Izinkan saya memberi sedikit maklum balas mengenai perkara di atas.
Kenyataan
'both cannot be right' adalah tidak tepat sama sekali. Ringkasan mengenai
perkara wudhu'
* Mazhab Hanafi: Menyentuh perempuan bukan muhrim tidak batal wudhu'
samada
sengaja atau tidak sengaja walaupun disertai dgn perasaan nafsu
syahwat
ataupun tidak.
* Mazhab Syaf'ie: Menyentuh perempuan bukan muhrim batal wudhu' secara
mutlak
samada sengaja atau tidak sengaja walaupun tidak disertai dgn
syahwat.
* Mazhab Maliki dan Hanbali: Menyentuh perempuan bukan muhrim tidak
membatalkan wudhu' sekiranya tidak disertai dgn nafsu syahwat.
Ke semua mazhab mengeluarkan hukum berdasarkan kpd dalil al-quran yakni:
"...Kalau kamu sakit atau dlm perjalanan atau salah seorang drpd kamu
membuang
air atau kamu menyentuh perempuan [laamastum nisa']..." (surah An-nisa':
ayat
43)
"...Jika kamu sakit atau dlm perjalanan atau sudah buang air atau kamu
menyentuh
perempuan [laamastum nisa'], kemudian kamu tidak memperolehi air, maka
bertayamumlah dengan tanah yg suci..." (Surah Al-Maidah: ayat 6)
Di dlm kedua ayat suci ini tidak dinyatakan secara jelas apakah sentuhan
itu
sengaja ataupun tidak sengaja. Dlm mentafsirkan ayat tersebut di dlm mazhab
ahlus sunnah wal jamaah, mereka mesti melalui manhaj yg serupa walaupun
keputusan mungkin berbeza. Tafsir mempunyai 3 kaedah ttp yg hanya layak
dipakai
hanyalah satu memandangkan ia berkaitan dgn ibadah. Kaedah2 tersebut ialah:
1. Tafsir bil-Ma'thur
2. Tafsir bir-Ra'yi
3. Tafsir bil-israiliyyat
Hanya Kaedah no.1 layak digunakan dlm perbahasan ini. Ke semua mazhab ahlus
sunnah wal jamaah menggunakan tafsir bil-ma'thur dlm mengeluarkan hukum.
Apakah
yg dimaksudkan dgn tafsir bil ma'thur?
Tafsir bil-ma'thur ialah tafsir yg berdasarkan pd kutipan2 yg sahih menurut
urutan yg telah disebutkan syarat-syarat olh para mufasir. Syarat2 tersebut
ialah menafsirkan al-quran dgn al-quran, menafsirkan al-quran dgn
as-sunnah/hadith kerana as-sunnah/hadith berfungsi menjelaskan al-quran,
mentafsirkan dengan perkataan para sahabat r.a kerana merekalah yg paling
mengetahui al-quran dgn sbb mereka hidup dgn rasulullah yg menerima wahyu
atau
mentafsirkan dgn perkataan tokoh para tabi'in yg mu'tabar krn mereka pada
umumnya menerima tarbiyyah dr para sahabat. 4 dasar ini mesti dilalui dlm
mengeluarkan hukum.Tidak boleh dilakukan ijtihad utk menjelaskan makna
tanpa ada
mana-mana dasar dan juga hendaklah ia meninggalkan hal-hal yg tidak berguna
atau
bermanfaat utk diketahui selama tidak ada riwayat yg shahih mengenainya.
Ibn Taimiyyah rh berkata:
"Kita wajib yakin bahawa Nabi S.A.W telah menjelaskan kpd para sahabat
makna2
al-quran sebagaimana yg telah difirmankan olh Allah S.W.T di dlm al-quran:
"Agar kamu(Muhammad) menerangkan kpd umat manusia apa yg telah diturunkan
kpd
mereka." (Surah An-Nahl: ayat 44)
Sekarang kita lihat manhaj yg digunakan olh imam mazhab arba'ah dlm
menafsirkan
ayat menyentuh perempuan yg berkaitan pembatalan wudhu'.
Mazhab Hanafi
Mazhab hanafi berpegang kpg pendapat Ibn Abbas (ahli tafsir) yg mengatakan
'laamastum'--sentuhan itu adalah bermaksud jimak. Mereka juga berpegang kpd
pendapat Ibn
As-sikit yg mengatakan bahawa apabila kalimah 'laamastum' digandingkan dgn
perkataan
perempuan bermaksud bermaksud jimak. Pendapat ini disokong oleh bbrp dalil
dlm
al-quran yg
menggunakan perkataan mulamasah, laamastum, al-massu, atau al-lamsu
sebagai
maksud
jimak. Berikut adalah dalil-dalil Al-quran yg menunjukkan bahawa
'laamastum'
bermaksud jimak:
"Bagaimanakah aku akan memperolehi seorang anak padahal aku tidak pernah
disentuh(yamsasni)
olh seorang lelaki pun?" (surah Ali-Imran: ayat 47)
"Dan jika kamu ceraikan mereka sblm kamu bersentuh(tamassu) dgn mereka."

