An analysis of the high court ban on bull fights in Goa

Acting on a writ  petition (No. 347 of 1996), the Panaji Bench
of the Bombay High Court comprising of Justice R K Batta and
Justice R M S Khandeparkar, in a judgement dated 20 December
1996, banned the sport of bull fights popularly known as dhirio
in Goa, as a contravention of section 11(1) of the Prevention of
Cruelty to Animals Act, 1960, which is also in force in the
state of Goa.

Let's look at the merits of the case, and then ponder on the
likely detrimental effects to society due to the imposition of
the ban on bull fights, and suggest a course of action based on
reason.

  The writ petition seeking the ban on bull fights was
  filed by Norma Alvares and People for Animals. The
  petitioners' advocate was M.S. Sonak. The respondents
  in the case were the State of Goa; the Director,
  Department of Animal Husbandry; and the Inspector
  General of Police. The respondents were represented by
  the Advocate General, V B Nadkarni, with G U Bhobe
  assisting him. The intervenors in the case were Simon
  Caiado and the All Goa Bull and Buffalo Owners'
  Association. The intervenors were represented by
  Anacleto Viegas.

The arguments of the petitioners' counsel, Mr Sonak, all of
which were found to be weighty by the honourable judges, were as
follows:

  (i) That cruelty is inflicted to the animals in the
  course of the sport of bull fights and occasionally a
  bull can get gored and he can be calmed down only by
  putting to sleep. Also occasionally a spectator can be
  gored to death. In fact the immediate cause for the
  writ petition was the fact that notwithstanding the
  killing of a spectator, Xavier Rodrigues, during a
  bull fight organized at Ambaji-Fatorda, near Margao on
  17 September 1996, a further bull fight was scheduled
  to take place on 2 October 1996. That eight months
  earlier an unnamed spectator was also gored to death
  during a bull fight at Guirim.

(ii) That the conduct of bull fights is in contravention of
section 11(1) of the Prevention of Cruelty to Animals Act, 1960,
for short called the Act, and therefore is illegal and that the
respondents are aiding and abetting the illegalities.

(iii) That bull fights are associated with social evils of
illegal betting, relating to the fortunes and fate of individual
bulls, and that bull fights have become popular because of the
betting that goes with them.

  (iv) That bull fights are a recent introduction in Goa
  and though initially, no money or gambling was
  associated with them, in recent times, due to the
  patronage of politicians, the frequency of bull fights
  has increased enormously and they have become a
  completely commercial business in which spectators are
  charged Rs 35 as entrance fee and the crowd at a bull
  fight can range anywhere from 500 to 5000, depending
  on the bulls which are engaged for fighting, the
  commercialization being at the cost of cruelty to the
  animals and occasionally to human beings.

(v) That the State cannot be a silent spectator to the cruelty
to animals and choose to be indifferent to the barbaric
treatment given to animals for sheer pleasure of human beings
and cannot shirk the responsibility to take action under the Act
and under the Criminal Procedure Code, and that toleration by
the authorities of the violation of the Act will encourage
lawlessness and social evils.

  In hindsight it may be observed that the respondents
  and the intervenors both relied solely on a single
  line of defence, which proved their undoing. Their
  defence was that cruelty to animals cannot be presumed
  merely because a bull fight is arranged. Cruelty may
  occur only in the course of a bull fight depending on
  the circumstances in each case of bull fights and
  there is no presumption that there will be cruelty to
  animals in the course of each and every bull fight.
  Being so, it is not possible to prohibit bull fights
  under the provisions of the Act. As rightly pointed
  out by the petitioners' counsel, neither the
  respondents nor the intervenors attempted to counter
  the arguments put forth by the petitioners, viz
  cruelty to animals and human beings, betting etc.

In the course of his arguments, the Advocate General, V B
Nadkarni mentioned to the effect that any cruelty inflicted to
the animals in the course of their being butchered for food for
human beings, is exempted from the Act. A moot question is, how

CONTROVERSY OVER STANDING up FOR National Anthem

The controversy is assuming disproportionate dimension under present
circumstances in which intolerance is the flavour of the season Needlessly
it is turned into a battle and war of words between Hindus and Muslims,
thus aggravating already surcharged atmosphere Every school going  student
i India is ingrained respect for National anthem, unless the people under
scanner never attended any formal schooling to be ignorant about it. It is
another matter why National anthem is introduced  in cinema halls by
legislation, since 2003 in Maharashtra by NCP and mandated to stand in
order. Earlier it was played at the end of the show and doors were locked
till it was over It also states there in that people can exercise their
choice What is disturbing is that spectators take law enforcement in their
own hands and chuck them out  in spite of having valid  tickets,
intimidating, showering with abuses short of physical assault What is their
explanation? Is it downright defiance, knowingly, willingly,
conscienceciously or just mild  indifference? Could there have been better
civilized alternative response? It is only fuelling religious divide,
hatred and animosity. It is pure lumpenism to hackle down for not standing

