Again, time for history, recent and not so recent. The fifth amendment
protects you, at least in theory, from your confession being admissible
if the police obtain it by beating the living shit out of you until you
sign. This protection is not a wacky US invention, it is also found in
British common law. It is a protection every bit as vital to a free
society as habeus corpus.

You are surely more civilized in Canada, but in the US we have a long
and rich history of police-coerced confessions using beatings, rubber
hoses, sleep deprivation, even electric shock. This is what "compelling
you to be a witness against yourself" can look like in practice. It
doesn't just pertain to the witness stand.

As to the purpose of an innocent person using the fifth while on the
stand? There are a variety of reasons why. in the McCarthy hearings of
the 1950s, people were questioned about their political beliefs, which
were not a crime and were nobody's business but their own. They took the
fifth in many cases, and rightly so. Besides it being no business of
McCarthy and his cronies, the information was used to persecute and
harrass. What they were accused of was no crime, but a forthright
answer would have been used to destroy their reputations and their
livelihoods.

And of course, just maybe, while that liquor store was being robbed you
were home f**king the daylights out of your best friend's wife. That's
not a crime, and is in fact exculpatory, but you would probably want to
keep it to yourself.

The original post spoke of how the data on the box would be available
not only in a legal proceeding but also routinely to auto manufacturers
and auto insurance companies.

That, particularly if it is accompanied by any identifying data as to
the driver, is intrusive. How and where I drive, so long as I obey
traffic laws, is nobody's business but my own.

Ironic also that this will be benefiting auto manufacturers and
insurance companies, but they are not footing the bill for this black
box- the individual buying the car is paying for it, whether he/she
wants it or not. Shouldn't the auto companies and insurers be the ones
paying for the *(^#%$ thing if they are the ones realizing the benefit?

The only way that this would not be an invasion of privacy is if the
data is surrendered with the consent of the owner, or if the box is
obtained through legitimate legal means such as a search warrant.

I didn't remember an Artic Cat wankel, but I know Evinrude made one,

If you want a rotary bike that didn't get Guigario'd to death

You have a right to not incriminate yourself precisely because if you
had no such right you would be compelled to incriminate yourself.

Go here-

http://www.crimelibrary.com/notorious_murders/not_guilty/coerced_confessions/5.html

to see what form that may take in practice.

And no, "taking the fifth" is not a tacit admission of guilt, it is a
declination to answer a question when on trial for a criminal offense.
Isn't it quite obvious that one may choose not to answer a question
without being guilty of the crime of which one is accused?

I think many people have a misunderstanding of this aspect of the Fifth
Amendment fostered by a popular misquote-

On the telly, you always here the (guilty) guy say on the stand "I
refuse to answer on the grounds that it may incriminate me." Although
IANAL, I believe that language is unnecessary and prejudicial. The
Fifth amendment states in pertinent part that no person "shall be
compelled in any criminal case to be a witness against himself" - that
just stays that you cannot be compelled to give testimony when you are
the defendant in a criminal trial.

It is the same as the idea behind the 5th amendment of the US
constitution. People have the right to admit guilt, but they should
not be forced or required to incriminate themselves if they choose
not to. Using data logged by the owners car to incriminate them
against their wishes violates what many people feel should be a
fundamental human right to choose not to bear witness against
yourself. I suppose the actual act of logging the data is not a
problem, as long as it can not be disclosed to any 3rd party without
the car owners permission, even if by court order. I actually think
that the data logging could help prevent police from wrongly accusing
drivers of traffic violations, as the exact speed, time, and location
of the vehicle would be logged.

bad, it just isn't as robust as the inline pumps because it is
lubricated by the fuel. It doesn't handle as wide a range of
viscosity, or running the tank empty repeatedly as well as the pump

after sitting all day at about 16 degrees.

I can't tell if the mirrors are autofrosting or not, 'cause the

it had 2" of water in the back footwell mere days ago.

That is definitely true. Drivers are the biggest factors in the driving and
there are plenty of people who don't have a clue about their vehicles other
than "yeah it's got 4wd" and no clue about how the 4wd or awd works and what
effect that will have. So they pretty much just say "yeah I got 4wd so snow
doesn't bother me" with no clue about what kind of tires they have or how
much tread is on them...

