“Sixty Year Later:  Reaffirming “Inherent Dignity and Equal and Inalienable 
Rights”, A Commentary by Andrea Carmen, International Indian Treaty Council 
Executive Director

“Whereas recognition of the inherent dignity and of the equal and inalienable 
rights of all members of the human family is the foundation of freedom, justice 
and peace in the world”

These inspiring words are the opening paragraph of the United Nations 
“Universal Declaration of Human Rights” (UDHR), adopted by the United Nations 
(UN) General Assembly 60 years ago today, December 10th, 1948.   

Indigenous Peoples were not involved in drafting or adopting the UDHR.  But its 
recognition that Human Rights are inherent --- the birthright of all persons 
and Peoples, bestowed on us by our Creator -- have resonated strongly with us.  
“Inherent” and “inalienable” mean that Human Rights can never be given or taken 
away, by states (countries), the UN, or any other entity.    They can only be 
recognized and upheld.  Or, as is too often the case, they can be violated.   

Given the UN’s historic commitment to these principles as expressed in its 
founding human rights document, we were surprised and on many occasions 
outraged, during the 25-years of work for the adoption of the UN Declaration on 
the Rights of Indigenous Peoples, to see that   some states were not ready to 
recognize these principles when it came to Indigenous Peoples.   The US, 
Canada, Australia and New Zealand  (the only four counties which voted against 
the Declaration at the UN General Assembly last year) continually proposed 
language that defined the rights of Indigenous Peoples as “less” than those 
already recognized under International Law for “All Peoples”.   This was 
particularly the case with the internationally- recognized right to 
Self-determination.  

It became clear to us that Racism and Discrimination, as well as an ongoing 
tendency for states to disregard their existing human rights obligations, 
remained alive and well in the hallowed halls of the United Nations. The UDHR 
had clearly not done enough to ensure that the rights of Indigenous Peoples 
were fully recognized and protected.

On September 13, 2007, the equation was changed with the adoption of the UN 
Declaration on the Rights of Indigenous Peoples by the General Assembly.  The 
Declaration affirmed and underscored, in both its preamble and operative 
articles, that Indigenous Peoples are equal in rights to all other persons and 
Peoples.   
Indigenous Peoples were finally, irrevocably recognized as full members of the 
human family, and as Peoples with both individual and collective human rights 
fully affirmed.   There can now be no backsliding, no exceptions or 
justifications for defining the rights of Indigenous Peoples as “lesser” or 
“second class” rights.  

The Declaration on the Rights of Indigenous Peoples does not bestow any new 
human rights.   Rather, while affirming that Indigenous Peoples’ have equal 
rights as compared to any other Peoples, it also reflects our unique 
perspectives as to how these rights must be respected, expressed and 
implemented to ensure our collective survival, dignity and well-being.   Its 
adoption was an essential and long-overdue step towards fulfilling the 
commitment made by the UN General Assembly 60 years ago today.  

Sixty years may seem like a long time to wait for our inclusion as full members 
of the human family.   But Indigenous Peoples have waited, in this hemisphere 
at least, for more than 516 years to throw off the brutal legacy of 
colonization, land theft, violated treaties, and cultural destruction.  And 
despite the commitments made by the world community on December 10, 1948, as 
well as on September 13, 2007, the situations facing our communities have not 
changed very much “on the ground”.  In many places around the world, including 
in the United States, Indigenous Peoples continue to face human rights 
violations of all kinds.

But with the adoption of the Declaration, Indigenous Peoples have a solid floor 
to stand on. We have an internationally-recognized minimum standard affirming 
that our inherent rights are not less than those of other Peoples.  But we do 
not want to wait, and in fact we cannot wait, another 60 years to see its 
implementation become a reality for Indigenous Peoples around the 
world.    
 
Implementation is the key, and the challenge, as we move forward to ensure that 
the noble words on paper have in impact in the lives of Indigenous Peoples 
struggling to survive, thrive and protect their traditional homelands and ways 
of life.  This will require, first and foremost, that we as Indigenous Peoples 
refuse to accept less than the “minimum standard” affirmed in the Declaration 
in any of our dealings with states or their representatives, as we continue to 
defend and assert our rights.  This w

DENVER, CO - AUGUST 25, 2008 – To honor and celebrate Native Americans' 
historic engagement in the political process this year, a truly unique event, 
"Native Nations: Uniting for Change",
will be held on Wednesday, August 27th at the Denver Art Museum. The
event will be held to honor the Congressional Native American Caucus
and the Native American Delegates to the Democratic National Convention
(DNC).  


"This event will celebrate the nomination of Sen. Barack Obama as
the Democratic Presidential Nominee and bring together tribal leaders,
U.S. Senators, Members of the House of Representatives, and other
friends of Indian country for a day of discussion, education,
networking, Native American art, and live performances," said Mark
Macarro, Tribal Chairman, Pechanga Band of Luiseño Indians and DNC
Platform Committee Member.


