Hi.  Juan Cole’s opening, introductory paragraph has a factual error,
written before Saif al-Islam turned up alive.  This will likely be seized
upon by the relative few who have seen this massive, popular uprising
largely as a U.S. intervention.  They are wrong.  That the major capitalist
nations want control of middle-east oil and have supported dictators for the
past hundred years, until the Arab spring, is indisputable, as is their
hypocritical support for whomever is ascending or in power. As that will
continue, it cannot be the basis for opposing these wars of liberation from
merciless dictatorships, even when they welcome air support to prevent mass
murder.  Cole doesn’t deal with this as an ongoing concern, but has much to

The Libyan Revolution has largely succeeded, and this is a moment of
celebration, not only for Libyans but for a youth generation in the Arab
world that has pursued a political opening across the region. The secret of
the uprising’s final days of success lay in a popular revolt in the
working-class districts of the capital, which did most of the hard work of
throwing off the rule of secret police and military cliques. It succeeded so
well that when revolutionary brigades entered the city from the west, many
encountered little or no resistance, and they walked right into the center
of the capital. Muammar Qaddafi was in hiding as I went to press, and three
of his sons were in custody. Saif al-Islam Qaddafi had apparently been the
de facto ruler of the country in recent years, so his capture signaled a
checkmate. (Checkmate is a corruption of the Persian “shah maat,” the “king
is confounded,” since chess came west from India via Iran). Checkmate.

The end game, wherein the people of Tripoli overthrew the Qaddafis and
joined the opposition Transitional National Council, is the best case
scenario that I had

revolution. I have been making this argument for some time, and it evoked a
certain amount of incredulity when I said it in a lecture in the Netherlands
in mid-June, but it has all along been my best guess that things would end
the way they have. I got it right where others did not because my premises
turned out to be sounder, i.e., that Qaddafi had lost popular support across
the board and was in power only through main force. Once enough of his heavy
weapons capability was disrupted, and his fuel and ammunition supplies
blocked, the underlying hostility of the common people to the regime could
again manifest itself, as it had in February. I was moreover convinced that
the generality of Libyans were attracted by the revolution and by the idea
of a political opening, and that there was no great danger to national unity
here.

I do not mean to underestimate the challenges that still lie ahead– mopping
up operations against regime loyalists, reestablishing law and order in
cities that have seen popular revolutions, reconstituting police and the
national army, moving the Transitional National Council to Tripoli, founding
political parties, and building a new, parliamentary regime. Even in much
more institutionalized and less clan-based societies such as Tunisia and
Egypt, these tasks have proved anything but easy. But it would be wrong, in
this moment of triumph for the Libyan Second Republic, to dwell on the
difficulties to come. Libyans deserve a moment of exultation.

I have taken a lot of heat for my support of the revolution and of the
United Nations-authorized intervention by the Arab League and NATO that kept
it from being crushed. I haven’t taken nearly as much heat as the youth of
Misrata who fought off Qaddafi’s tank barrages, though, so it is OK. I hate
war, having actually lived through one in Lebanon, and I hate the idea of
people being killed. My critics who imagined me thrilling at NATO bombing
raids were just being cruel. But here I agree with President Obama and his
citation of Reinhold Niebuhr. You can’t protect all victims of mass murder
everywhere all the time. But where you can do some good, you should do it,
even if you cannot do all good. I mourn the deaths of all the people who
died in this revolution, especially since many of the Qaddafi brigades were
clearly coerced (they deserted in large numbers as soon as they felt it
safe). But it was clear to me that Qaddafi was not a man to compromise, and
that his military machine would mow down the revolutionaries if it were
allowed to. 

Moreover, those who question whether there were US interests in Libya seem
to me a little blind. The US has an interest in there not being massacres of
people for merely

After years of 'silent raids' and federal workplace audits, unions 
and community allies are going on the offensive.

