Read the Help Topic Merge  Options to see the comparison criteria
Legacy uses.

You will see that Legacy does not consider marriages (dates nor spouse
names) in comparing two people.

We are happy to consider suggestions for new features.

In Legacy 6.0 and 7.0 you can suggest a new feature by clicking on the
link on the Legacy Home Tab Support Section

Other users can make a suggestion here:

Use the drop down list in the first box to select a category, Legacy 7
or Legacy Charting.

Michelle,
I just submitted a suggestion about this comparison problem and used your 
example.  I have likewise had many possible duplicates presented by the program 
which can not possibly be the same person.  The basic principle is that for two 
individuals to be considered the same person, they should at least have lived 
during the same time frame.  Hope the programmers might tweak this logic and 
provide a life-span must intersect option.

put it on legacy, so strange.

That is what is displayed when I run a find dups.

On the left side it shows David Johnson with a birth date of 1962, on the right 
side it shows the other David Johnson who has a marriage date of 1815.  
Needless to say I marked them as not duplicates but that should have been 
figured out by the computer.

I tend to agree with you. I came to the conclusion, rightly or wrongly, that
Legacy does not compare vital dates, so I no longer use it, preferring
GenMatch or GenViewer (usually the former).

Michele,
This could be the preverbal double edged sword.  If the program eliminates this 
as a dup and one of the dates is in error, then you would not see the error.  I 
think I would rather choose to call it a dup instead of having the computer 
determine that it isn't.
