UnitedGoansFoundation accuses the BJP led Goa government of using the
Crime Branch to sabotage the Louis Berger Bribery Case. By focusing
the entire case on the Missing file, Churchill and Digambar, the Govt
has narrowed the scope of the investigation and has diverted the
attention of the public on a tiny aspect of the mega scam. Even the
RakshaMantry said that this is not even the tip of the iceberg.

Ever since the news broke out in the US of LB paying bribes to two
Goan Ministers, the public is lead to believe that the investigation
is moving at blazing speed which raises several questions. How was the
CM so confident that CB would be able to prepare the preliminary
report in just 2 days? Was the Govt tracking the LB judicial
proceedings in the US? Why was ManoharParrikar, after knowing which
ministers were involved and where the money was exchanged, did not
come forward with the information when he was the CM. Why did the CB
not summon Parrikar? Goa has been reading about the several U-turns by
the Chief minister wherein he initially states that the LB
investigation will be handed over to the CBI because it has
international ramifications. Later he says that he wont be asking the
CBI to investigate the case since Crime Branch is doing a good job.
This is not true because the case has now hit a deadlock over a
missing file.

UGF points out that two of the three officers who are investigating
this case have a dubious track record. One officer, DattaguruSawant
has a history of extortion, was dismissed from his job, accused of
assault and is being currently investigated for extorting a helmet
from a porter at Margao railway station. Another officer,
VishweshKarpe is famous for not registering FIR in CyprianoFernandes
custodial death case and threat to kill case filed by Aires Rodrigues
against VishwajeetRane. He is also alleged to have assaulted an animal
rights activist in the police state. During his tenure in Anjuna, the
entire drug lobby had a bull run. The third offier, KhartikKashyap who
had prepared a dossier of drug trade couldn’t find more than 5 drug
peddlers in south Goa. Also, with regards to the online goan
prostitution websites where the most effective method of crackdown
would be sting operations, his excuse for inaction was the website
hosts don’t always cooperate. UGF questions the wisdom of the CM to
appoint these officers who lack experience in investigating such a
case. ? The CB has a history ofderailing investigations such as the
LPK waterfront case, Vasco rape case and the illegal mining case.
Equally shocking is the statements made by CB that the casinos run on
Soni’s black money. The CB’s inability to build strong cases in the
past raises serious doubts of whether LB bribery case will ever reach
its logical conclusion. UGF questions why this case is not being
headed by the DGP himself.

UGF also questions the aspect of the missing file. Why is the Crime
branch stressing so much on a file?If the CB had just delved into the
actual procedure which entails any loan arrangement with JICA they
would have realized that all documents have to be vetted and confirmed
by JICA during each and every step. So technically speaking this file
should be in possession of JICA and also JBIC which could easily be
obtained. What is the real intent of the Crime Branch? Is the file the
real clinching evidence or is it just a ploy to divert the attention
of the public and the courts?Till 2012 it was the Congress Govt and
from 2012 it was BJP. When did the file go missing? Does the govt
believe thatDigambar and Churchill took the files when the BJP was in
power or if the same happened before 2012? Why was an FIR not filed
against the current PWD Minister? UGF also strongly doubts whether the
CB did an inventory of all the files it seized during the raid at JICA
office or else we wouldn’t have had the PIO stating that the files
were with the CB and the CB not contesting the PIOs statement straight
off in Court.

UGF further questions the stark contrast in the way CB approached
Churchill and Digambar. Why wasn’t Digambars house raided?  While
Churchill as arrested at night, Digambar had filed for anticipatory
bail just the previous day. How did he know that he would be arrested?
How did this information leak out.Did someone in the CB or govt or one
of his bjp buddies tip him off?

UGF believes that there is a huge cover up happening, and like all
other cases, the investigation will be shoddy but prolonged so that
the people forget the issue, the prosecution will sabotage the case
and the judge will have no choice but to dismiss the case. In the end
people will lose faith in the judiciary. This is what the BJP Govt
wants.