92. Never should a believer kill a believer; but (if it so happens) by
mistake (compensation is due): if one (so) kills a believer it is ordained
that he should free a believing slave and pay compensation to the
deceased's family unless they remit it freely. If the deceased belonged to
a people at war with you and he was a believer the freeing of a believing
slave (is enough). If he belonged to a people with whom ye have a treaty
of mutual alliance compensation should be paid to his family and a
believing slave be freed. For those who find this beyond their means (is
prescribed) a fast for two months running: by way of repentance to Allah:
for Allah hath all knowledge and all wisdom.
93. If a man kills a believer intentionally his recompense is Hell to abide
therein (for ever): and the wrath and the curse of Allah are upon him and a
dreadful penalty is prepared for him.
94. O ye who believe! when ye go abroad in the cause of Allah investigate
carefully and say not to anyone who offers you a salutation: "Thou art none
of a believer!" Coveting the perishable goods of this life: with Allah are
profits and spoils abundant. Even thus were ye yourselves before till
Allah conferred on you His favors: therefore carefully investigate for
Allah is well aware of all that ye do.
95. Not equal are those believers who sit (at home) and receive no hurt and
those who strive and fight in the cause of Allah with their goods and their
persons. Allah hath granted a grade higher to those who strive and fight
with their goods and persons than to those who sit (at home): unto all (in
faith) hath Allah promised good: but those who strive and fight hath He
distinguished above those who sit (at home) by a special reward.--
96. Ranks specially bestowed by Him and Forgiveness and Mercy. For Allah
is Oft-Forgiving Most Merciful.

92: c. 611. Life is absolutely sacred in the Islamic Brotherhood. But
mistakes will sometimes happen, as did happen in the melee at Uhud, when
some Muslims were killed (being mistaken for the enemy) by Muslims. There
was no guilty intention: therefore there was no murder. But all the same,
the family of the deceased was entitled to compensation unless they freely
remitted it, and in addition it was provided that the unfortunate man who
made the mistake should free a believing slave. Thus a deplorable mistake
was made the occasion for winning the liberty of a slave who was a
Believer, for Islam discountenances slavery. The compensation could only be
paid if the deceased belonged to a Muslim society or to some people at
peace with the Muslim society. Obviously it could not be paid if, though
the deceased was a Believer, his people were at war with the Muslim
society: even if his people could be reached, it is not fair to increase
the resources of the enemy. If the deceased was himself an enemy at war,
obviously the laws of war justify his being killed in warfare unless he
surrendered. If the man who took life unintentionally has no means from
which to free a believing slave or to give compensation, he must still by
an act of strict self-denial (fasting for two whole months running) show
that he is cognizant of the grave nature of the deed he has done and
sincerely repentant. I take this to apply to all three cases mentioned:
that is, where a Believer killed a Believer unintentionally and the
deceased (1) belonged to the same community as you, or (2) belonged to a
community at war with you, or (3) belonged to a community in alliance with
you.
93: c. 612. What is mentioned here is the punishment in the Hereafter. The
legal consequences, enforceable by human society, are mentioned in ii. 178,
under the rules of Qisas. That is, a life should be taken for a life
destroyed, but this should be on a scale of equality: a single murder
should not commit a whole tribe to a perpetual blood-feud, as in the days
of ignorance. But if the heirs of the man slain accept reasonable
compensation, this should be accepted, and the taking of a life for a life
should be put a stop to. This course leads to the saving of life, and is
commanded to men of understanding.

