What is the ruling on investing and trading in Internet cafes, even though I do 
not know whether a user will go to beneficial sites or to harmful and haraam 
sites? There are chat programs in which people can get to know one another, and 
that often takes place between the sexes, and there may be exchange of indecent 
pictures, movies and songs through it.

Praise be to Allaah. 

If these computers may be used to access reprehensible and false things that 
are detrimental to Islamic beliefs or through which people will look at 
indecent images and movies and stories, or engage in dubious conversations or 
haraam games, and the owner of the cafe cannot prevent these evils or cannot 
control these computers, then in that case it is haraam to deal in what has 
been mentioned, because that is helping in sin and transgression, and Allaah, 
may He be glorified and exalted, says in His Holy Book (interpretation of the 
meaning):

“Help you one another in Al‑Birr and At‑Taqwa (virtue, righteousness and 
piety); but do not help one another in sin and transgression. And fear Allaah. 
Verily, Allaah is Severe in punishment”

[al-Maa’idah 5:2] 

And Allaah is the source of strength. may Allaah send blessings and peace upon 
our Prophet Muhammad and his family and Companions. End quote.

 The husband wrote a receipt to his wife for the sum of £10,000, and the wife 
wrote a receipt to the husband for the sum of £10,000. In other words, each of 
them wrote a receipt, and the two receipts were deposited with a third party, 
on the condition that whichever of them transgressed against or mistreated the 
other party was proven guilty would be punished by the receipt becoming due to 
the one who was transgressed against, whether that involved reviling or 
slander. It was proven that the wife was guilty, so what should the third party 
do?.

Praise be to Allaah.   

Obliging the husband to pay money to his wife if he mistreats her or abuses 
her, or obliging the wife likewise, is not binding and in fact is not 
prescribed in sharia at all. Determining the degree of a punishment is not up 
to people, and imposing payment of money as a punishment -- even if it is 
permissible -- is up to the judge. Moreover writing a receipt to this effect is 
a kind of lying, because neither of them has received anything from the other 
in that regard. 

Based on that, these receipts should be disposed of and should not be relied 
upon at all. 

Each of the two spouses must treat the other well, and adhere to that which 
Allaah has commanded of kind and decent treatment. Allaah, may He be exalted, 
says (interpretation of the meaning): 

“and live with them honourably”

[al-Nisa’ 4:19] 

“And they (women) have rights (over their husbands as regards living expenses) 
similar (to those of their husbands) over them (as regards obedience and 
respect) to what is reasonable, but men have a degree (of responsibility) over 
them”

[al-Baqarah 2:228] 

And Allaah knows best.



3. Buying gold through a site on the internet.

There is a company selling gold via the internet. Is it permissible to buy from 
them or to bring them customers and receive payment for that?.

Praise be to Allaah.   

It is well known in Islam that when buying gold for currency, the exchange 
should take place in the same sitting where the transaction is agreed upon, 
because the Prophet (peace and blessings of Allaah be upon him) said: “Gold for 
gold, silver for silver, like for like, same for same, hand to hand… If it is 
an exchange of one of these things for another, then sell as you like, so long 
as it is hand to hand.”  

Narrated by Muslim, 1578. 

I think that buying gold via the internet is not a transaction that is 
conducted hand to hand, because you are sending the money to them then they 
send that gold to you after a while. If that is the case, then buying and 
selling in this manner is haraam, and it is haraam for you to bring customers 
to this company, because Allaah says (interpretation of the meaning): 

“but do not help one another in sin and transgression”

[al-Maa'idah 5:2] 

But if the money and goods are exchanged immediately in one sitting, then it is 
permissible for you to tell people about them and to bring customers to this 
company, and to receive payment for that.

That is what distinguishes the hypocrites, that they and all praise be to 
Allah, do not understand a thing about the Religion. The hypocrite knows how to 
drive a car and its mechanics, he knows the nations of the world and their 
capitals, he also knows lots of trivial things and various other useless facts 
which do not benefit him, if they do not harm him. However, when you approach 
him with things from the Religion which are common knowledge, he doesn't know a 
thing about them.

Allah, the Sublime, says:

But the hypocrites do not understand. [Al-Qur'an, Al-Munaafiqoon (63):7] 

The Messenger of Allah, sallallaahu `alaihi wa sallam, said as is reported in 
the Saheehs of Al-Bukhari and Muslim: Whomsoever Allah wishes to show 
goodness, he gives him understanding of the Religion.

