"Add To List" assigns the list before to the current paragraph; having one item - the very first before the list - would make the behavior inconsistent. And using the Ctrl key modifier makes the function very flexible anyway. The only alternative is to have two functions, "Add to List Before" and "...After", which needs to be enabled depending on the document structure. The behaviour in step 3 in case of bottom of the list, is what I would expect.. also for the top of the list.. The whole CTRL+CLICK 'Add to list' is the advanced feature, IMHO I admit, I'm circling around the area of bug 36220 and bug 140579.. Except there is no 'continue numbering' button.