97. When angels take the souls of those who die in sin against their souls
they say: "In what (plight) were ye?" They reply: "Weak and oppressed were
we in the earth." They say: "Was not the earth of Allah spacious enough
for you to move yourselves away (from evil)?" Such men will find their
abode in Hell what an evil refuge!
98. Except those who are (really) weak and oppressed men women and children
who have no means in their power nor (a guide-post) to direct their way.
99. For these there is hope that Allah will forgive: for Allah doth blot
out (sins) and forgive again and again.
100.He who forsakes his home in the cause of Allah finds in the earth many
a refuge wide and spacious: should he die as a refugee from home for Allah
and his Apostle his reward becomes due and sure with Allah: and Allah is
Oft-Forgiving Most Merciful.

97: c. 615. The immediate occasion for this passage was the question of
migration (hijrat) from places where Islam was being persecuted and
suppressed. Obviously the duty of Muslims was to leave such places, even if
it involved forsaking their homes, and join and strengthen the Muslim
community among whom they could live in peace and with whom they could help
in fighting the evils around them. But the meaning is wider. Islam does not
say: "Resist not evil." On the contrary it requires a constant, unceasing
struggle against evil. For such struggle it may be necessary to forsake
home and unite and organise and join our brethren in assaulting and
overthrowing the fortress of evil. For the Muslim's duty is not only to
enjoin good but to prohibit evil. To make our assault we must be prepared
to put ourselves in a position from which such assault would be possible,
and Allah's earth is spacious enough for the purpose. "Position" includes
not only local position, but moral and material position. For example, we
must shun evil company where we cannot put it down, but organise a position
from which we can put it down.
98: c. 616. If through physical, mental, or moral incapacity, we are unable
to fight the good fight, we must nevertheless guard ourselves from it.
Allah's gracious Mercy will recognise and forgive our weakness if it is
real weakness, and not merely an excuse.

101.When ye travel through the earth there is no blame on you if ye
shorten your prayers for fear the unbelievers may attack you: for the
unbelievers are unto you open enemies.
102.When thou (O Apostle) art with them and standest to lead them in
prayer let one party of them stand up (in prayer) with thee taking their
arms with them: when they finish their prostrations let them take their
positions in the rear and let the other party come up which hath not yet
prayed and let them pray with thee taking all precautions and bearing arms:
the unbelievers wish if ye were negligent of your arms and your baggage to
assault you in a single rush but there is no blame on you if ye put away
your arms because of the inconvenience of rain or because ye are ill; but
take (every) precaution for yourselves. For the unbelievers Allah hath
prepared a humiliating punishment.
103.When ye pass (congregational) prayers celebrate Allah's praises
standing sitting down or lying down on your sides; but when ye are free
from danger set up regular prayers: for such prayers are enjoined on
believers at stated times.
104.And slacken not in following up the enemy: if ye are suffering
hardships they are suffering similar hardships; but ye have hope from Allah
while they have none. And Allah is full of knowledge and wisdom.

101:c. 617. Verse 101 gives permission to shorten four Rakat prayers when
people are on a journey: verses 102-104 deal with cases when they are in
danger at war, in face of the enemy. The shortening of prayers in both
cases is further governed as to details by the practice of the Messenger
and his Companions. As to journeys, two questions arise: (1) what
constitutes a journey for this purpose? (2) is the fear of an attack an
essential condition for the shortening of the prayers? As to (1), it is
best to leave the matter to discretion, having regard to all the
circumstances of the journey, as in the case of the journeys which excuse a
fast: see ii. 184, n. 190. The text leaves it to discretion. As to (2), the
practice of the Prophet shows that danger is not an essential condition; it
is merely mentioned as a possible incident. The Messenger usually shortened
the prayers from four Rakats to two Rakats in Zuhr (midday prayer), 'Asr
(afternoon prayer) and Ishaa (night prayer): the other two are in any case
short, Fajr (morning prayer) having two Rakats and Magrib (evening prayer)
having three.
102:c. 618. The congregational prayer in danger in face of the enemy rests
on the principle that the congregation should be divided into two parties;
one party prays while the other watches the enemy, and then the second
party comes up to prayers while the first falls back to face the enemy;
either party does only one or two Rakats, or about half the congregational
prayer; every precaution is taken to prevent a rush by the enemy; even
while at prayers armour and arms need not be put off except when rain is
likely to cause inconvenience to the wearer and damage to the arms, or when
illness or fatigue causes the wearer's strength to fail. Details can be
varied according to circumstances, as was actually done by the Prophet at
different times.
103:c. 619. It means: "when ye have finished congregational prayers." It
allows you to remember Allah individually in any posture possible during
the danger. But when the danger is past, the full prayers should be offered
at the stated times.
104:c. 620. Religion should be a source of strength and not of weakness in
all our affairs. If we have to struggle hard and suffer hardships, those
without faith have to do the same, with this difference, that the man of
Faith is full of hope in Allah, whereas the man without Faith has nothing
to sustain him.