The people of knowledge have said the opposite to this is that whomsoever Allah 
does not wish to show goodness, He does not bestow upon him the understanding 
of the Religion.

The sign of a believer is that he understands the Religion and is constantly 
increasing his knowledge of certain matters and benefits and he is covetous of 
all that is good, as well as the gatherings wherein it is disseminated. The 
hypocrite, however, completely turns away. When the people talk in a gathering 
about matters to do with the Prayer or worship, it is to him as if they are 
speaking in a different language. However, when a matter of this world comes up 
such a price of goods, vouchers, bills, travellers cheques, the yen and the 
dollar (and I do not say that the believer does not know these matters, rather 
he knows these matters but he also knows the affairs of the Religion) then he 
(the hypocrite) speaks as if that is the only thing in the world which 
interests him besides food and drink. So he whoknows these matters but does not 
know a thing about the Religion, then that is a sign of hypocrisy and refuge is 
only with Allah!

On Arrogance, Humbleness, and Inferiority Complex

It has been called ummul-amradh, or the root of all sicknesses of the heart.
Prophet Muhammad, Sall-Allahu alayhi wa sallam, warned that a person having 
even an iota
of it in his heart will never enter paradise. This deadliest of all sins is 
kibr,
or arrogance.

No one likes arrogance --- in others. We never like a person who is haughty, 
too proud,
or condescending. We detest a person who belittles us and has a huge ego. 
Similarly we
love people who are humble, polite, and easy to talk to. We love people who 
give us
respect and honor. Thus if we follow the principle of treating others the way 
we like to
be treated, most of these problems might be cured. In reality, the treatment of 
ummul-amradh
requires a deeper look.

For that we need to appreciate the difference between adab or manners, on the
one hand and akhlaq or morals on the other. While adab deal with one’s
external disposition, akhlaq as defined by Islam deal with our inner thoughts,
feeling, and attitudes. In a healthy personality, the manners and morals are in 
harmony.
But it is also possible to have the former without having the latter. The first 
concerns
itself with how a person deals with others. The second is concerned with what a 
person
thinks of himself. Two persons showing humbleness in their dealings with 
others, may have
exactly opposite ideas in their minds. One may do it out of his or her
generosity; the other may do it because he genuinely thinks that he is not
better than the other person. The first person only has a shell of humbleness, 
which will
crumble when tested. It is the second person who is really free of arrogance.

Real greatness belongs only to Allah, our Lord, Creator, and Master. Human 
beings are
just a creation of Allah --- and a very small creation in comparison to the 
unimaginably
vast universe. Anyone who understands this will realize that our proper status 
is only
that of servants of Allah. In fact for a Muslim the real human model is none 
other than
Prophet Muhammad, Sall-Allahu alayhi wa sallam, who is the greatest of all 
human beings.
His greatness lies in being the humblest of all servants of Allah! It is 
impossible for
any person who has this consciousness to entertain any notions of his own 
greatness.

This leads us to the definition of kibr, given in a famous hadith: Kibr
is to knowingly reject Truth and to belittle other people. This hadith exposes 
two
strains of this deadly disease, both dealing with our exaggerated ideas of
self-importance. The first suggests that I am more important than the Truth. 
The second
suggests that I am more important than other people.

We know about the Quraish and Jews of Arabia who had come in contact with 
Prophet
Muhammad, Sall-Allahu alayhi wa sallam, and who knew in the heart of their 
hearts that he
indeed was the Messenger of Allah. Their arrogance, though, kept them from 
accepting it.
History has recorded statements from some of them who said we know he is the 
Promised
Prophet but we will keep on opposing him to maintain our leadership.

While that was the most blatant form of arrogance, we can witness the same 
attitude on
a smaller scale in our discussions and arguments. A person realizes that he was 
wrong, but
then his pride keeps him from admitting it. No matter how polite or humble
that person may appear to be ordinarily, this test shows the presence of 
arrogance in his
heart. It is arrogance that keeps a person from saying I am sorry.

