Ran into an interesting twist on "presence" in a state. One client went to a trade show in Nevada. She was informed that for the next quarter she would have to consider herself "in" Nevada, even though she did not sell anyting at the show. I don't think she is going back. Most of my clients get around this problem by incorperating the web side of the business under a different name. Also some states, like California, base their sales taxes for mail-order on the recipients postal code, not the vendors, unless the codes are the same. There are eight or nine different sales tax rates in CA depending on local taxes.