Ini bukan soal orang UMNO atau PAS atau apa-apa parti. Soalnya awak tu
terlalu ikut "perasan" seolah-olah awak boleh buat hukum hakam sendiri.
Jangan terlalu celupar mulut, terutama tentang perkara-perkara ugama. WALAU
APA PUN niat dan tujuan awak MENGAJAK ORANG RAMAI memakan babi panggang dan
meminum arak (atau ucap selamat minum arak!!), ianya tetap melampau,
biadap,
dan uncalled for sebagai seorang muslim (kalau awak tu muslim lah). Jangan
nak cuba alih tajuk kerana kenyataan awak sebelum ni TERLALU TERANG DAN
JELAS serta tak boleh dipertikaikan lagi. Kalau hanya dengan berselindung
disebalik "sepanduk politik" sahaja awak boleh kata apa saja yang terlintas
dibenak, maka itu lagi memalukan parti awak sendiri.
Lain kali kalau nak memerli atau mengutuk atau menghina orang, pandanglah
kiri kanan. Lebih dari itu gunakan sedikit otak awak tu untuk memikirkan

baik dan buruknya kepada masyarakat Islam atau sekurang-kurangnya apa kesan

IRAQ SANCTIONS LETTER CIRCULATING IN CONGRESS
Twenty-eight members of the House of Representatives
have signed on to a
letter calling for the lifting of economic sanctions
on Iraq. The letter,
sponsored by Reps. Tom Campbell (R-CA) and John
Conyers (D-MI), will be sent
to the President on January 27.
The letter asks the President to de-link the
economic sanctions from
military sanctions in place against Iraq. It notes
that sanctions have
severely damaged Iraq's health care and
infrastructure. The letter cites
UNICEF estimates that several thousand children
under the age of five die
each month because of malnutrition and disease
resulting from the embargo.
"Morally, it is wrong to hold the Iraqi people
responsible for the actions
of a brutal and reckless government."
MUSLIMS IN PUBLIC LIFE BREAK FAST TOGETHER
At an iftar sponsored by the American Muslim Council
on January 4, more than
one hundred Muslims active in public life broke
their fast together on
Capitol Hill. The iftar brought together American
Muslims who work in
federal and local government, including Congress and
the State Department,
and leaders of the local Muslim community.
The iftar continued an AMC tradition of bringing
together American Muslims
for Ramadan events at the seat of government. AMC
co-hosted the first Eid
celebration in the White House in 1996, and
initiated the first iftar events
in Congress (1996) and the Pentagon (1998).
During the dinner, speakers commented on the growing
role of American
Muslims in the public square. The audience was
addressed by Aly R.
Abuzaakouk, AMC executive director; Islam Siddiqui,
Deputy Assistant
Secretary of Agriculture; Jameel Johnson, chief of
staff to Rep. Gregory
Meeks (D-NY); and AMC board member Sulayman Nyang,
co-director of the
Muslims in the American Public Square research
project at Georgetown
University.
PRESIDENT CLINTON HOSTS EID CELEBRATION
President Clinton hosted an Eid celebration today
for American Muslims, the
first president to host such an event. For the last
four years, Eid
celebrations at the White House have been hosted by
First Lady Hillary
Clinton, who initiated the tradition in 1996 with
AMC as co-host.
In his remarks, Clinton spoke on the need for
international tolerance,
citing the Qur'anic verse that God created humanity
and made people into
nations and tribes so that they might know one
another. He also noted that
the Abrahamic faiths originated in the Middle East
and that Islam is the
faith of almost a quarter of the world's population
and six million in the
United States. National Security Adviser Sandy
Berger and Assistant
Secretary of State Harold H. Koh were also in
attendance.
PENTAGON HOLDS IFTAR FOR MUSLIMS IN MILITARY
Muslims active in the armed forces came together for
an iftar at the
Pentagon on Wednesday, January 5. The American
Muslim Armed Forces and
Veterans Affairs Council, which hosted the event,
estimates that 14,000
Muslims serve in the U.S. military, primarily in the
army, navy, and air
force. Several Muslim chaplains administer to the
religious needs of
American Muslims in the military.
The tradition of holding iftar events in government
is catching on beyond
Washington. Last week, the speaker of the
California state assembly for the
first time hosted an iftar and dinner in Los Angeles
for the local Muslim