The second strain involves our feeling of superiority with respect to other 
people.
Islam’s teaching is that one should never consider oneself greater than other 
people,
because that Judgment will come from Allah, and Allah alone, on the Day of 
Judgment. None
of us knows what our end will be, whether we will end up being a winner or 
loser over
there. The person who appears to be nobody here may end up with eternal bliss 
because of
his goodness that only Allah knew. The person who is a big shot here may end up 
among the
sinners who will be punished there, because of his evil that only Allah knew. 
How foolish,
it is then to congratulate ourselves over our fleeting superiority.

What if a person does have edge over another person in measurable worldly 
terms? How
then can he not consider himself superior than the other person in that 
respect? The point
is sometimes made in half jest: it is difficult to be humble when you are so 
great. Islam
does not ask us to reject reality and imagine we don’t have what we really do. 
Rather
it asks us to take a deeper look at the reality and not be misled by a 
superficial
perception of it. And the simple reality that escapes many is that our health, 
wealth,
talents, and power are not of our own creation. God gave those to us as a test 
and He can
take them back whenever He wills. Those who are conscious of this reality, 
their blessings
will produce gratitude in them; those who are blind to it

Does the Term Ahlul-Kitab Still Apply Today? 

Dear scholars, As-Salamu `alaykum. I frequently hear the term
Ahlul-Kitab. Does this term apply to the Jews and Christians of today
with their gross violations of all the divine rules and teachings
imbedded in the revealed books? Jazakum Allah khayran.

In the Name of Allah, Most Gracious, Most Merciful. 

All praise and thanks are due to Allah, and peace and blessings be upon
His Messenger. 

Dear brother in Islam, first of all, we'd like to say that we are
impressed by your question, which emanates from a thoughtful heart. May
Allah Almighty help us all adhere to the principles of this true
Religion, Islam, and enable us to be among the dwellers of Paradise in
the Hereafter, Ameen. 

In the first place, we would like to stress that Muslims should have
good relations with all people of every religion. At school, at work, in
the neighborhood, et cetera, a Muslim should be kind and courteous to
everyone. Islam teaches its adherents to interact with all people and
cooperate for the good and betterment of the whole mankind. Islam
encourages Muslims to cooperate with everyone regardless of his/her
religion or creed in all projects that are virtuous or beneficial to
humanity or other creatures of God. 

The Christians and the Jews of the People of the Book in our times are
indeed those referred to in the texts of Shari`ah, in both the Qur'an
and Sunnah, as Ahlul-Kitab. Signs of disbelief noticed in the practices
of some people of the Book, including Jews and Christians, in our times
does not expel them from being Ahlul-Kitab So, the rules and
regulations related to them regarding permissibility of eating their
food and marrying their chaste women are still applicable to them. 

In this regard, Sheikh M. S. Al-Munajjid, a prominent Saudi Muslim
lecturer and author states: 

Ahlul-Kitab or People of the Book consist of both believers and
disbelievers, as indicated in the Qur'an, where Allah mentions the
disbelievers among them, saying, O people of the Book! Why do you
disbelieve in the verses [about Prophet Muhammad] of Allah, while you
(yourselves) bear witness (to their truth). (Al `Imran: 70) 

And, Say: O people of the Book! Why do you stop those who believe from
the path of Allah, seeking to make it crooked, while you (yourselves)
are witnesses? And Allah is not unaware of what you do. (Al `Imran: 99)


Allah refers to the believers among the People of the Book, making clear
the difference between them and the disbelievers; He further says: Not
all of them are alike; a party of the people of the Book stand for the
right, they recite the Verses of Allah during the hours of the night,
prostrating themselves in prayer. They believe in Allah and the Last
Day; they enjoin what is right and forbid evil and they hasten in good
works; and they are among the righteous. And whatever good they do,
nothing will be rejected of them; for Allah knows well those who are the
pious. (Al `Imran: 113-115) 

These people also believe in our Prophet (peace and blessings be upon
him) and in the Qur'an which was revealed to him. Allah says, And there
are, certainly, among the people of the Book, those who believe in Allah
and in that which has been revealed to you, and in that which has been
revealed to them, humbling themselves before Allah. They do not sell the
Verses of Allah for a little price, for then is a reward their Lord.
Surely, Allah is Swift in account. (Al `Imran: 199) 

Signs of disbelief noticed in the practices of some people of the Book,
including Jews and Christians, in our times does not expel them from
being Ahlul-Kitab So, the rules and regulations related to them
regarding permissibility of eating their food and marrying their chaste
women are still applicable to them.