[Goanet] BOMBAY CHIEF JUSTICE MOHIT SHAH URGED NOT TO ATTEND GOVT DINNER

Bombay High Court Chief Justice Mohit Shah has today been urged not to
attend the dinner being hosted for him by the Goa Government on August 20th.
Chief Justice Mohit Shah who is retiring on September 9th is scheduled to
visit Goa on 20th and 21st of August.



In a letter faxed to Chief Justice Mohit Shah today, it has been stated
that with an immense sense of deep anguish and in public interest, he is
requested not to attend the dinner that is being hosted by the Goa
Government.



Chief Justice Mohit Shah’s attention has been drawn that the cash strapped
Goa Government which has been unable to even pay the monthly pension
payments for the last two months to the old age pensioners under the
Dayanand Social Security Scheme has decided to host for him a lavish dinner
at the five star Marriot hotel in Panaji on August 20th.



The holding of the dinner would also be contrary to the Goa Government
circular dated 31st December 2014 calling for a total restraint on wasteful
expenditure as a step towards economy measures and rationalization of
expenditure.



By attending a dinner hosted by the Government, Chief Justice Mohit Shah
would be sending a wrong message. There is already a public perception that
the Independence of the judiciary in Goa has been compromised in the manner
in which the Goa CBI Court has been wound up and the selective targeting of
Judges with the Judges today having developed cold feet to take on the
Government for its illegalities.



It being talked that the State is proposing to appoint Chief Justice Mohit
Shah  as the new Lok Ayukta of Goa,  this would be even more reason for him
to refuse allowing the dinner to be hosted and not to participate in the
same. The move to host the dinner by the State Government is inappropriate
and it would also be highly unethical for a sitting Judge to accept a
dinner hosted by a State Government.



Never before has that State Government hosted any dinner for a sitting
Judge of the High Court, nor has any sitting Judge stooped to such a low
level, to accept any such invite. Holding the dinner would prove the nexus
between the State and the High Court, which will confirm the whispered
rumors in the corridors of the Courts and outside, of the manipulations
tomtomed by the State Government.



It is pertinent to note that a part of the Marriot Hotel premises where the
Government has planned the 20th August dinner is under a demolition order
of the Bombay High Court at Goa passed on 29th June this year in Writ
Petition 333/1993 ordering demolition within six months for being in
violation of the CRZ rules.



An extraordinary General body meeting of the Goa High Court Bar Association
held yesterday has resolved not to host a farewell dinner for Chief Justice
Mohit Shah. Now let us hope that Chief Justice Mohit Shah would act
appropriately and not attend the Government dinner.

Enjoyed reading your post. You are my vision of a good journalist ie One
who Thinks, Researches, Questions-self of the points written and Accepts
contra-comments if any. I regret that we currently do not have too many
Goan journos who are like you, Olga Tellis and Pamela D'Mello.

My comment on a few of your points:
RM 1: The story does not carry quotes from the ‘victim’ and ‘perpetrator’
but it is insufficient to prove that Mayabhushan has not spoken to (or
known) them.

jc 1: Until Mayabhushan (MB) specifically confirms or denies that he knows
and/or has had personal dealings with either or both of them, it is safe to
assume (until proved otherwise) that MB knows the alleged perpetrator
personally.

RM 2: "As we have seen, time and again, news of such incidents only cause
the woman victim untold grief. There is curiosity about her identity,
character and antecedents, and even before a formal complaint has been
filed, the jury is out and her name is made mud."

jc 2: Absolutely !  No IFs and BUTs about that.

RM 3: The Sexual Harassment of Women at the Workplace (Prevention,
Prohibition and Redressal) Act, 2013

jc 3: A rambling Act which literally forces the 'aggrieved woman' to seek
legal counsel.

RM 4: But good news, once again, comes as the Supreme Court’s judgement in
B C Deva versus State of Karnataka, 2007, which puts the version of a rape
victim above material evidence in proving the crime.

jc 4: I do not believe that the above, as stated, is Good News.