American Muslim Council. Eid is the Islamic holiday
marking the conclusion
of Ramadan, the month of fasting and spiritual
renewal.
In his remarks to American Muslims, President
Clinton spoke of Ramadan as a
"gift of Islam" in reminding all people "of our
shared obligation to aid
those who live with poverty and suffering." He
noted that Islam is "now
practiced by one of every four people on earth" but
that there are "still
too many Americans who know too little about Islam."

The ceremony was opened with an invocation by Yahya
Hendi, Muslim chaplain
at Georgetown University, and a short speech by
Na'Imah Saleem, a
14-year-old American Muslim from Washington, DC.
National Security Adviser Sandy Berger and Assistant
Secretary of State
Harold H. Koh were also in attendance.
"Clinton said it right: American Muslims are a
cornerstone of American
society," said Aly R. Abuzaakouk, executive director
of AMC, who attended
this morning's event. "The Clinton years have seen
many symbolic 'firsts'
for American Muslims, including today's historic
meeting with the president.
We look forward to more appointments and greater
representation in the
coming years."
Mr. Abuzaakouk also noted that Ramadan has begun to
make its way into
mainstream American culture, and this year was even
recognized on the
popular TV shows the Simpsons and E.R. "From the
White House to the
Simpsons, the presence of American Muslims is
recognized more than ever
before."

AT EVENT COMMEMORATING END OF RAMADAN

THE PRESIDENT: Thank you. Thank you very much,
Eid Mubarak, and welcome to the
White House. N'Imah Saleem, you did a fine job
for a 14-year-old, or a 24-year-old, or a
44-year-old. I thought she was terrific. Thank
you very much, thank you. (Applause.)
And, Imam Hendi, thank you so much for your
words, your prayer, and for serving as the
first Muslim chaplain of my alma mater,
Georgetown University. Congratulations. We're
glad to have you here. Thank you, sir.
(Applause.)
I'd like to welcome others from the
administration who very joined us -- our National
Security Advisor, Sandy Berger; Assistant
Secretary of State Harold Koh. We also have
a White House fellow here, Khalid Azim; and Dr.
Islam Siddiqui, the senior advisor to the
Secretary of Agriculture and the highest ranking
Muslim in the Clinton administration. We
thank him for being here. We have a Muslim Army
chaplain, Captain Muhammad. We
thank him for being here, and the other Muslims
who work here in the White House --
they are all particularly welcome -- and all the
rest of you who have come here. Let me
say welcome to you. (Applause.)
My friend, Rasheed, thank you for leading the
applause there. I always try to have
someone in the audience there who is pumping the
crowd at the right time. (Laughter.)
Let me also say a special word of welcome to you
from the First Lady. Hillary has done
this celebration for the past several years; many
of you have been here with her. And
she had to be out of the city today, and that's
the only reason she's not here, because this
means so very much to her. And I want to welcome
you here on her behalf, as well.
Over the weekend, along with Muslims all over the
world, you celebrated the end of the
holy month of Ramadan. The month of daily fasting
is not only a sacred duty, it is also a
powerful teaching, and in many ways a gift of
Islam to the entire rest of the world --
reminding not simply Muslims, but all people, of
our shared obligation to aid those who
live with poverty and suffering. It reminds us
that we must work together to build a more
humane world.
I must say, it was, I thought, especially fitting
that we celebrated the Eid at the end of the
first round of the talks between the Syrians and
the Israelis. And I thought it was
particularly moving that Imam read the passage
from the Koran that said that Allah
created nations and tribes that we might know one
another, not that we might despise one
another.
There's a wonderful passage in the Hebrew Torah,
which warns people never to turn
aside the stranger, for it is like turning aside
the most high God. And the Christian Bible
says that people should love their neighbor as
themselves. But it's quite wonderful to say
that Allah created the nations and tribes that
they might know one another better,
recognizing people have to organize their
thoughts and categorize their ideas, but that
does not mean we should be divided one from
another.
It has been a great blessing for me, being
involved in these talks these last few days, to
see the impact of the month of Ramadan and the
Eid on the believers in the Syrian
delegation who are here. It was quite a moving
thing. And I hope that your prayers will
stay with them.
Let me say, also, that there is much that the
world can learn from Islam. It is now
practiced by one of every four people on Earth.
Americans are learning more in our
schools and universities. Indeed, I remember that
our daughter took a course on Islamic
history in high school and read large portions of
the Koran, and came home at night and
educated her parents about it, and later asked us
questions about it. (Applause.) And, of
course, there are now 6 million Muslims in our
nation today. The number of mosques and

