Dear all, These days there are all kinds of clueless alleged experts who spout partisan nonsense about health care. Aires IMHO is not one of them. I have read what Dr. Ferdinando dos Reis Falcão has written in response to Aires' latest post. I agree with Dr. Falcão. I will ignore # 4 and 5 supra. Not only are they gratuitous, they are also quite ignorant and offensive examples of exuberant crap. I will also ignore #1 supra. It smacks of rank prejudice against and unreasonableness towards CM Parrikar. wrt #3: IMHO, Aires is NO shining example of an exponent of the 'equal protection' provided by Art 14 of the Indian Constitution. (Will expand if needed.) Hence, #3 also ignored. Aires may be right wrt #2. There, indeed, might be protection for civil servants including doctors under existing law or perhaps .. NOT. Will try access a copy of the Bill/Act when available. There must be a reason why this Bill has been presented to the Legislature. ps: Seriously disappointed (but not surprised) as I am at the numerous U-turns that CM Parrikar has taken since his retaking the CM's chair, I know of NO ONE who is electable + elected + better than him for Goa at the moment. If someone including Aires knows of that someone .please advise. jc
[Goanet] WHY SHIELD ONLY DOCTORS?
In yet another ill-thought move the Manohar Parrikar government has introduced in the Legislative Assembly the Goa Medicare Service Personnel and Medicare Service Institutions (Prevention of Violence and Damage or Loss to Property) Bill, 2013. The bill seeks to provide protection and compensation to medicare service institutions from any kind of assault on them or loss caused to their property by the patients or their relatives. Anyone found convicted would also face three years in jail and fine of Rs 50,000. One fails to understand why this very biased discrimination by only singling out the medical fraternity. Would this not amount to discrimination in violation of Article 14 of the Constitution? Don't all citizens need protection alike? Anyone found violating any law or damaging any property should be sternly and swiftly punished in accordance with the law, regardless of who the victim is. The doctor’s career like every other profession is today no longer a mission but more of a business venture. The advocates, engineers, architects, builders and for that matter those in every trade are vulnerable to the backlash from dissatisfied customers. And we have seen in Goa that all such hostile response is due to deficiency and negligence in the service provided to the clients and customers. There is already a law which deals with matters relating to destruction of public property and also provisions for assault on public servants in discharge of their duties. Hence Government hospitals and doctors therein, already stand protected. As far as non-government property and non-officials, there is also already a law for them. Now carving out this Special Class has no nexus with the objective sought to be achieved. Unless of course, the Government desires to now protect quacks and incompetent medical practitioners. COMMENT: Aires, just to enlighten your wrong perception; a human being is not a mechanical engine. It is not a car, nor a building, nor consumable that can be replaceable. A medical doctor cannot guarantee cure of any patient, as in case of a problem of your car, fridge, TV, plumbing or a building. It is not just a case of replacing a defective part, anyway, no spares are available. It is also because one human is not the same as another; one may react to some medicine, or be immune to some drugs, or even be at a terminal end due to some disease not diagnosed and then when taken as emergency to a hospital, succumbs, tempers of relatives flare. Have you forgotten how a Hospital in Maharashtra was vandalised by a crowd after one high ranking Shiv Sena had a heart attack and was rushed to a hospital and died there? Have you forgotten how one relative assaulted a doctor at GMC when a relative died? It is true that death is a deep stress on a relative at times, but it does not mean one has a right to displace one’s stress and frustration by assaulting a doctor. One needs to control one’s frustration that is fuelled by ignorance of facts. To make it more easier to understand, the difference between a doctor’s job and any other repair jobs, let me cite this story. A renowned heart surgeon took his car to a workshop, and a mechanic who was overhauling an engine recognised him. The mechanic boastfully tried to impress the surgeon that he, like heart surgeons also repairs car engines, the heart of a car. The surgeon acceded to his views but told him to try overhauling a running engine. Dr. Ferdinando dos Reis Falcão.
