the fix for the alertafter timer broke upalerts in 0.99.3-35 :(

No, I didn't got any message for upalert. 

The option -u will be already supplied to an alert program by mon itself if it
is being called as an upalert.

Unless the method of calling changed since the last stable version, you
should actually be calling mail.alert with a "-u" to send up alerts. The
way you are calling it now I would kind of expect you to get two alerts -
one for the failure and one for the restore. Have you seen two messages?