Re: [MBZ] autodimming mirrors

2006-11-30 Thread Lee Einer
An immutable reality of the road is that he who goes faster than he can
stop will some day meet with grief.

Here in El Otro Las Vegas we had several inches of snow fall over night.
I was driving on the main drag early this AM, hubs locked, 4wd engaged,
at 20-25 mph. I judged that to be max safe speed. Some clown in a box
van passed me going over the posted speed limit. Idiot. I half expected
to see him down the road either OFF the road or wrapped around a
telephone pole. Didn't happen this time. It will happen some time if the
driver doesn't wise up.

I have no illusions about what my intrepid Isuzu Amigo can do in the
snow. 4WD does help in the snow, but the bottom line is that the rubber
you have on the road is the rubber you have on the road, same traction
whether 2wd or 4wd. 4wd will help you take off and go, it will not help
you stop and it will not do much to help you turn.

My favorite dumbass thing is the SUV owners who think their SUV will go
through a deep flooded wash. You can see them on the news every monsoon
in Phoenix and Tucson- on the roofs of their SUVs, waving to the rescue
helicopter. Note: 4WD does not convert your SUV into a submersible craft.

And then there's this- The biggest SUV on the road for the biggest
morons on the road-

Nokians seem to be more expensive than Blizzaks.
In recent prices I've seen, before shipping, mounting balancing ect, Nokians
cost ~ $100 to $120. Blizzaks seem to be in the $70 to $85 range.

I'll share the following information, with the careat that it is what I
learned 8 years ago and the current line of Blizzaks may now be different.
Blizzaks were snow tires for half their tread life, and summer tires for the
latter half of tread life. I suspected that summer half of the tread life
was probably not a fun, performance tire. So, at that time I bought Nokian
NRW's and used the same set for 6 winters (Dec - Mar). In that sixth
winter, we had a deep snow fall just before Christmas. My 124, with its old
Nokians, was often the only vehicle plowing its way down unopened roads and
streets. So, in my experience, Nokians are effective snow tires right
through 50k+ mi. of tread wear.

Many people like Blizzaks. I have no first hand experience with Blizzaks,
and don't know thier current philosophy about winter effective tread life.

Looks like there might be an audio shop in there? I bought a whole
storage cabinet and a bunch of random boxes full of stuff from a dept
store that had gone out of business, the auction guys did not want to
deal with it as they were selling all the fixtures, etc. The cab was
full of screws, little electronic gizmos, and stuff for installing
stereos, and the boxes had some very good power tools in them, amongst a
lot of other junk (confiscated knives, switchblades, razors, brass
knucks, and dope pipes from shoplifters). Whole deal was $500 a few
years back, I figured I got about $2k worth of stuff, not counting the
collectible weaponry and smoking accessories.

It sure is. Mine is a '71 303cc, Arctic Cat used the Sachs wankel 303 from
'70-'72 and a 295cc higher output from '73-'75. The 303 is about 19hp, the 295
is about 24hp.
Max speed on my 303 seems to be about 50mph although I've still got some clutch
issues to work out that keep me from hitting full speed. The engine is a torque
monster and the sled weighs a ton so it'll pull a big load if I hook it to a
sleigh. Long enough that its relatively comfortable with both my wife and I
riding at the same time.
My website has my '71 and a '72, www.deadsledwrenchers.net check under Arctic
Cat.
Polaris and Johnson/OMC also had rotary powered sled, the Polaris used the 303
and an interesting dual rotor 606, Johnson/OMC used a different (much larger)
motor.
The 2 stroke rotary motors make a really cool sound "brrrup brrrup brrrup".

Blizzaks were originally designed by Metzler, in Germany. They had blue
tread and black sidewalls. When Metzler got out of the PKW tire business,
they sold the Blizzak line to Bridgestone.

I've never bought anything from tirerack because i could always buy locally
for the same or less. There used to be a place called Eurotire in NJ that
I always bought from because they always had better tires and better
prices, even with mounting and balancing added on. Sadly, Eurotire is no
longer around. Being a Dieseller, I have no need for v rated
tires. Tirerack may well be THE place for V rated tires.

