more time and effort to organise and revamp local service providers, rather that bring in newer, bigger players. At the macro level, last year's slump of between 20-25 % has a number of external causes that are typical of the way tourism is structured, dependent on the vagaries of international events outside anybody's control. A tiny leisure destination like Goa can tank under the effects of European sanctions against Russia (the major charter market) and falling oil prices, leading to the latter's economic downturn. Hotels in Goa responded by dropping tariffs and offering packages to domestic visitors, to make up the losses. But increasingly, the industry is perceiving the need for a more collective agile response to crisis management --- one that government and its administrative bodies are incapable of helming. The industry is arguing for the setting up of a dedicated tourism board, that is independent of government, but has representation of government and industry stakeholders, with government fiscal backing. The idea was first suggested by the CII in 2008, but has never become a reality. They see it as a body that would advise government, aid in preparing Goa centric tourism policies and strategise for short and long term planning. From all indications there is definitely a huge gap in the understanding and responses between the trade and government. While the tourism department concentrates on the tedious and time consuming processes of annual licensing, tariff collections and data collation, the Goa Tourism Development Corporation has its own hotels to manage and overhaul and events to promote. It's being argued, with some justification, that the processes of governance leave it with little bandwidth to grapple with and respond to the fast paced ground level changes that make and unmake destinations, the cut throat competition that is now underpinning the global tourism marketplace. The articulate former TTAG head Ralph de Souza says the global industry has changed drastically but Goa's responses have not kept pace. The days of mass tourism and assured large packages are definitely declining --- brought about by increased air connectivity, the opening up of newer destinations and increased flight costs. The bump in FIT numbers over bulk group bookings and the fact that bulk of the bookings are over the Internet, requires an altogether different response and marketing model. The entire ecosystem calls for detailed, user friendly, interactive websites and Apps and fleet footed reaction mechanisms to what the global market throws at you. In the competitive cut throat global marketplace, countries like Sri Lanka and Thailand are offering free landings as incentive, while Maldives offers dollar incentives per flight. Destinations in India are known to pay tour operators $ 15 a pax. Cambodia,Vietnam and Laos offer joint budget packages. Goa's failure to keep pace is seen as one of the reasons for its inability to hold onto its share in a buyers market. There could well

http://timesofindia.indiatimes.com/city/goa/MONEY-LAUNDERING-in-Goas-Casinos/articleshow/48488762.cms One of the many open secrets now tumbling into the media spotlight as part of the Louis Berger bribery case involves Goa's deeply unpopular casinos, via the accused hawala operator, Raychand Soni, who was arrested by the Goa police last week for supplying crores in cash to be paid in bribes to former chief minister Digambar Kamat, and former state public works department minister Churchill Alemao. The crime branch testified that casinos are running on his (Soni's) funds. The special public prosecutor G D Kirtani told the presiding judge, B P Deshpande, that Soni funds many casino gamblers in Goa. It appears that huge sums of cash have been continuously funneled through Soni's shop in Panaji since 2009 - all part of the ocean of black money that is awash everywhere in India, where there is more unaccounted money than the rest of the world combined. Like the property market - which has also seen a highly inflated bubble in Goa - the poorly regulated casinos of the state are a reliable way to launder and park illegal funds. Make no mistake, money laundering is the bread and butter of the casino industry wherever it has established itself in the world. In Australia, a Vietnamese criminal named Pete Hoang, by himself, generated an estimated turnover of $1 billion between 2000 and 2012 - a huge percentage of the entire industry's gambled funds - and as all that cash passed through his hands into official receipts, the casinos colluded to give him loyalty cards under different names. But that is only one outrageous case. Just a few weeks ago, the USA government's treasury department's financial crimes enforcement network levied one of its biggest ever fines - an incredible $75 million - against the Tinian Dynasty Hotel Casino on the Northern Mariana Islands, a US commonwealth, for willful and egregious violations of money-laundering rules. This closely follows another $10 million fine imposed on the Trump Taj Mahal casino in Atlantic City, New Jersey, for similar violations. Even given that recent history, it should be noted that there are strict regulations in the USA, and there remains some measure of oversight and law enforcement. In Goa, there is very little of anything like any of that. Here, the situation