BERKELEY, CA -- When the current wave of mass firings of 
immigrant workers started three years ago, they were called silent 
raids in the press.  The phrase sought to make firings seem more 
humane than the workplace raids of the Bush administration.  During 
Bush's eight-year tenure, posses of black-uniformed immigration 
agents, waving submachine guns, invaded factories across the country 
and rounded up workers for deportations.
Silent raids, by contrast, have relied on cooperation 
between employers and immigration officials.  The Department of 
Homeland Security identifies workers it says have no legal 
immigration status.  Employers then fire them.  The silence, then, is 
the absence of the armed men in black.  Paraphrasing Woody Guthrie, 
they used to rob workers of their jobs with a gun.  Now they do it 
with a fountain pen.
Silence also describes the lack of outcry on behalf of those 
workers losing their jobs.  No delegations of immigrant rights 
activists have traveled to Washington DC to protest.  Unions have 
said little, even as their own members were fired.  And undocumented 
workers themselves have been afraid.  Those working feared losing 
their jobs.  Those already fired worried that immigration agents 
might come knocking on their doors at night.
Over the last few months, however, a wave of protest is 
starting to break that silence.  In Berkeley, California, workers 
facing firings at Pacific Steel Castings, the largest steel foundry 
west of the Mississippi, have sought community support in a fight to 
keep their jobs.  City councils in Oakland and Berkeley have passed 
resolution asking Homeland Security Secretary Janet Napolitano to 
back off efforts to force the company to terminate them.  Churches 
and immigrant rights activists have sent her letters with the same 
demand.
In Los Angeles, 1400 janitors marched among the Bunker Hill 
skyscrapers, blocking downtown traffic at lunch hour.  They protested 
a wave of similar firings by Able Building Maintenance, California's 
largest privately-held building services contractor.
The two protest campaigns come after two years in which 
dozens of other employers have fired workers in response to DHS 
demands.  John Morton, head of the Immigration and Customs 
Enforcement agency, a division of DHS, has made serial announcements 
of the number of companies being audited to find undocumented 
employees - citing figures from 1000 to 1654. 
There is no master list of how many how many workers have 
been fired.  Over the last two years, however, it's at least many 
thousands.  In Minneapolis, Seattle and San Francisco over 1800 
janitors, members of SEIU union locals, lost their jobs.  In 2009 
some 2000 young women laboring at the sewing machines of American 
Apparel were fired in Los Angeles.  At one point Morton claimed ICE 
had audited over 2900 companies.
President Obama says this workplace enforcement targets 
employers who are using illegal workers in order to drive down 
wages-and oftentimes mistreat those workers.  An ICE Worksite 
Enforcement Advisory claims unscrupulous employers are likely to pay 
illegal workers substandard wages or force them to endure intolerable 
working conditions.  Curing intolerable conditions by firing workers 
who endure them doesn't help the workers or change the conditions, 
however. 
Instead, the administration's rhetoric has fed efforts to 
blame immigrants for stealing jobs and for undermining wages.  In a 
bid to oppose support for Pacific Steel workers, one local city 
council member wrote, every job given to an undocumented immigrant 
is a job denied to an American citizen, and citizens won't work for 
the low wages undocumented immigrants will work for.

In reality, the DHS workplace enforcement wave is focusing, 
not on low-wage employers, but on high-wage, and often unionized 
ones.  Fired janitors around the country are almost all members of 
SEIU.  Workers at Pacific Steel belong to Local 164B of the Glass, 
Molders, Plastics and Pottery Workers (GMP).  In this council 
member's own city, dozens of workers were terminated at a Sealy 
mattress factory, where they belonged to a furniture workers' local 
of the Communication Workers of America.
There is a long history of anti-union animus among 
immigration authorities.  Agents have set up roadblocks before union 
elections in California fields, conducted raids during meatpacking 
organizing drives in North Carolina and Iowa, audited janitorial 
employers and airline food plants prior to union contract 
negotiations, and helped companies terminate close to a thousand 
apple packers when they tried to join the

Dear Daniel,
We can't sacrifice our public libraries to corporations looking to make a 
buck. 
Public libraries provide tremendous value to our communities. And it's not 
just about books. Whether it's access to the internet or a safe place to study 
after school, libraries create a civic space that impacts everyone from 
children to seniors. 
But this vital role is threatened when the operation of public libraries is 
handed over to private corporations that seek to run the libraries first and 
foremost to maximize their profit.