Even though there is no constitutional codification, legal enforceability,
it is morally binding and is no more personal CHOICE and liberty. but
believe in the cause. Standing up during National anthem is not a barometer
of displaying patriotism publicly .National anthem and flag are National
identities and every citizen must show due respect as  a matter of pride
and honour, Instances of Johny Lever I 1988 taken to task officially, In
2003 Tokyo teachers were castigated for refusing to stand and in 1966 NBA
player was also suspended for same reasons. Showing reverence, respect by a
simple gesture by standing to order for few seconds is an indication of a
cultured, educated , dignified citizen of a Nation.Playing of National
anthem of individual players in soccer team, olympics is drive the sense of
national pride. It is highly debatable as to how carelessly,
disrespectfully people stand during such an exercise without  respect and
dignity

Goa Chief Minister Laxmikant Parsekar has further punctured and virtually
ruptured the autonomy of the Anti-Corruption Branch (ACB) by abruptly
shunting out its head SP Bosco George. This only reaffirms that this
government’s so called mantra of Zero Tolerance to Corruption is just
another hoax. The double talk by the Chief Minister stands exposed as he is
not allowing the law to take its own course.


The transfer of Bosco George is over the Chief Minister’s fury that
his brother-in-law
Ghanashyam Malvankar an officer at the Industrial Development Corporation
was recently arrested while caught red-handed accepting a bribe of Rs 50,
000.


For the ACB to fairly and fearlessly investigate and prosecute the case it
was imperative that Laxmikant Parsekar should have not continued at least
as Home Minister as the ACB would expectedly be subtly arm twisted to hush
up the case or face retribution. And ironically the ACB would require the
sanction of the Chief Minister himself to charge sheet his brother-in-law.


The ACB is a wing of the Vigilance department very independent of the
Police which directly reports to the Chief Secretary. But the ACB is now
sought to be controlled and manipulated by the police at the instance of
the very controversial lackluster IGP Sunil Garg who is virtually calling
the shots at the behest of the Chief Minister.

What is the point of having the anthem played in the theatre? t is
churlish, and feudal to expect people to accord respect in a theatre when
in the first place there was no need to have it played in that venue. How
can such things be considered morally binding. By using that logic there is
little than can be done as we begin thinking in binding terms. Even it will
be akin to seeing slavery as freedom, police brutality being good to keep
us upright, taking bribes being just payment for a job well done. Zalem

I recently stood at attention when the US Anthem was played and registered
the surprise on the faces of the police? Why? Think about it? It was for
the feast of St, Martin de Porres.

When did anyone get the feeling that Indians did not have a lumpen streak!
Here let us go with the synonym, vulgar. Vulgarity thrives in many, many of
us. But we smell like roses despite it. Did we not know this? Have we not
seen some of it in those close to us, even in our families? Kitem! --
kuddea, ki zoddea zaleat? It is part of the 5,000 year and counting
civilization. Ask the so called freedom fighters. Nothing can disabuse that
reality, or better yet fact. We like to come across as decent, and some are
truly egalitarian. Most are not, but we manage with the graces we are

GOA SU-RAJ PARTY congratulates the Herald editorial and goes a step forward
to deplore and condemn the shunting of SP Vigilance Mr. Bosco George by the
CM & Home Minister of Goa in a vindictive manner and pleads with the
majority of  right thinking people of Goa to FORGIVE HIM FOR  HIS LAPSES AS
HE DOES NOT KNOW WHAT EXACTLY HE IS DOING. He seems to have cut off his

& ORDER [4] POLICE of its ROAD MAP FOR GOA to Goa's Honest to core Law
Enforcement Officers and shall see to it that they be honoured through
implementing what has been said in words, thoughts and spirit as under:

*Police Department shall be freed from the interference by the Executive
Branch. It shall be fully equipped to fight crime with modern methods.
Police stations shall be provided with adequate transport/patrol vehicles
fitted with modern communication facilities. Recruitment procedures shall
be streamlined to give equal representation to the main communities of Goa.
The Police force shall be brought under a ‘Civilian Services Board’.  A
public relations bureau shall be set up at the police headquarters which
shall be responsible to implement and oversee the establishment of public
relations desks at each police station to improve police-public relations
at all levels. Such designated officers at every police station shall be
responsible for the building up of the confidence of the public in the
police force, follow-up on criminal complaints and complaints against any
police personnel for dereliction of duties and/or misconduct. Special
programs shall be designed to train all police personnel in matters of

GSRP strongly believes that Tomazinho Cardozo, with due respect to him, is
burping from a longtime of indigestion caused by politricks more than the
politics that he was a part of.