In another Fatwa, Sheikh Al-Munajjid adds: 

The Christians and the Jews of the People of the Book in our times are
indeed those referred to in the texts of Shari`ah, in both the Qur'an
and Sunnah, as Ahlul-Kitab. They are to be reckoned as unbelievers just
as they were in the lifetime of the Prophet (peace and blessings be upon
him). They are the people of the corrupted Torah and Injeel, as
evidenced by the fact that Allah called them People of the Book
despite their being unbelievers and their books being corrupted.
Following are some Qur'anic verses that prove this fact: 

O people of the Book! why do you reject the Signs of Allah, of which
you are (yourselves) witnesses? (Al `Imran: 70) 

O people of the Book! There has come to you Our Messenger, revealing to
you much that you used to hide in the Book, and passing over much (that
is now unnecessary): There has come to you from Allah a (new) light and
a perspicuous Book. (Al Ma'idah: 15)

23. Chapter: On Commanding The Right And Forbidding The Wrong
 
Allah Almighty says, Let there be a community among you who call to the good, 
and enjoin the right, and forbid the wrong. They are the ones who have 
success. (3:104) The Almighty says, You are the best nation ever to be 
produced before mankind. You enjoin the is right, forbid the wrong. (3:110). 
The Almighty says, Make allowances for people, command what is right, and turn 
away from the ignorant, (7:199) and the Almighty says, The believers, men and 
women, are friends of one another. They command what is right and forbid what 
is wrong. (9:71) The Almighty says, Those among the Tribe of Israel who 
rejected were cursed on the tongue of Dawud and that of 'Isa, son of Maryam. 
That is because they rebelled and overstepped the limits. They would not 
restrain one another from any of the wrong things that they did. How evil were 
the things they used to do! (5:78-79) and the Almighty says, Say: 'It is the 
truth from your Lord; so let whoever wishes
 believe and whoever wishes reject.' (18:29) The Almighty says, Proclaim what 
you have been ordered to, (15:94) and the Almighty says, We rescued those who 
forbidden the evil and seized those who did wrong with a harsh punishment 
because they were deviators. (7:165)
 
184. Abu Sa'id al-Khudri said, I heard the Messenger of Allah, (PBUH), say, 
'Whoever of you sees something wrong should change it with his hand; if he 
cannot, then with his tongue; if he cannot, then with his heart, and that is 
the weakest form of belief.' [Muslim]

Islamic courts have been cleared to deal with family and divorce disputes. 
 
Sharia tribunals will be able to decide how a Muslim couple divide their money 
and property and who gets the children. 
 
The sole proviso from Jack Straw's Justice Ministry is that a formal law court 
must rubber-stamp the ruling. 
 
This would be in the form of a two-page form sent to a judge sitting in a 
family court. The divorcing couple would not need to attend. 
 
The decision follows nine months of controversy over the role of tribunals run 
according to Islamic strictures. 
 
In February, Downing Street slapped down the Archbishop of Canterbury when he 
suggested the rise of sharia law seemed 'unavoidable'. 
 
But in July, Lord Phillips, who has since retired as Lord Chief Justice, said 
sharia principles could be the basis for resolving family and business 
disputes. 
 
Muslim ministers have warned that sharia should not have an official role 
because it accords unequal status to men and women. 
 
Giving more weight to evidence from men could hand them a greater share of 
property and enhanced custody rights. 
 
Lawyers said yesterday that using the secretive family courts to endorse sharia 
decisions would draw a veil over matters of wide public interest. 
 
Critics of the idea said yesterday advancing the role of Islamic tribunals 
would further marginalise isolated minority communities. 
 
The endorsement of sharia was announced to MPs by Bridget Prentice, a junior 
justice minister. 
 
She said the councils would still have no jurisdiction in England and that 
rulings by religious authorities had no legal force. 
 
But Miss Prentice added: 'If, in a family dispute dealing with money or 
children, the parties to a judgment in a sharia council wish to have this 
recognised by English authorities, they are at liberty to draft a consent order 
embodying the terms of the agreement and submit it to an English court.'  

'This allows English judges to scrutinise it to ensure that it complies with 
English legal tenets.' 
 