Langkah itu sejajar hasrat syarikat itu menjadi pengendali air terkemuka di dunia setanding dengan syarikat utama lain, kata Pengerusi Eksekutif, Datuk Rozali Ismail. Katanya, melalui pengawalan 30 logi rawatan air, Puncak Niaga akan melaksanakan piawai kualiti tinggi, perkhidmatan cekap, pembangunan sumber manusia dan teknologi inovatif. Rozali berpendapat, sistem pengagihan air di Selangor dan wilayah Persekutuan perlu dipertingkatkan lagi selaras dengan perkembangan perdagangan secara elektronik. Katanya: ''Usaha memperkemaskannya perlu untuk memastikan bekalan air yang disalurkan kepada para pengguna awam dan pihak industri tidak terjejas. Beliau berkata, sesuai dengan kedatangan alaf baru, Jabatan Air Selangor misalnya, disarankan tidak lagi menggunakan sistem secara manual. ''Ini kerana ia memungkinkan pengguna menghadapi pelbagai masalah seperti kelewatan membaiki paip dan sebagainya,'' kata Rozali kepada Utusan sambil menambah Puncak Niaga bersedia membantu JBAS secara sukarela. ''Kami boleh menolong mengemaskinikan sistem itu kerana Puncak Niaga mempunyai pengalaman setelah melaksanakan sistem tersebut ketika berlakunya krisis air pada tahun 1998,'' katanya. Beliau berkata, ketika krisis air melanda WP, Puncak Niaga mengendalikan sepenuhnya sistem pengagihan air khususnya yang melibatkan perkhidmatan pelanggan melalui sistem berkomputer. Ditanya mengenai kemungkinan berulangnya krisis air pada tahun 2003, beliau menambah ia sukar dijangkakan tetapi semua pihak amat perlu bersedia menghadapi. ''Malah, sebagai pengendali yang berorientasikan pelanggan, kita mesti sentiasa bersedia pada bila-bila masa dan tidak boleh bersantai,'' kata Rozali. Selain itu kata beliau, penekanan yang serius perlu diberikan kepada pemuliharaan alam sekitar bagi memastikan sumber minuman bersih dan berkekalan. Rozali juga bimbang sejak sedekad lalu, kawasan takungan air telah menunjukkan perubahan besar kerana arus pembangunan yang menyaksikan pencemaran di sungai pembekal air terus meningkat. KUALA TERENGGANU -- Bekas Menteri Besar Terengganu, Tan Sri Wan Mokhtar Ahmad, berkata bahawa beliau tidak akan menerima sebarang pencalonan untuk kerusi Majlis Tertinggi (MT) Umno dalam pemilihan parti Mei ini. Beliau berkata keputusan itu diambil bagi memberi laluan kepada orang lain, terutama para pemimpin muda dalam Umno Terengganu, untuk mencari sokongan daripada anggota parti supaya dapat dicalonkan sebagai anggota MT. Tan Sri Wan Mokhtar berkata sudah tiba masanya beliau memberi laluan kepada generasi baru untuk mengambil alih tempat yang dikosongkannya itu. "Bagaimanapun, saya akan terus bekerja untuk parti selagi khidmat saya diperlukan... Kedudukan dalam parti tidak penting. Apa yang penting ialah kejujuran dan komitmen kita berjuang untuk bangsa, agama dan negara," katanya ketika ditemui di rumahnya dalam majlis rumah terbuka sempena Hari Raya semalam. Terengganu kini mempunyai dua wakil dalam MT yang mempunyai 25 kerusi, iaitu Wan Mokhtar dan Ketua Penerangan Umno, Datuk Dr Yusof Nor. Beliau berharap agar mereka yang dipilih sebagai anggota MT kelak akan dapat menunjukkan komitmen mereka di samping dapat memberi sumbangan yang akan menguatkan parti serta mengukuhkan perpaduan anggotanya. Ketika ditanya peluang Barisan Nasional (BN) merampas semula Terengganu daripada PAS, Tan Sri Wan Mokhtar berkata bahawa ia boleh dicapai jika semua pemimpin dan anggota parti mengetepikan perbezaan pendapat dan kembali bersama untuk satu tujuan. -- Bernama.