is much more like that of Macau, where the casinos are rigged as money laundry machines, and organized crime dominates from behind the scenes. According to secret diplomatic cables released by the whistle blowing website, Wikileaks, Macau casinos phenomenal success is based on a formula that facilitates...money laundering, upwards of a phenomenal $200 billion per year. There is much more in those diplomatic cables on Macau that could also apply to Goa's casinos - Facilitator organizations work closely with organized crime groups to identify customers and collect debts. Junket operators work directly with casinos to buy gaming chips at discounted rates, allowing players to avoid identification Know-your-customer (KYC) and record-keeping requirements are significantly looser than in other international gaming venues. Oversight...is limited and remains a serious weakness. A final comparison between Macau's dangerously out-of-control casino industry, and Goa's insidiously growing menace, is the redirection of that pipeline of unregistered black money via the casino tables directly into the political system. One person who makes his fortune on the gaming tables in Macau is Sheldon Adelson, the casino magnate who is also a would-be political kingmaker in both the USA and Israel. But there is a backlash against his use of dirty money, whereas here in Goa, exactly the same kind of tainted funds are now touted as a public necessity by the same BJP that protested against casinos when in opposition. It is a shameless bait and switch tactic, and completely against the public interest. Why does Goa have casinos? Why are they bang in the middle of the river opposite Panaji? Why are images of gambling allowed on billboards, and broadcast on the side of a casino right in the centre of the state capital? Why does this extremely dirty, globally reviled, utterly degraded, extraordinarily dubious so-called industry continue to hang on in a state that does not need it, and despite a public consensus against casinos that has only grown, strengthened and redoubled over the past decade? It's the money, stupid. Just follow the money.

It also addresses the general perception that such criminals tend to repeat their act and hence need to be monitored. A look at laws in other major countries, however, suggests that only the names of convicted offenders are required to be listed. In many cases, the public at large does not even have access to this database though the police do. A 2014 report of the office of sex offender sentencing, monitoring, apprehending, registration and tracking (SMART), the US government agency to monitor such crimes, states that such registers are maintained by at least 19 countries including the US, the first country to pass a national sex offender registration law in 1994. Other major countries that have similar laws include the UK, Canada, France, Germany, South Africa and South Korea. According to the report Austria, Finland, Israel, Malaysia, New Zealand, Switzerland and UAE are among many countries that have considered or were considering such laws. A study of conditions of registration as sex offender in the US, UK, Canada and Australia shows that it is mandatory for those convicted for certain sexual crimes to register themselves in the sex offender database. Typically, the offenders are classified in various categories depending on the seriousness of the offence and the perceived threat to society. In the US, there are three levels of registered sex offenders. Following their release after the conviction, sex offenders are required to register with the community's division of criminal justice service, which examines their case. Depending on factors like the use of force, victim's age, number of victims, use of weapons, alcohol or drugs to assault the victim, offenders are classified into level 1, 2 or 3. Level 1 offenders are people who are considered the least likely to repeat the crime. Level 3 is the classification given to those judged most likely to commit the crime again. Offenders are further classified as 'sexual predator', 'sexually violent offender' or 'predicate sex offender'. Level 1 offenders, if not classified in the above three categories, are required to register themselves for 20 years. Level 2 and Level 3 offenders along with people classified as predators, violent offenders or predicate offenders have to register themselves for life. Failing to provide information of their whereabouts to the register is an offence punishable with imprisonment for up to ten years. Other countries too have levels of classification and registration periods for sex offenders. In a majority of the countries that maintain sex offenders' registries, the database is not publically available. For instance, the UK, Germany, France, Canada and Australia don't maintain a publically available database. The monitoring is done by informing the local police and community leaders when a person convicted of a sexual offence starts living in a particular community. Times View The home ministry's proposal to 'name and shame' those charged for sexual offences by putting their names in the public domain runs completely contrary to the principle that underlines our justice system - the accused are presumed to be innocent until proven guilty. Other countries too have a system of making the names of sexual offenders public, but nowhere is this done prior to conviction. The reasons are obvious. A person charged with a sexual crime may ultimately be judged innocent by the courts. How fair would it be in such cases for his reputation to have been badly tarnished in the meantime? The ministry's suggestion that where this happens the name can be taken off the list does nothing to redress the damage done. It also needs no great imagination to see how such a system could be badly abused by people out to settle scores with one another. It's an idea that needs to be amended before it is rolled out. =

