These issues about patents could be said about every piece of software out
there.

You should not underestimate the importance of this issue as it is one
of the *few* arguments that Mono/.NET opponents bring up against that
technology at every occasion, just look in diverse forums and blogs. But
more important, it might keep off companies from using Mono.

Therefore I suggest that the licensing FAQ should be updated by adding a
solid statement about that issue.
In my opinion, the two important points are:

(1) the .NET API patent contains (some) prior art (at least regarding
the Base Library). Just compare the API with the Java Library, for
example. Therefore it is likely that it is not (fully) enforcable, even
it has been grated to MS by the USPTO.

(2) *(almost) every* software is affected by a lots of other patents,
e.g. the data structure to XML mapping patent of MS. Therefore it makes
virtually no difference if you use C,C++,Java,PHP or C#/Mono.

A much better solution would be to publish the results of Novell's
patent review that Miguel mentioned one year ago. Having such a
statement in the FAQ, I'm sure the patent question is then resolved for
most people and companies.

This kind of thread seems to pop up quarterly or semiannually. I long for a
mono-fud or mono-patents or some such mailing list to keep this from
cluttering the main list.

Therefore my conclusion is that any serious .NET application

actually provides. However nobody seems to care about that
fine detail and believe that when the CLI can be used for
free, (at least) the Mono Stack is safe which is (*in my
opinion*) not the case.

Of course you can use it for free, since the whole mono class
library is MIT-licensed. That's the only licence you're bound
to.

It's really useless to talk about patents. It's even unclear
whether MSFT owns (or has licenced from the respective owners)
all patents for the BCL.

It's unclear if, for example /me doesn't own a patent
on Object.GetHashCode() because I've used it in the very
late 60s to compute a way out of my mother's body.
A prenatal half-cognitive prior act.

On the FAQ: which country shell the FAQ be written for?
USA? EU? India? For all countries? That's not what I
expect from the Mono team or their layers. I expect (1) a good
and free BCL. Everything beyond that is "real world": you
can get issued by everybody for everything.

Your expectations are too high: you want a "sleep awell"
license from the team.

Educate yourself a little further:

And for the rest, I dare YOU to come up with a better platform than C#

be dying to switch. Don't forget to include something resembling
ASP.NET, ADO.NET, Gtk#, System.Xml, and so on...Also, be aware of not getting into ANY software patent over there on the process, so I can rest in peace at night.

Do yourself a favor and be nicer too, for a change.

I'm pretty sure you're not living in the US, so why are you whining
like an idiot? The European Union (where you will someday belong
to ;-) doesn't give a shit on software patents.
Stand up and scream at you corrupt politicians, if you
have a problem with patents.

One thing I don't understand is where the heck all this hostility comes from. He could have started a simple argument/discussion about the legal implications of the M$/Mono relationship. Instead he decided to basically flame the Mono devs and users using some over-the-top language trying to imply the everybody is trying to destroy the "Purity" of Linux. Seems to me like a person the would say that Linux should have remained without a Graphical Interface because it spoils the purity of the OS or smt.

It's true patents mean jack-shit nowadays in the EU, but nobody knows what will happen next. We all hope that even after we join the EU (hopefully sooner rather than later) things will stay the same in this respect, but companies are lobbying for the introduction of software patents and maybe at some point they'll control enough "corrupt politicians" to have their way. God help us if and when that happens.

Anyway, this discussion seems pointless to me at this point, especially since the introduction was a total fiasco, so I think it shouldn't move beyond this point. I don't exactly know what the policy for this list is regarding profanity, so I refrain from telling him a thing or two in his native language (frankly, a language that is much better for swearing that english ever was) and will leave it at that.

Keep up the good work.

Hi Alexandu,

Before calling me a troll that spreads FUD, first read the wikipedia definition:

As you saw already, I have good reasons and proofs for my statements
(it's fucking obvious).
It's your turn. Please provide evidence that the ECMA/ISO parts are
"royalty free" (legal this time) and dump the non-ECMA stacks and then
I will bow to you. Also, if such evidence exist please update that
stupid FAQ (it is useless in it's current state).

So again, FUCK YOU for trying to poison Linux (or Gnome for that
matter). Please remember you don't own it. And ... don't worry about