I know that there is Rape and tons of it in India and elsewhere. But, I
submit that it is also very important NEVER to convict anybody of an
unproven charge with Irrevocable consequences...ie Rape and Death Penalty
cases. In the case of Rape and Sexual Harassment, one has to understand
that False Accusations occur too! The Falsely accused too are branded for
life.

For obvious reasons, I will NOT refer in a public forum to my own
professional experience with a number of cases at a SC level, but invite
you to THINK back to the case of the unfortunate Goa College of Arts chaps
who were wrongly accused, held in custody and ? beaten up.

We could ALL agree, could we not? that there are sickos among guys as well
as gals.  Is there an Act which protects young men from being sexually
harassed ? Unless 'we' believe that Young Men are unlikely to be sexually
harassed !

So...Is the 2013, until amended, constitutional?

Is believe that we need a lot more education for ALL of us. Inter alia, we
must advise our people that (a) Sexual Harassment is real and occurs at
work as well as at home (b) We should do ALL to prevent that from happening
by avoiding situations which trigger these tragic and destructive events
(c) We all, including journos who report these stories, must understand
that there are many facets to a story. SO, please VERIFY before you destroy
lives. Some of these facets may include Instant Messages and Affairs or
even make-believe (Generic statement; Not saying that any of this occured
in this case) (d) There MUST be a shorter and more facile route from
Occurence to Reporting to Resolution.

Anybody, including 'attached' individuals can become infatuated and fall in
love with anybody else. Sexual Harassment is NOT about love.

There is much that we certainly did not expect from the Modi sarkar “We had an 
emperor on 27th of May 2014,” said industrialist Rahul Bajaj in an interview to 
NDTV, “but the shine seems to be wearing off.” The Emperor image was perfect 
for Narendra Modi on 15 August 2014 when he delivered his maiden speech as 
prime minister (PM), from the ramparts of the historic Red Fort, in a regal 
red-and-green safa(headgear). When you read this column, the PM would have 
delivered his second Independence Day (I-day) speech. Many of us, who had 
scrambled to switch on our television sets to hear the PM on I-day, for the 
first time ever, are no longer so enthused.  On the positive side, the PM has 
done well to energise India’s relationship with many nations during his 
frenetic foreign visits and to connect with the vast Indian diaspora. Mr Modi 
also earned kudos for raising the issue of latrines and sanitation on I-day and 
for following it up with the Beti Bachao (save our daughters) campaign. His 
call to post a ‘selfie with daughter’ touched people across the country. The 
Pradhan Mantri Jan-Dhan Yojana (PMJDY) was another big I-day announcement with 
the laudable objective of bringing 40% of unbanked Indians into the formal 
banking system with a no-frills account, debit card and an insurance cover of 
Rs1 lakh. According to the PMJDY website, nearly 470 million accounts had been 
opened at the end of July 2015 and a whopping Rs20,769 crore has been deposited 
in these accounts. Are these really unbanked Indians rushing to deposit their 
money in the safety of banks? Or is a PMJDY account a way to avoid scrutiny by 
the tax authorities due to its lax KYC (know your customer) rules? Only time 
will tell. The PM followed this up with two more insurance schemes (accident 
cover and health insurance) at very attractive premiums.  Unfortunately, a 
series of successful events, product launches and international visits does not 
make up for a series of mis-steps and inexplicable actions. The government 
seems badly advised about issues that it needs to prioritise in parliament and 
outside. It has failed to revitalise the economy, despite the benefit of a 
sharp fall in oil and gold prices and a decent monsoon. Its failure to manage 
parliament put it in the ignominious position of allowing the 44-member 
Congress party to lead a rag-tag opposition to boycott parliament and stall its 
key bills. But, worse, nobody has a clue why this is happening. Mr Modi 
lampooned his predecessor by referring to him as ‘Maun-mohan Singh’ but his 
silence on several key issues has begun to rankle just as much. Why are so many 
top public sector banks (PSBs) headless for 13 months when their gross bad 
loans are set to touch Rs4 lakh crore, and a whopping Rs70,000 crore has been 
committed for their recapitalisation over the next four years (in addition to 
Rs45,000 crore in the past four years)? Why is accountability of 
government-owned banks not a priority for Modisarkar?  Many of us cheered when 
the PM announced his plan to shut down the Planning Commission last August. But 
NITI Aayog, the renamed Planning Commission, is not even Modi sarkar’s primary 
think tank. According to The Economic Times, the government will dole out 
nearly Rs500 crore in fees to the Big Four audit and consulting 
firms—PricewaterhouseCoopers, Ernst & Young, Deloitte and KPMG—along with 
strategy firms such as McKinsey, The Boston Consulting Group (BCG) and Bain & 
Company by March. This ‘quantum leap’ in engagements covers Make in India, 
Digital India, smart cities, Swachch Bharat and skill development. One would 
not grudge the money spent on consultants, if the government had used them to 
also produce white papers on various issues like the Black Money (Undisclosed 
Foreign Income and Assets) and Imposition of Tax Bill, 2015, the rollout of the 
Goods & Services Tax (GST), and to draw up an action plan for implementation of 
new policies. Had this been done, the government may have avoided a serious 
loss of face on the amendment to the The Right to Fair Compensation and 
Transparency in Land Acquisition, Rehabilitation and Resettlement Bill, 2013 
(commonly known as the Land Bill) which may now be dropped. A consultant’s 
study may have exposed the myth that land acquisition is holding back economic 
development. There is plenty of land under the control of sick public sector 
undertakings that can be imaginatively redeployed for new industries with some 
smart planning and out-of-the-box thinking. But the government seems 
disinclined to look at such options.  R Jagannathan, a senior editor, has