Goa’s image is taking a heavy battering Eugene Corriea The political parties are sharpening their knives for the elections, even though there’s a long time for the ballot box to be set up. The high drama will obviously be played out in the open and the candidates will indulge in the art of slugging, hurling accusations against each other and pinpoint deficiencies in their opponents and, thereby, try and convince the electorate why he/ she is the right choice. The ball has been set rolling in the courtroom since Churchill Alemao was arrested and lodged in jail while Digamber Kamat, at the time of writing, is on tenterhooks whether he will be joining Churchill in the slammer. With this latest political drama, Goa is front and centre of Indian politics. There was a time when such political action or political tamasha took place in other states and Goa sailed without much of the stormy political winds blowing outside its borders. But decades have passed since Bhausaheb Bandodkar occupied the chief minister’s chair and his Maharashtra Gomantak Party ( MGP) was supreme with the baton passing to his daughter Shashikala Kakodkar. Today, Goa presents a different picture. The tourist portrait is alluring and is the magnet that attracts both local and foreign tourists, but the political picture isn’t flattering but rather downright disgusting. On one hand, Goa is projected as the ideal tourist paradise, never mind the wrinkles such as the drug trade, prostitution and rapes, with even foreign tourists being victims of carnal desire, while, on the other hand, the political landscape makes Goans bow their heads in shame. It only makes some of the Goans ask themselves as to what has happened to Goa, a land that they were proud of its beauty, culture and heritage and would shout from the rooftops, even from thatched huts: amchem Goem, bhangarachem Goem . Goans, both inside and outside, were narcissistic. Times have changed, and Goa has changed just as India has changed since it won its freedom from British rule on August 15, 1947. I am not one of the “ midnight children”, as the great writer Salman Rushdie said of the generation that came around that time. When freedom came to Goa, though some still have trouble with the word “ freedom” and rather see it as the new enslavement, there was no denying that Goa would be swallowed by the hydraheaded behemoth that is India, with its thousand of languages and hundreds of cultures. The North is so different from the South, and so is the East from the West. As the Canadian professor, Arthur Rubinoff, who wrote his doctoral thesis on Goa’s newly gained independence in a book, “ India’s Use of Force in Goa”, and later followed it with another book, The ‘ Construction of a Political Community: Integration and Identity in Goa”, remarked, in an essay, that with each passing day, Goa becomes like the rest of India. Rubinoff ’ s words came rushing to my mind on reading the political nuances and the politicking taking place in Goa in current times. Some may curse Nehru for Goa’s ills today, or some may praise Nehru for bringing democracy to the land that was locked with the iron hand of dictatorship. So, one must live and let live as Goa is part of India. There’s no looking back except for nostalgic reasons. The way is to survive and make do with the best of what Goa can do and achieve for its citizens. But with each passing day, the fight to survive the daily onslaughts on the image of Goa from the nefarious political intrigue and deceit taking place routinely has become a harrowing experience for its residents. The whole atmosphere is vitiated by the level of corruption that’s slowly but surely suffocating the people. For too long the people have borne the shenanigans from politicians, especially those who are in power at the time, and we now see the people lose its patience and express its displeasure in no uncertain terms. A democracy is vibrant when the people are vigilant. Whatever may be the reasons with both Churchill and Digamber brought to justice after a long period to face the bribery charges,. Though it could be witchhunt or it could be political revenge or party gamesmanship, it’s just the tip of the iceberg of corruption taking hold in Goa. If the case comes to its logical end, and if it sinks the political careers of Churchill and Digamber then it’s a victory for the people, though it could be seen as a sledgehammer blow to the Congress. The courtroom battle is a forerunner to the coming of the battle of the ballot. It doesn’t matter which party wins, Goa is the ultimate loser. It’s too high a price to pay for the battering Goa’s image is taking across the nation and the world. ( Eugene Correia is a senior journalist) -- eugene