In the midst of successive budget crises, California has seen a number of 
communities consider turning over their public libraries to private 
corporations, often without the type of public dialogue and considered 
analysis such an impactful decision merits. 
One of the central problems with privatization is that claims made by 
corporate privateers often have little basis in reality. Or hidden costs 
become apparent only after a private company has taken over. 
Local officials have a duty to ensure taxpayers don't get a raw deal. But 
slick sales pitches, budget shortfalls or conservative ideology can entice 
elected officials to rush headlong and embrace risky privatization schemes. If 
that's not enough, right now there's no requirement that the public be given a 
meaningful chance to weigh in before a public library is privatized. 
AB 438 — which was passed in the California State Assembly in June and will 
soon get a vote in the State Senate — will protect our libraries from 
privatization. It will give taxpayers the information they need about library 
privatization efforts in their community, and shift the burden of proof to 
require credible evidence that the community will benefit from privatization. 
The bill requires that a city or library district that intends to employ a 
private contractor to operate a library shall require 1) a fair cost analysis, 
2) proven savings to the taxpayers, 3) competitive bidding, 4) proven 
qualifications of the contractor, 5) no displacement of current employees, and 
6) performance and financial audits. 
Or as Assemblyman Das Williams, who wrote the bill, said: All of the things 
that [a company] promises to the public for cost savings should have proof. 
And it should be proof that is presented to the public in a public meeting 
with adequate notice. That's what I view as the core of this bill. 
These are rather modest requirements given the central importance of public 
libraries to local communities.

Hello everyone,

I wanted to give an update on the Indigenous struggle going on here in
northern Arizona.

Below is an article in the Flagstaff paper today.  For the Hopi, their
Katsinas live on the sacred Peaks, which they call Nuvatukaovi.  The
Dine'/Navajo call the mountain Doo’ko’oosliid, and it is the western
mountain of their 4 sacred mountains.  In total, 13 tribes from this area
hold this mountain sacred, with some believing it to be the origins of
their being.

We are up to over 30 indigenous and ally activists that have been arrested
in the past 3 weeks, including Huluapai, Navajo/Dine', Yavapai-Apache,
Havasupai  Hopi.  Protests centered around Forest Service offices have
now spread to Albuquerque, NM and Gallup, NM.  Yesterday, many activists
protested outside of the City Hall in Flagstaff, which was led by chanting
and drumming by Navajo/Dine' healers.  There are also over 20
campsites/basecamps that indigenous activists have established across the
western side of the mountain, using the 2 week legal camping permits
allowed by the US Forest Service.  This past week, the USFS police have
began harrassing the campers, so there are expectations that they will
soon attempt to disrupt these peaceful and prayerful campsites.  I have
been volunteering sporadically at the cookshack, and plan to be there
again with my kids on Friday.  These campsites can use supplies, camping

actions to stop the desecration by the Amerikkkan government, which
continues to destroy Indigenous culture and lifeways for profit.

Hopi Tribe sues Flagstaff over snowmaking

The Hopi Tribe has filed suit against the city of Flagstaff for the city's
sale of reclaimed wastewater to Arizona Snowbowl.

The tribe is asking a Coconino County Superior Court judge to find that
the city's contract to sell water is illegal, and to declare it null and
void and/or award the tribe unspecified financial compensation for
suffering it says it will experience if the plan goes ahead.

The lawsuit says the city's water sale will create a public nuisance and
violate state laws about where reclaimed water can be used.

Notably, the tribe raises future plans for city water sources at Red Gap
Ranch, ties it to the reclaimed water sale, and says Flagstaff is doubly
infringing upon the tribe's water rights.

The law governing tribal water rights dates to a 1908 case where the U.S.
Supreme Court found that tribal reservations were guaranteed water rights
sufficient to meet the needs of the reservation.

If a reservation was established to give a tribe an area to grow
agriculture, for example, there must be enough water to irrigate crops on
it.