The DNC in Denver will highlight the increasingly important role of
Native Americans in the electing of America's leaders. The 2008 DNC
will include a record number of Native delegates as Native voices are
being heard like never before. Native American leaders describe the
2008 Election year as historic and marked by an unprecedented effort by
the candidates to pay heed to tribal communities and concerns. The
Native vote this year could very well decide the outcome in key
battleground states.


Joe A. Garcia, President of the National Congress of American
Indians, will serve as moderator for the policy forum from 2 – 4 p.m.
on Wednesday. Topic areas to be discussed include the Native American
Plank of the Democratic Platform, A New Administration – Honoring the
Government to Government Relationship, Indian Country's Request for the
Presidential Transition Plan, and Legislative Priorities Outlooks. 


Native Nations Reception, 4:00 – 7:00 p.m.
This
innovative reception will include a Native American art exhibition,
Native inspired multi-media presentations and food, as well as a live
art performance by painter Bunky Echo-Hawk (Pawnee/Yakama). Echo-Hawk
will create a painting beginning at 5 p.m. that will be inspired by the
historic role that Native Americans are playing in this year's
presidential election. In addition, there will be musical performances
by Meighan Meisters, a young First Nations artist. The reception will
be held in Ponti Hall in the North Building of the Denver Art Museum.


Democratic National Convention Viewing Party, 7:00 – 9:00 p.m.
A live feed of the DNC will be provided for all attendees in the Ponti Hall in 
the North Building of the Denver Art Museum.

Native Nations After Party, 9:00 – 11:00 p.m.

The after party will include live music and entertainment in the Ponti Hall in 
the North Building of the Denver Art Museum.

Consolidated Indigenous Shadow Report to United Nations Committee on the 
Elimination of Racial Discrimination highlights Racism by United States
 


February 5, 2008 – The International Indian Treaty Council (IITC), in 
coordination with the Western Shoshone Defense Project, submitted a 
Consolidated Indigenous Shadow Report to the United Nations Committee on the 
Elimination of Racial Discrimination (UNCERD) on January 6th, 2008.  The UNCERD 
is the "Treaty Monitoring Body" for the International Convention on the 
Elimination of All Forms of Racial Discrimination (ICERD).  It monitors 
compliance of the States (countries) which have ratified the Convention with 
its provisions, including the United States (US).
 
Submissions from Indigenous Peoples, tribes, organizations and communities from 
around the country were included in the report.  It highlights a range of human 
rights violations and examples of racial discrimination reported by Indigenous 
Peoples in the US.  These include the destruction of sacred sites, threats to 
spiritual and cultural practices, environmental racism, violence against 
Indigenous women, Homeland Security-promoted border and immigration policies, 
Treaty rights violations, widespread discrimination in education, health and 
prisoners' rights.  Information was also included from Indigenous Peoples in 
countries outside the US who are affected by US policy. The report will be 
considered in the upcoming examination of the US by the UNCERD in February in 
Geneva, Switzerland. 
 
The UNCERD, during the review, will question US representatives on US 
compliance with the Convention based on the US official report to the 
Committee, called the Periodic Report. United Nations guidelines require that 
governments consult with Non-Governmental Organizations in their counties when 
they compile their Periodic Reports, but the US has generally ignored this 
guideline.  The Consolidated Indigenous Report was submitted to ensure that the 
voices of Indigenous Peoples would be heard during this examination. 
 
Alberto Saldamando, IITC General Counsel, who co-coordinated the development of 
the report stated, "In compiling this report to the UNCERD, it was clear that 
the institutionalization of racism and discrimination against Native Peoples is 
ingrained at every level of US society.  The data and the many inputs we 
received from Tribes, Native Peoples and individuals vividly demonstrate that 
racial discrimination thrives in schools, universities, prisons and in the 
so-called administration of justice in the US, at every level of government and 
society at large.  Even in textbooks, Indigenous Peoples in the US are reduced 
to caricatures with little humanity and even fewer rights, particularly those 
rights recognized by the recently adopted UN Declaration on the Rights of 
Indigenous Peoples. We hope that the government and people of the US are 
willing to correct the highly disproportionate impact of discrimination and 
poverty on Native Peoples in the US, in keeping with the UN
 Declaration.  The international arena is one of the few spaces we have to 
denounce the racial discrimination directed against us.  At some point it has 
to happen."
 Julie Fischer, Western Shoshone Defense Project and co-coordinator of report 
stated, "We are extremely pleased with the completion of the Indigenous Joint 
Shadow Report.  As we continue to move forward in this long struggle, we are 
witnessing more and more native voices coming forth and standing to be counted. 
 The Report reflects those voices and the commonality of the struggles of the 
indigenous peoples of this Turtle Island.  The Committee on the Elimination of 
Racial Discrimination has been a strong force in the struggle of the Western 
Shoshone and other indigenous people.  With the information contained in this 
Report, it is our hope to equip the Committee with the information it needs to 
hold the United States and its multi national corporations accountable to the 
rights of the first peoples and respect for their traditional laws, lands and 
resources."
 
