I worked for a company that got penalized for making everyone a salaried employee - the gov't didn't like that. At the time, the ruling was only management could be salaried, so if you didn't manage anyone, you had to be hourly. I've also heard that for some reason IT people also get to be classified as salaried, but things may have changed.