The city has an agreement to sell up to 1.5 million gallons of reclaimed
water daily to Snowbowl from November through February.

This comes as a second lawsuit questions the possible human health risks
of using reclaimed water to make snow for skiing, and as contractors
working for Snowbowl install water pipeline along Snowbowl Road.

Federal courts ultimately sided with the U.S. Forest Service in a previous
lawsuit that asserted snowmaking would violate tribal religious freedoms.

In this lawsuit, the Hopi Tribe asserts the water sale for making snow:

-- Is contrary to public policy because it will result in unreasonable
harm to the environment and public health

-- Was null and void because Snowbowl's contractual agreement to buy city
water expired in 2004, when Snowbowl had not yet obtained all necessary
approvals for the snowmaking project

-- Is against state law because reclaimed water is not allowed to run off
of the site for which it is intended, and run-off is expected here

-- Goes against city and state requirements that

AMY GOODMAN: Libyan rebels have consolidated their grip on the capital of
Tripoli by capturing Muammar Gaddafi's main compound, a hugely symbolic
victory that appears to put an end to his 42-year-long rule, but the
whereabouts of Gaddafi remain unknown. He spoke Tuesday night on a poor
phone connection to a Syrian-based television channel.

MUAMMAR GADDAFI: [translated] All the tribes in Tripoli, out of Tripoli,
youths, senior people, women, men and armed communities must attack Tripoli
and comb the streets and eradicate the traitors and rats. They will
slaughter you and desecrate your bodies.

AMY GOODMAN: That was Muammar Gaddafi speaking from an undisclosed location
on Tuesday. The Libyan leader said he had retreated from his Tripoli
compound in a tactical move after NATO air strikes reduced it to rubble. In
his address, Gaddafi vowed his forces would resist the aggression with all
strength until either victory or death.

Reporters in Tripoli say heavy gunfire could still be heard nearby the area
of the Rixos Hotel, where dozens of international journalists are trapped.
The hotel is guarded by heavily armed Gaddafi loyalists. Former U.S.
Congress Member Walter Fauntroy is one of the 35 people stuck in the hotel.
He told the Daily Telegraph, quote, Right now we are in a precarious
situation with some of our friends from the media, because we fear that
unless we are able to relocate, we may all be in danger.

Meanwhile, Libya's U.N. envoy, Ibrahim Dabbashi, predicted Tuesday the
country would be liberated within 72 hours.

IBRAHIM DABBASHI: We expect Sirte, which is the natal city of Colonel
Gaddafi, to fall in the hands of the freedom fighters within the next 48
hours. Our forces are coming from both sides, from the west starting from
Misurata and also from the east starting from Ras Lanuf and Brega. They are
moving now toward Sirte, and we expect them to capture Sirte very soon. We
expect also the population of Sirte to join the revolution soon. For Sabha,
also we expect it also to join the revolution in the next 48 hours. So, we
expect Libya to be totally liberated and totally calm and peaceful within
the 72-the next 72 hours.

AMY GOODMAN: That was Libya's U.N. envoy Ibrahim Dabbashi. He had
represented Gaddafi but was one of the first diplomats to defect. He said
Gaddafi and other top officials may be scattered in houses across Tripoli or
in an underground shelter.

The Arab League said Tuesday it will meet this week to consider giving
Libyan rebels the country's seat at the League after it was taken away a few
months ago from the Gaddafi government.

Qatar's prime minister and minister of foreign affairs], speaking at a
meeting in Qatar, one of the main backers of the Libyan rebels.

HAMAD BIN JASSIM BIN JABER AL-THANI: [translated] Libyan brothers who have
died so far, what we hope for now is stability and consensus in Libya, and
we also hope that wisdom, forgiveness and the rule of law will be adopted by
all Libyans. One war is over, but the next has just begun, that of building
and forging consensus amongst Libyans. And I think this is just as important
as the previous war.

Today, Britain's National Security Council is meeting to discuss welcoming
the National Transitional Council. Talks have included how to send
humanitarian aid and medical supplies. Ministers also discussed working with
the U.N. to unfreeze Libyan assets to financially assist the council.
