يهديكم فريق عمل رقابة أطيب التحيات، ويتمنى لكم دوام التقدم والنجاح.



يسعدنا أن نرفق لكم بحث " تقريب هوة الخلاف بين الفتاوى الشرعية: الإنجازات
والتحديات  "، الذي قدمته "رقابة" فيالمؤتمر العالمي العاشر لعلماء الشريعة
بماليزيا في الفترة ما بين 3 – 4 نوفمبر 2015م.

 استهدف البحث تحديد أدوات وتحديات التقريب بين الفتاوى الشرعية على المستوى
المحلي والدولي، بالإضافة إلى توضيح أبرز الإنجازات الدولية الهادفة إلى
التقريب بين الفتاوى الشرعية.

 وقد خلص البحث إلى الآتي :

-   تتمثل أهم أدوات التقريب بين الفتاوى الشرعية على المستوى
المحلي في ثلاث هي: هيئة الرقابة الشرعية العليا، وإعداد نظام عمل هيئة
الرقابة الشرعية الخاصة الذي يضع إطار ملزمًا لضوابط الفتوى على مستوى هيئات
الرقابة الشرعية الخاصة، واعتماد العقود النمطية على مستوى المؤسسات المالية
الإسلامية.

-   تتمثل أهم أدوات التقريب بين الفتاوى الشرعية على المستوى
الدولي في: المجامع الفقهية الدولية، والمعايير الشرعية الصادرة عن هيئة
المحاسبة والمراجعة للمؤسسات المالية الإسلامية، والندوات والمؤتمرات المتخصصة.

-   يعتبر من أهم تحديات التقريب بين الفتاوى الشرعية الآتي: عدم
وجود نظام ملزم يتضمن ضوابط الفتوى الخاصة، وغياب (أو ضعف) دور الهيئة الشرعية
العليا.



وفي هذا الإطار إنتهى البحث إلى توصيات موجّهة إلى هيئة المحاسبة والمراجعة
للمؤسسات الماليّة الإسلامية (أيوفي) حول مراجعة وتطوير معايير الضبط للمؤسسات
المالية الإسلامية وخاصة في الجوانب الآتية:

-   تطوير معيار رقم (1): "تعيين هيئة الرقابة الشرعية
وتكوينها وتقريرها"
الذي يتضمن ضوابط الفتوى الخاصة ليراعي القيود المستجدة بسبب وجود هيئة عليا
أو معايير شرعية معتمدة أو نظام عمل هيئات الرقابة الشرعية الخاصة.

-   إعداد معيار خاص ب "هيئة الرقابة الشرعية العليا" في ظل
وجود فجوة في المعايير الدولية التي تتناول هذا الموضوع.