I believe it is time we shifted our glance on the matter of evil from God to 
ourselves. The great issue before us should be our involvement in
 almost every kind of evil presently occurring on our planet. Whether we
 consider poverty and starvation, genocide, ethnic hatred and warfare, 
racial and sexual discrimination, greed and hoarding, species decline, 
deforestation, air and water pollution, land degradation, global 
warming, and even floods, droughts and tornadoes human beings now are 
responsible, directly or indirectly, to a lesser or greater degree - and
 some more than others - for all of the above.



We should stop fretting about 'theodicy' - how and why God is 
responsible for evil - and consider the increasing and appalling extent 
to which we are. This would be a salutary task for the religions, and 
especially Christianity, to take on: to help us see ourselves clearly as
 the oppressors that we are. Rather than Christianity focusing its 
concern with evil on God, let us place the blame where, in our time, it 
primarily belongs: on the privileged middle and upper classes of the 
world whose greedy lifestyle is causing greater evil to millions of 
impoverished people and to millions of dying species, as well as to the 
very health of our planet, than any so-called 'act of God' ever has. We 
are bringing about this evil continuously, silently, and insidiously 
simple by living the way we do.



So how can we not despair? What possible prospects are there for any 
significant changes occurring? I began this book with two quotations: 
one from Irenaeus, 'The glory of God is every creature fully alive' and 
the other from Bishop Serapin of the fourth century, 'We beg you, God, 
make us fully alive.' The first statement is the prophetic one, the 
description of life as it should be and as we, God's helpers, should 
make it be. But the second statement is the sacramental one, the trust 
that God is able to bring this about, through our willingness and work. 
In other words, we are not alone. 



The prophetic witness of God in Christ tells us what we must do; the 
sacramental embodiment of God in Christ surrounds us with God's 
empowering presence as we attempt to do it. The first and last words - 
the words of creation and resurrection - are Yes, not No. The No is 
enclosed within the Yes: we only discover what sin and evil are as we 
realize the joy of God's love, the love of others, and the love that is 
the world. That is the reality that I have gradually come to realize 
over the last fifty years; it is not what we must do or can do, but what
 God can and does do through us. 



We are instruments of divine love and reflections of divine glory. We
 were created in God's image, in the image of love, and our goal is to 
grow more fully into that image by loving each other and the world in 
concrete, practical, daily ways; in other words, in just and sustainable
 ways. But we are not left on our own to do this: God is with us, all of
 us, every second of every day. Our task is to become aware of God's 
presence. As we do so we will both see the world differently and be 
empowered to act differently in and toward it. We are called to see 
differently - and then to live differently, as differently as we can, 
with God's help.