Blizzaks may not last 6-7 winters (though my wife's and my parents have
lasted that long). It depends on how warm and dry and how many miles you
put on. They're also only the "good tread" for the first 55%, but if your
tires are worn down that much then they're not going to be near as good in
the snow anyway...

Oh a wise guy? Why I oughta...

I'll stand by my statement, with snowtires on in the winter if I can't go
somewhere with my 190D I've got no business being out. That was DOUBLY true
with the 240D, that car was outstanding in the snow.
I have driven a Subaru in the snow, good cars, nicely balanced, nicely geared.
In my experience people drive them like nuts...

In your example if theres a coating of ice over everything I again stick by my
statement that most people have no business being out. Okay, if you're wife is
in labor you've got to go out but an ice storm says to me "no unneeded travel"
a trip to the store because we're out of milk can wait a day. Sure, I can
probably make it but what about the guy in the Caddy on bald tires thats sure
the traction control will allow him to make it? I'm not so worried that my car
won't carry me I'm expecting some other idiot will plow me off the road...

Maybe thats why I'm such a safe motorcycle rider, I expect that all the other
drivers are out to get me and take precautions against it.

That's what the FSM would lead you to believe. In putting together my
240D/3.0, however, I have a 617.912-12 engine (originally assembled with
an automatic transmission) and a 617 manual flywheel (gotten from a
123.130 whose 617.912-10 had punched the connecting rod for #1 through the
block). The machine shop messed up the original balance of the flywheel,
so they rebalanced it by itself.

I slapped the two together and they've been working fine for the last
50,000 miles or so.

[MBZ] For Sale: 14" Mercedes Rim (15 hole) .

Near flawless 14" Mercedes Rim (15 hole). This was my spare and was only
used a couple times.
It is great to mount a snow tire on and the other one on your spare. Easy to
switch tires
In bad weather and back to regular tires in good weather. Or, as I did, put
chains on my two spares.
Its easer to change tires that to put chains on. Check on what a new one
costs. I'm asking $65

Re: [MBZ] snow tires

2006-11-30 Thread Loren Faeth
I can actually buy Blizzaks from a dealer just about anyplace i go. Cell
phone tires, I'd have to drive at least 1500 miles to get them, or mail
order them and that gets expensive. Pay more for a tire, pay $$$ for
shipping, and then pay extra for mounting and balancing. Easily adds $25
to $50 a tire.

Several years ago I bought some firestone radial snow tires for the
240D. after 6-7 winters, they are still good enough to use this winter. I
have been quite pleased with them. A LOT less money than cell phone tires.

This is also true. But you see, the guy with the model has figured a
way around that problem and realizes that the Ferrari is a status symbol
rather than something practical to drive. He saves alot on tickets and

Re: [MBZ] autodimming mirrors

2006-11-30 Thread Levi Smith

It is true that no one really "needs" 4wd.

HOWEVER...

Saying that if you can't get there in your 190D then it's not safe for
anyone no matter what is NOT.

Anytime you'd like to test your 190D against my 97' Suby with Blizzaks and
see who has more control in slippery stuff (including stopping but NOT due
to AWD) I will be more than happy to oblige.

That said, obviously the biggest factors to do with safety depend on the
drivers.

Personally I'm waiting to see some snow and cold at which point I'll throw
some Blizzaks on the Benz and see how it does. But IF I do decide to drive
it in the winter I WON'T be taking it on long trips into lake effect areas,
and I will be planning on a high chance of having to call for a ride/tow and
just plain having to drive MUCH slower on any slippery days.
I have YET to come upon ANY day with the Sube when I look out and say "I'm
not sure we'll make it". If it's REALLY bad out, then I might have to slow
down a bit. On the REALLY REALLY bad days, if everything is an absolute
sheet of ice (like you can barely walk to the car) then you have to drive
really slowly and carefully. IF we ever had like 16 inches of snow or more
on the road then it might become difficult since the snow tend to blow over
the front of the car...

I won't speak for other AWD/4WD vehicles because they can all handle
differently, but my point is basically that if you haven't driven my Sube in
the winter then you don't have a clue how it handles. And if you're only
driving a 190D (with no mention of snow tires) then you have absolutely no
clue of the possibilities of a REAL vehicle in the snow.

