This was revealed to the Goa bench of the Bombay high court on Wednesday by the state government counsel during a hearing on a petition filed by K Raheja Corp Pvt Ltd, an SEZ developer. In another development, the court directed Goa Industrial Development Corporation not to take any further steps on the show-cause notice issued by them in June 2008 to Peninsula Pharma Research Center Pvt Ltd to stop work. Arguing on behalf of Raheja, Ravi Kadam pointed out that since the central government has notified these industries as SEZs, the state government had no power to interfere or issue any orders to stop work within a SEZ notified area. Appearing for the government, Rajiv Kumar contended that though it is the central government that notifies SEZs, the land is acquired by the state government and so state laws will apply to SEZs. Rejecting the argument of the government counsel, the high court inquired whether the state government intends to withdraw the stop work order served upon the petitioner as they had no powers under the SEZ Act to interfere in decisions of the central government. The state government counsel then informed the court that the government is withdrawing the stop work order. Taking up another petition filed by Peninsula Pharma challenging the show cause notice issued by GIDC, the high court restrained GIDC from taking further steps in the matter. Even I got optimistic when I read it. But it was to last very short! Ah! Ah! Ah! It took just few weeks for the Goa Government to give up and withdraw the 3 SEZ stop work order and start singing at the tune of the Central government. Sincerely, I would have expected a higher resistance from our Goa Government. I think it is clear enough that the people of Goa do not rule in Goa. It has been like that for centuries and will continue like that, sadly. Another small lesson for those who claim Goa has been liberated. Another evidence of the contrary. As history closes another chapter, nothing really changed for centuries as it is clear that Goa is far from liberated. Only the blind cannot see this. I rest my case.