As a past politician himself and an honourable speaker of the august Goa
legislative Assembly under the then Congress regime, his honesty as
the speaker of the house was in question. However, we give it to him that
he is one hundred per cent right in saying what he says. Truly, politics
has become the  last recourse of crooks with drug mafia and matka kingpins
coming into politics  to subvert the  good name of POLITICS. His retirement
from politics could be one of the reasons that he no longer wants to be
seen supporting the politricks which is being dished out in the  name of
politics. We do consider him to be an honest and an upright person  making
honest statements. However, he should not mix POLITRICKS with POLITICS.
Politics could also be virgin clean if the right SYSTEM is found,
encouraged, elevated and supported. It does not matter that persons who
come into this SYSTEM  to  take it forward are not honest to the core or
are down to earth crooks. The former will have their way in taking the
SYSTEM forward, unimpeded, but those who come into the SYSTEM to manipulate
and milk it to serve themselves shall be left frustrated and shall walk out

We at GSRP have always been of the opinion that any worthwhile government
which desires to excel in rendering services that should be provided to the
people as its raison d'etre should keep a close 'eye' on the editorials of
the local dailies. Any and all problems, suggestions, opinions and
brick-bats that are displayed in these editorials  are the heart and  soul
of the newspapers and must be taken seriously by governments, especially,
if they mean well of the people of the State/Country.

GSRP congratulates and thanks  Navhind Times' Editorial staff/Editor for
this particular editorial. If the government has any  self-respect or pride
in dishing out  governance to this State, it should  take note  of this
editorial and try to reform its thinking process. It must know that the
moment one tries to impose anything on anyone, suspicions,
rumours, negativity and all sorts of things crop up and people fortify
themselves for a fight, even if the implementation of such projects ,
policies and/or ideas could be beneficial to them in the LONG RUN. The
matter of fact is that our governments do not take people into CONFIDENCE
and try to bull-doz with things like the Electronic City in Tuem, Mandrem,
 and unfortunately meet with a blank wall, like in this case, where people
have distrust on the intentions of the government whether they are good or
bad.

In this connection GSRP wants to showcase its strategies inbuilt into its
ROAD MAP FOR GOA in making the people of cities,towns, villages and wards
the stake-holders in the planning of areas within their jurisdiction with
appeciation accorded to the most deserving, thus bringing out the
COMPETITIVE  edge for best results and overall satisfaction for all.

sponsor special  annual *“Best City-Town- Village Awards”* so that ‘Cities,
Towns and Villages of Goa’ may compete with each other for this award.
Criteria shall be set for this evaluation, such as:- *[i]* Best enforcement
of building regulations and meeting citizen’s needs without breaking laws
and without harassment. *[ii]* Effective garbage disposal. *[iii]* Quality,
maintenance and  illumination of roads and public places. *[iv]* Sanitation
and Hygiene *[v]* Neighbourhood watch. *[vi]* Environment protection
through control of noise, air, water, land pollution. *[vii]* Encouragement
of better quality of life such as creating gardens, children’s play parks
and planting of trees etc. *[viii]* Agricultural excellence, control on
stray animals, proper pavements and drainage system and most importantly
“honouring the sons and daughters of the city, town and village who have
excelled in any field i.e sports, medicine, science social justice etc.
The certification of this award shall be carried out by an independent [all
Goa ] body constituted for the purpose. Through this award, the long
standing developmental demands of the winners shall be granted, such as
school, playground; market; children’s park; community hall; telephone
exchange; hospital/clinic; public toilets; etc. Competitions for this award
shall ensure proper functioning of the Municipalities, village Panchayats
and Comunidades through the generation of interest among the people to
attend the village Gram Sabhas, Municipal and Comunidade meetings and to
take active part in the governance of these bodies.

True they legislate on age of Govt servants et al. Unfortunately there is
no such bar on politicians, Onlly Divine intervention can terminate their
aspirations of expiry date Politicians want to die with boots on for a
glorious funeral., The argument is that between 58-60 people become
senile.’ lose their reflexes, are mentally not alert, prone to illness,
cost more than fresh candidate et al. It also provides openings for
numerous educated, unemployed. Life expectancy has increased and in the
West people still can remain till 75.None of these conditions apply for
politicians. There are those in 80+ and still growing strong. They consider
themselves as fit as a fiddle and will not make any such rules that will
curtail their employment and   enviable perks while in office. There should
be some VRS for these politicians, Modi has made a rule to limit those in
Ministry who are below 75 years at the start

Parikar might have talked about his retirement in all honesty, but he too
cannot be faulted singularly Those who raise the issue, should first put in
their papers, as some of them are too long, sticking like limpets Some
enter through back door of Raja Sabha,  opportunity to reinstate  discarded
lot by the voters. While others will want to be President, Vice President,
Governors, the Party post or any position that will extend their political
life at the fag end of their validity and utility.

Parikar may have retired from one day, given up Goa politics at the behest
of the party but  is still in reckoning for tests and has long, future,
fruitful innings with BJP. Admirably his talents have been recognized with
one of the best, enviable, prestigious posting in Central Ministry. Why
some are excessively rattled by the continuation of Parikar is
understandable ,as they are not able to manipulate with Parikar in the
ring. Goans should honestly be proud of Parikar occupying such an elevated
position

I think that Goa is where it should be; I have seen *Spotlight *the sad
story of youth sexual abuse in Boston---likely to get Oscars. I have a lot
of family relations there, and a niece of mine knew Cardinal Law very well,
personally.

No doubt the IFFI is a Central Gov't funding perk that a lot of States are
envious of.