In recent years the UNCERD has made very important decisions upholding 
Indigenous Peoples' Human Rights, in particular its General Recommendation XIII 
which affirms Indigenous Peoples' Free Prior Informed Consent in matters 
affecting them, and calls upon States to uphold this right.  The Western 
Shoshone Defense Project served as the co-coordinators with IITC for the 
development of this Report, and has successfully used the ICERD "Early Warning 
and Urgent Action procedures" to raise questions challenging the legitimacy of 
the Indian Land Claims Commission process and the purported "loss" of their 
ancestral lands in violation of the Treaty of Ruby Valley.  In 2006, the UNCERD

PAWNEE, OK-More than 85 Pawnee and Native youth
participating in the NVision Tour youth event at the
Pawnee Nation of Oklahoma over the Memorial Day
weekend received a very special surprise when a
celebrity guest arrived to partake in the festivities.

Actor Casey Affleck, a star from the upcoming film
“Ocean’s Thirteen,” and an international TV Series “4
Real” arrived to cover the multi-media, arts, music
and cultural event designed to promote leadership
development for Native youth and young adults.  The
innovative Native youth event was organized by
NVision, a national Native non-profit organization and
affiliate project of the Seventh Generation Fund.
NVision is comprised of some of the country’s leading
young Native professionals and visual and performing
artists.

NVision was selected by 4Real producers to be featured
in a series of eight, half-hour television shows that
take celebrity guests on adventures around the world
to connect with young leaders who, according to 4Real
Producers “under extreme circumstances, are affecting
REAL change. These are the REAL heroes of our time.”

Casey Affleck is among other celebrity guests
including Mos Def, Joaquin Phoenix, the Red Hot Chili
Peppers, and Cameron Diaz who have visited or will
visit communities all over the world to learn about
young leaders, like those of NVision.  The series will
air this fall in Canada on MTV and producers are also
seeking distribution in the U.S. and internationally
as well.

Affleck, 4Real Host Sol Guy and 4 Real’s camera crew
spent the weekend with NVision members and Native
youth participating in the NVision Tour multi-media
and visual and performing arts workshops. Native youth
spent much of Saturday attending workshops in
filmmaking, music, dance, photography, visual arts,
and leadership and culture.

Workshops led by NVision trainers not only gave Native
youth a taste of basic skills in multi-media and
visual and performing arts but also focused on the
importance of celebrating Native identity, history,
language and culture through contemporary and
traditional forms of artistic expression. NVision
trainers emphasized a message to Native youth of the
importance of wellness, empowerment, leadership and
the ability to successfully “walk in two worlds.”

 NVision youth participants, Affleck, 4Real and the
local community were also treated to a series of
community and cultural events including a dance
sponsored by NVision Friday night honoring Native high
school graduates.

On Saturday evening, NVision held a community dinner
and concert at the Pawnee Nation gym.  The concert
centered around a showcase of youth-produced pieces
including a short film, murals, music, dance and
photography created during the NVision Tour workshops.
Nationally acclaimed Native hip hop, funk, folk/rock
and traditional musical artists also performed at the
concert.

A painting created by the young acclaimed
Pawnee/Yakima artist and NVision member Bunky
Echo-Hawk was created live on-stage during the
concert. Upon its completion Casey Affleck and 4Real
Host Sol Guy both autographed the painting.  NVision
will conduct on online raffle for the painting from
June1-15th on its website at www.nvisionit.org. Raffle
proceeds will go towards creating an NVision
scholarship for the Pawnee Nation College.

NVision hopes to take the NVision Tour to reservations
and cities nationwide in the coming year. The
non-profit organization is currently fundraising and
seeking sponsorships for the NVision Tour.  For more

 THE INDIAN WARS NEVER ENDED
 MODERN DAY MESSAGE FOR MODERN DAY TIMES 
 
 BOULDER, CO- On Monday, March 26th, 2007, attorneys and staff of the Native 
American Rights Fund will premier its first ever Public Service Announcement at 
the opening ceremonies of the National Indian Gaming Association's annual 
convention and trade show in Phoenix, Arizona. The :60 second PSA, entitled, 
"The Indian Wars Never Ended," is part of a greater campaign to generate a 
renewed awareness to one of Indian Country's most established and respected 
non-profit advocacy organizations. 
 
 For 36 years, NARF has played a significant role in the progress of Native 
people's by providing legal advice and assistance to tribal governments in 
need. Today, some of those tribes are enjoying an economic renewal with the 
advent of gaming in the United States. It's why NARF will celebrate its renewed 
mission of "standing firm for justice" at the NIGA event before a live audience 
of hundreds of anticipated convention attendees. 
 
 Featured in the PSA production are NARF Executive Director John Echohawk and 
members of his legal team, as well as the award-winning hip-hop duo, Culture 
Shock Camp comprised of DJ, Shock B and lyricist and PS composer/producer, 
Quese IMC. The cross-generational project represents the symbolic message of 
NARF as it establishes a modern-day message for modern-day times.
