June 13, 2000

DPP dropped Mahathir's name at meeting,
                         says witness
                         Ajinder Kaur

1.30pm, TUES: Lawyer Manjeet Singh Dhillon this
morning
told the court in sacked deputy prime minister
Anwar
Ibrahim's sodomy trial that deputy public
prosecutor Abdul
Gani Patail "dropped" Prime Minister Mahathir
Mohamad's
name during a meeting they had to discuss
matters relating
to his client S. Nallakarupan (better known as
Nalla).

During cross examination by DPP Mohd Yussuf
Zainal Abidin,
Manjeet said the way Mahathir's name was
dropped at the
meeting, "it was an obvious intention to convey
to me the
fact that there was an overseeing aspect of the
whole matter,
including Nalla. Otherwise, why mention (the
prime
                         minister)?"

Businessman and former Anwar's tennis partner
Nallakarupan
was arrested on July 31, 1998, and held
incommunicado for 14
days before being charged in court for illegal
possession of
bullets at his house under the ISA which
carried a mandatory
                         death sentence.

Asked by Mohd Yussuf whether Manjeet agreed the
reference
to Mahathir was important and relevant to the
purpose of his
meeting with Gani, the defence witness said,
"The facts
concerning Nalla were a simple licensing
offence. It did not
warrant the ISA or the threat of a death
sentence. If the
                         situation concerning Nalla was being
manipulated out of all
proportions with the view of extracting
evidence out of it and
if that was being done with the knowledge of
the higher
authorities, and was being approved by the
higher
authorities, then the answer to your question
is: ‘Yes, it is
                         important'."

Earlier when asked by lead defence counsel
Christopher
Fernando as to whether he (Manjeet) was in fact
saying that
the prime minister was overseeing the
investigation, Manjeet
replied, "I do not think I can say that."

He added that the crux of the conversation
between him and
Gani centred upon trying to get Nalla to
implicate Anwar with
being involved with between two and five women.

When Fernando asked him whether it was in that
context that
Gani raised the issue of the prime minister,
Manjeet said, "I
am not able to answer that question because I
do not know
what hidden agendas people were operating
under."

In response, Fernando said, "Very fair answer."

Manjeet agreed with Fernando that during the
conversation,
Gani told him, "Please bear in mind we have our
reasons but
there are still a lot of matters that the prime
minister wants
to look into and there is the security side."

He also told the court that the "threat" raised
in the meeting
with Gani was a "very simple but unfair
bargain."

"We give you back your life and you implicate
Anwar for us. It
is your life or we implicate Anwar," Manjeet
said.

Yesterday, Manjeet told High Court judge Arifin
Jaka that he
met Gani at the AG's Chambers on Oct 2, 1998.

"The meeting came about after I reviewed the
facts revolving
around Nalla's arrest and it was clear to me
that it was not
an ISA offence. I wrote a letter to the AG
(Attorney General
Mohtar Abdullah) and I supplied him with
documentary
evidence which indicated that the most
appropriate law
applicable was the Firearms Act," Manjeet said.

He added that the response to the letter came
from Gani who
asked to see him at the AG' s Chambers.

"What transpired at the meeting was the blatant
attempt by
Gani to extort and blackmail evidence out of a
man by using
the man's life as a bargaining chip," Manjeet
said.

He told the court that Gani told him that they
were looking
into matters on behalf of the prime minister
and that he
                         wanted evidence from Nallakarupan "concerning
women".

"In the case of mentioning that fact, he (Gani)
moved in
numbers. He couldn't decide exactly on how many
women.
The number started from two, three and finally
he settled at
                         five," Manjeet said.

Anwar is being charged with forcing sex on his
wife's former
driver Azizan Abu Bakar with the aid of adopted
brother
Sukma Dermawan Saasmitat Madja, at Sukma's
apartment in
Tivoli Villas, Bangsar on "one night at 7.45pm
between
                         January and March, 1993".

The one-time heir apparent to the prime
minister's post is
currently serving a six-year jail term for
corruption relating to
abuse of power while in office as deputy prime
minister. He
has repeatedly denied all charges and says they
were
trumped up to end his political career.

Hearing is to resume this afternoon.