Dear Sir,/s,

Earlier I have taken interest to make use  part of this British Cemetery
 for the purpose to getting elevated our Caranzalem Chapel into the Church
which was mandatory as per our Bishop rules, to have a cemetery.
 Since the request was turned down or never came up  by the Goa authorities
and others, our chapel later on was managed with great efforts to get it
elevated into the Church, by the blessing of Taleigao Panchayat and the
Bishop who have consented to use Taleigao cemetery to this Caranzalem
Church.
 Our earlier Parish Priest Fr. Lourenco along with the parishioners also
tried their level best to get the consent of this unused British cemetery
 but was turned down at that time.
Now, since the news was published in TOI that the debris and bundle of
sewerage dug stones  were dumped  at the entrance of this cemetery, and it
is true,  it shows the bad attitude of our Govt of Goa under  the control
of GSIDC who have never  bothered to look after this British Cemetery.
 The existence of this British cemetery at D.Paula ,Goa  shows  that the
British  soldiers and their nationals were buried in this cemetery.
I am sure that the British embassy must be still in touch with the Govt of
India/ Goa by giving monetary funds to maintain this cemetery. ( read
statement enclosed above of Ms. Karen Almeida, Consular Officer British
Nationals Assistance office in Goa)..
 I am to request the Govt of Goa either look after this cemetery or give it
up this land to the Government of Goa so that this place may be used for
any  religious activities or for the Under privileged/home aged  persons or
donate to the Mother Thereza home mission/institution instead of keeping it
idle and not maintained in consultation with the British embassy.

Talk about talks seem to be the most acceptable formula to deal with India
–Pakistan relations. There were 3 wars in which Pakistan had to eat humble
pie, It does not mean that fourth  war is the best option, Indian economy
may be in a better position to absorb the shock and army well prepared to
inflict serious damage. Talks therefore is the way forward,. India in the
past have refused talks , but it has not helped to solve the issue and
under external pressure went back to the negotiating table. International
portraying of Pakistan strategy has not paid dividend, In spite of Pakistan
bleeding continuously in a low intensity war, India has shown maximum
restraint with patience. Pakistan camouflages its design by calling
terrorist as non state actors and home grown feedayen. The argument that
Pakistan is itself being targeted by terrorist as well is no justification.
When UPA was in power, BJP use to cry hoarse that Govt, does not act tough,
Modi in his election rhetoric said that India will not be treated with kid
gloves .India has been vacillating between having talks and calling off to
make its point, Pakistan considers lack of consistency as some sort of
weakness .The tolerant India in spite of grave provocations, brutality and
constant violations offers the other cheek. The defense minister states
that the response is thrice and hard, Pakistan does not publicise any
serious damage to life and property. May be it is withholding, suppressing
actual figures, as if it is not affected. On the other hand the damage on
Indian side is truthfully  blown out with visuals supporting it. Is it
because the habitation on Indian side is within firing range? ,  No amount
of proof will certify Pakistan , dismissing most objective data as trash
,.India has been elastic in accommodating Pakistan concerns, but all the
bloody, brutal incident do  not inspire confidence. The Pakistan army in
collaboration with ISI acts in tandem does not admit the relations. The
flagrant violations of cease fire by Pakistan on LOC with more deterrent
fire power does not indicate sincerity of purpose The hardliners in BJP
want blood to be drawn, but it does not work that way, Involving Huriat,
separatist in pre consultations labeled as courtesy meetings is difficult
to fathom and their influence on talks between Nations is diluted. Pakistan
is running terrorists training camps and then infiltrating them under the
cover of fire. Talks must go on as there is no alternative accept war. What
is the agenda for such talks different from all the past engagements? Anti
Indian rants in Pakistan is the order, when ever talks are scheduled. That
is the only way for Pakistant army to be reckoned with and stay relevant