A consent order allows couples to have a 'clean break' divorce in which there 
are no long-term maintenance payments. 
 
The orders can be approved only where a couple have negotiated and agreed all 
aspects of their break-up such as money, debts, property and children. The 
family court judge must decide whether the agreement is reasonable and ensure 
no side has been disadvantaged. 
 
The great majority of consent orders are approved. 
 
Barrister Neil Addison said yesterday: 'If the system works, the judge will not 
allow an agreement where there has been pressure on one party. He allows a 
consent order only if the agreement seems reasonable. 
 
'However most mediation of disputes takes place in private and agreements are 
approved in open court. This is different  -  the original sharia law is secret 
and so is the judgment.' 
 
Robert Whelan, of the Civitas think-tank, said: 'The problem with the 
Government's attitude is the big question over how far submission to sharia 
courts is voluntary among Muslim women. 
 
'Women who live in some communities may have no option but to go to the sharia 
court. The case is then rubber-stamped by a family court without any of us 
knowing how the decision was reached.' 
 
Islamic tribunals have authority to make decisions in business and financial 
disputes where both parties agree to accept arbitration. 
 
Five sharia courts operate mediation systems under the Arbitration Act of 1996. 
 
But financial disputes are less controversial because they are much less likely 
to raise problems over the status of women.

Back in March 2008 Atlas Shrugs blog ran a story entitled GET OFF MY BUS I 
NEED TO PRAY! The title linked to a news report from the British tabloid 
news paper The Sun.

According to the Sun the story went something like this: Muslim bus driver in 
London kicks passengers off his bus in order that he can pray. Keeps them 
waiting and then lets them back on after he has done his Muslim thing.

4 comments were posted to the Atlas Shrugs website all of them rather 
aggressive towards the Muslim chap in the news report. Here they are:

As I said rather aggressive towards the Muslim bus driver. Anyway it transpires 
that the story was a fabrication by the Sun. That's right it never really 
happened as the Sun claimed.

Today the newspaper agreed to pay the Muslim bus driver £30,000 ($42,915) for 
libel and breach of privacy:

The Guardian

  A London bus driver today accepted £30,000 in damages from the Sun over a 
claim that he ordered passengers off his vehicle so that he could pray.

  The story in March last year caused Arunas Raulynaitis considerable distress 
and embarrassment, his solicitor, Stephen Loughrey, told Mr Justice Eady at the 
high court in London.

  Loughrey said the newspaper now accepted that the allegations were entirely 
false and that Raulynaitis did not order any passengers off, there was no 
rucksack and no one refused to reboard because they feared he was a fanatic.

  The article suggested that Raulynaitis was so arrogant, unprofessional and 
contemptuous of the passengers within his care whom he is paid to serve, that 
he ordered them off his bus so that he could pray, he added.

  The article went on to allege that the passengers later refused to reboard 
the bus because they spotted a rucksack and feared he may be a fanatic and 
therefore, it is to be inferred, a terrorist, Loughrey told the court.

  While it is the case that Raulynaitis did pray on the bus, he did so during 
his statutory rest break, as he is of course entitled to do. Not a single 
passenger was inconvenienced in any way. It transpires that an individual who 
noticed Raulynaitis at prayer chose to film this act on a mobile phone and sent 
the video to the Sun, which then reproduced stills from it alongside the 
article, as well as the footage itself on the Sun's website.

  Loughrey said the article not only created an utterly false impression of 
Raulynaitis's attitude toward his passengers, but also wrongly cast serious 
aspersions on his religious faith.

  He added that News Group Newspapers, the News International subsidiary that 
publishes the Sun, had already published an apology and agreed to pay 
substantial damages plus costs.

  The newspaper's solicitor, Patrick Callaghan, apologised for the publication 
of the false allegations.

  Raulynaitis's law firm, Carter-Ruck, said the damages were for libel and 
breach of privacy. As well as being highly defamatory of Raulynaitis, the 
article was also a clear and serious infringement of his privacy, Carter-Ruck 
added.

  It included photographs of him at prayer, and indeed the website version of 
the article included deeply intrusive mobile phone footage, which readers of 
the Sun were encouraged to watch.

  References to the false story quickly found their way on to a number of 
other often Islamophobic websites and the footage of Raulynaitis at prayer was 
also posted on YouTube, where it was viewed by thousands more people.
