the CPack section in the top CMakeLists.txt file is a good place. It 
would make sense to add a section there, and maybe even comment why the 
files are listed (currently it just filters build files, AFAIK, to avoid 
packing them with after testing).

imho distributing stuff (even just in source form) which is not (known to
be) freely distributable is a problem.

Is there a trivial way to prune the hugin tarball of all unused stuff?

FWIW there is it at least one file that *is* compiled and has totally
unclear license terms: src/hugin_base/hugin_math/eig_jacobi.cpp
(current upstream webpage: http://ess.mike.googlepages.com/, and
upstream does not seem to respond to mail).