Levi
Yeah, I get worked up about traction. (:

On 11/30/06, Curt Raymond <[EMAIL PROTECTED]> wrote:

Uhhh, the '98 probably has narrower tires, then combine that with more
control in the manual trans and a smaller engine, of course its better in
the snow...

I'm still of the opinion that few people "need" a four wheel drive in the
snow and ice. However these days it seems like most people don't know the
difference between needs and wants. If its bad enough out that I can't get
somewhere in my 190D I shouldn't be out on the streets because its not safe
no matter what. All vehicles only have four wheel stop...

Of course if its really bad here I'll just take a snowmobile. My '71
Arctic Cat 303 rotary powered snowmobile will go lots of places a jacked up
4x4 won't...

can probably talk you into putting the diesel Benz in the garage for the
winter and driving a jacked up 4X4. We now have 3 of them. 2 Ford F150s
and an old Toyota 4Runner. I'm too poor to contemplate a late model gasser
4Matic but I won't do without 4 wheel drive in the winter
anymore. Interesting how different the ones we have are. We have a 98 F150
reg cab shortbox 4X4 with a V6 and manual 5 speed as well as an 02 F150
Supercrew 4X4 with a 5.4 and an AT. I would have expected the 02 to be
better in snow (at least around town on the streets) as it is longer and
heavier but it definitely is not. I am guessing it is essentially the
difference in tires. The Supercrew has less aggessive tire tread and I am
thinking that must be making the difference in traction in the snow. Randy

There are several types of Blizzaks - check TireRack for your desired type -
for my 91 300D in 195/65R15 the Revo1 Studless Ice & Snow are $79 each.
They rec'd very high marks from people who bought them, BTW.

So they;re not outrageous IMO - ~$320 for a set then add mounting,

Though this time of year would be the wrong time to go to your local tire
store and try and find some... For that matter sometimes Tire rack runs out
of a certain size around now as well...

Uhhh, the '98 probably has narrower tires, then combine that with more

the snow...

I'm still of the opinion that few people "need" a four wheel drive in the
snow and ice. However these days it seems like most people don't know the
difference between needs and wants. If its bad enough out that I can't get
somewhere in my 190D I shouldn't be out on the streets because its not

in tires. The Supercrew has less aggessive tire tread and I am thinking
that must be making the difference in traction in the snow. Randy

While we are on the subject of non-MB diesel. Anyone have any

I thought Mazda had that pretty much licked by the time the RX3 came
out. IIRC, that had an expected life of around 100k when 60k was
considered good for a set of piston rings on an American car.

I got the flywheel from a 1980 123.130 with a 617.912 and a stick shift
from the factory. The number I listed is the one it's marked with. The
other number (for a 240D) is from a 1982 240D with a 5-speed (whose
5-speed was already taken).

No, they are not the same. The 300D manual flywheel is heavier than the
240D manual flywheel. My previous email (to which no one has replied) has
the part numbers of both.

Re: [MBZ] autodimming mirrors

2006-11-30 Thread Jim Cathey

Gump has auto frosting mirrors in the cold and she also chose not to
start with BioD in the tank at 16*F

The Frankenheap started just fine this morning at about 8 degrees
on #2. Did plug in the block heater though. Started fine at work
after sitting all day at about 16 degrees.

I can't tell if the mirrors are autofrosting or not, 'cause the
windows for sure _are_! The car was very damp from all the rain,
it had 2" of water in the back footwell mere days ago.

I had a set of Blizzaks on wheels for my W202 which I sold since those
wheels
can't be used on the W203. I now have a set of Nokian WRs on new car
takeoff
wheels for my C320 and I think they are better. Particularly since
they are

not squirrely on dry pavement like the Blizzaks were.

The studded Hakka 1's that I put on our SDL and the 450 SL worked
_great_! Still using 'em, though the SL's tires have migrated to
the 200D winter beater.

They're getting a little bit aged, about six years, but they're
still working fine. I don't think they handle badly on dry pavement
either.

That and a bit of weight in the trunk if you need it and you're set.
I had 200# in the SL. Last year the Frankenheap's trunk was filled
with spare parts, this year it's empty. Might have to go for the
sand again, we'll see.

The Chicken Wagon came with a set of Alpinas on it, but it hasn't
gotten much use in the snow, especially lately.