Monday, January 10, 2000 Rais: More prosecutors soon Move to combat defamation, sedition and false news JELEBU: The Government will appoint more experienced and qualified prosecutors in an effort to combat defamation, seditious ceramahs and distribution of false news. Minister in the Prime Minister's Department Datuk Dr Rais Yatim said the appointments would be made as soon as possible. "The Government has to implement this measure because irresponsible quarters have continued distributing false news, committing defamation and giving seditious ceramahs." Dr Rais said the filling of vacancies for prosecutors at federal and state levels would expedite the handling of these cases. "Thus, I believe irresponsible parties would be more respectful of the law and would not repeat the behaviour," he said. "We don't want such behaviour to become a culture in our society as it could affect the harmony of the people," he told reporters at his Hari Raya open house yesterday. Dr Rais said those found guilty could be punished under the Penal Code, Sedition Act and Printing Act. He said that cases relating to defamation, sedition and distribution of false news were handled by the Attorney-General without the government's intervention. "That is provided for under Article 145 of the Federal Constitution. "However, many are confused over the matter because they are influenced by false news. Prosecuting is the A-G's job and not the government's," he said.

NIK AZIZ AKUI TERIMA SURAT LAYANG MENGENAI TIGA ABDUL KOTA BAHARU, 10 Jan (Bernama) -- Menteri Besar Datuk Nik Abdul Aziz Nik Mat mengakui menerima surat layang kononnya terdapat "tiga Abdul" dalam pentadbiran Kerajaan Negeri yang dikatakan cuba menggugat kepimpinannya. Beliau yang tidak menyatakan nama tiga Abdul itu berkata, dakwaan itu terdapat dalam surat layang yang dihantar kepadanya tanpa nama pengirim. "Saya pernah terima surat layang tetapi dukacitanya tidak ada nama, bila tidak ada nama saya anggap mereka yang tulis ini tidak ikhlas dan tidak berani," katanya pada majlis perjumpaan Aidilfitri dan dialog dengan anak-anak Kelantan di perantauan di sini, malam tadi. Nik Aziz berkata demikian ketika menjawab pertanyaan seorang penuntut Kelantan yang belajar di luar negara bahawa beliau pernah mendengar kononnya terdapat "tiga Abdul" dalam pentadbiran Kerajaan Negeri yang dikatakan cuba menggugat kepimpinan Menteri Besar. "Saya tidak menghiraukan dakwaan itu kerana ianya adalah surat layang yang tidak mempunyai bukti bagi membolehkan tindakan diambil," kata Nik Aziz. "Selagi tidak ada hujah (bukti) saya bertindak juga tidak baik haram, kalau ada hujah (bukti) saya tidak bertindak, pun haram juga," katanya. Nik Aziz membacakan sepotong firman Allah s.w.t "Kalau satu berita datang daripada orang fasik maka hendaklah kamu cari penjelasan habis-habisan". Beliau mahukan pihak yang mengirim surat layang itu menemuinya dengan memberi bukti terhadap dakwaan berkenaan supaya tindakan selanjutnya boleh diambil. Terdahulu ketika berucap, Nik Aziz berkata Kerajaan Negeri tidak berbangga dengan pembangunan fizikal kerana ia boleh dilihat dan dicapai di mana-mana sahaja. Sebaliknya kejayaan dalam memperkenalkan dan menyakinkan umat Islam akan kemampuan Islam adalah lebih besar nilainya, kata beliau. -- BERNAMA

