I am now getting more and more people complaining about this date-picker 
problem.  It seems to be limited to the HTC (hacked?) version of WM 6.5.

I am starting to have to offer refunds and I guess eventually will have to 
declare HTC phones a no-go area for my programs.

Any chance of a fix ?

We haven't been able to reproduce the problem here. As you mention, it
is also not clear that this happens in all devices, or just hacked ones.

The only alternative would seem to be to create a control of your own.
It probably would not look like the old date picker, but it should be
possible to build one fairly easily. For example, you could use 3
listboxes, for month, day and year.