KERAJAAN TIDAK AKAN BERTOLAK ANSUR KAWAL PENJUALAN HARAKAH JASIN, 10 Jan (Bernama) -- Setiausaha Parlimen Kementerian Dalam Negeri (KDN), Datuk Seri Abu Zahar Isnin berkata kementerian itu tidak akan bertolak ansur terhadap mana-mana pemilik premis yang menjual akhbar Harakah kepada bukan anggota PAS. Beliau berkata kementerian itu mempunyai kakitangan yang cukup untuk membuat pemantauan terhadap penjualan dan pengedaran akhbar itu di premis-premis yang menjual akhbar berkenaan. Menurutnya, walaupun kebenaran untuk menjual akhbar itu ada, tetapi tujuan akhbar itu dicetak adalah untuk dijual kepada ahli parti berkenaan sahaja dan bukan dijual secara terbuka. "Kalau hendak jual pun hanya di premis yang tertentu sahaja dan kita akan bertindak jika ia dijual di kedai-kedai suratkhabar secara terbuka kerana ini tidak mendapat kebenaran," katanya. Beliau berkata demikian kepada pemberita semasa mengadakan rumah terbuka sempena Hari Raya Aidilfitri di rumahnya di Merlimau di sini hari ini. Abu Zahar berkata disebabkan pelanggaran peraturan itu kementerian telah mengambil tindakan merampas akhbar berkenaan yang dijual secara terbuka kepada orang ramai dalam beberapa siri serbuan yang dijalankan baru-baru ini. "Kita telah terlalu bertolak ansur, kita sudah terlalu longgar, kita telah beri peluang dan akhirnya benda ini menghentam kita balik, oleh itu tidak ada lagi tolak ansur," katanya. Mengenai penjualan akhbar itu di markas-markas parti PAS, beliau berkata kementerian sentiasa mengawasi penjualannya dan memastikan hanya ahli-ahli parti berkenaan sahaja yang dibenarkan membeli. Sementara itu, Abu Zahar berkata kementerian itu juga telah meminta Jabatan Kemajuan Islam Malaysia (Jakim) untuk memberi nasihat kepada kerajaan-kerajaan negeri supaya memastikan semua penceramah di masjid-masjid hendaklah mendapat persetujuan dan kebenaran daripada kerajaan negeri. Beliau berkata kerajaan-kerajaan negeri melalui jabatan-jabatan agama Islam masing-masing boleh mengariskan peraturan yang perlu diikut oleh penceramah-penceramah berkenaan bagi memastikan tidak timbul fitnah dan pembohongan yang memburuk-burukkan kerajaan. Mengenai penjualan dan pengedaran mercun pada musim perayaan AIdilfitri, Abu Zahar berkata walaupun arahan dikeluarkan bagi pengharaman penjualan, pengedaran dan memainkan bahan berkenaan, para peniaga pasaran gelap telah mengambil kesempatan daripada permintaan orang ramai. Tindakan akan dikenakan kepada mana-mana pemilik premis mahupun individu yang didapati menjual, mengedar mahupun memainkan mercun dan meriam buluh, tegasnya. Abu Zahar berkata bagaimanapun kegiatan menjual dan mengedarkan bahan berkenaan secara gelap berleluasa pada musim perayaan kerana ada permintaan daripada orang ramai. "Walaupun beberapa siri serbuan, mengeledah dan merampas bahan berkenaan di samping mengenakan tindakan kepada penjual serta pengedar tetapi tanpa kerjasama daripada orang ramai untuk membanteras kegiatan itu tidak akan mencapai matlamat sepenuhnya," katanya. --BERNAMA

Monday, January 10, 2000 Nik Aziz: Show us mistakes in Harakah KOTA BARU: PAS is prepared to make changes to Harakah if the Government can prove that its official publication carried articles undermining the faith of Muslims. Kelantan Mentri Besar Datuk Nik Abdul Aziz Nik Mat said the Government should point out where Harakah went wrong so mistakes could be rectified. The Government should discuss this with PAS, Nik Aziz said at his Hari Raya open house. The PAS Council of Ulamas chief was commenting on allegations that Harakah was printing lies which could undermine Muslim unity and faith. He said the Government should not overlook other publications which had stories contradictory to the teachings of Islam.--Bernama
