on this ongoing issue at Jamaica Bay Wildlife Refuge, Queens Co. (N.Y.

Please correct if incorrect, but there is a relatively recent  
agreement with the City of New York's Parks Dept., that does not  
appear to transfer any management/decision-making back to the city**   
These issues likely need to be addressed most to, & by, the top  
administrators at Gateway National Recreation Area (Ms. Jennifer  
Nersesian is the head administrator there) and possibly on up the  
chain to the Washington DC offices of the National Parks Service.  The  
city of New York once owned and managed Jamaica Bay Wildlife Refuge,  
and (I believe) the laws that were applicable to its management were  
different from those that apply now. For what it may be worth, and it  
is important to understand to those who do not see a difference, the  
management of the Jamaica Bay "Refuge" is under the purvey of a  
National Recreation Area, with an emphasis on the word:  
"Recreation"... hardly my preference nor that of anyone I know in the  
naturalist community who have visited Jamaica Bay Wildlife Refuge, it  
has had a lot of consequences to how things are managed there,  
particularly in recent times.  I would emphasize that as of now, the  
people Andrew Baksh has suggested we contact, as well as the ideas put  
forth by John Askildsen, be considered in earnest.  It will only  
happen if enough of us make our voices heard to those who administrate  
and who are meant to serve the public, we the people...

Again, Ms. Nersesian is the head administrator of Gateway National  
Recreation Area.   I would also tend to agree with at least most if  
not all of what John Askildsen posted, in part in response to Susan  
Herbst's prior post, in that there will be more action taken in favor  
of bird &/or habitat protection when pressure is applied and in part,  
in addition to actual letters to elected representative (a physical,  
paper & ink letter, sent in the old USPS system, is considered to have  
the most impact of all ways of contacting a representative or an  
official, or for that matter anyone in a public position even in our  
age of mobile media. A phone call is also good, and an email is also  
good. Adding one's name to a petition can be useful but individual,  
personal input to one's elected officials and other public servants  
are likely to make a stronger impression overall.)  Another thought is  
that writers / editors for local newspapers and magazines, producers &  
others with TV & radio programs, & web site managers might be  
contacted along with your local or regional birding or environmental  
group. (If a negatively-inclined piece appeared in, let's say, the NY  
Times, you can be sure that folks behind desks at the National Parks  
Service will quickly be made aware of that, and they will also be  
aware if they receive praise in public for work well-done, when such  
takes place, that is!) Also, being respectful and informed is a given  
with feedback to any public official for there to be a chance for a  
positive response.

Some of the additional ideas on volunteerism are of interest and could  
potentially be of worth, but an issue that must be dealt with are  
those in charge of management at the Refuge (or any other public lands  
locations & issues). The area in discussion must be seen as in need of  
work, & that work is in need of being done prior to now. We won't get  
a volunteer effort going (on the projects at issue here) without the  
approval of top management; their opinion & decisions can be affected  
in part by our input.

I just found out that the "Young Birders Club" had a scheduled trip to the East 
Pond this weekend. Guess they could cancel or switch to kayaking? Maybe a 
bucket brigade...teach the young uns the privilege of shorebirding does not 
come easy.

All of this made known to the relevant authorities in NPS will apply the much 
needed pressure to get the East Pond issue resolved.

[nysbirds-l] Manhattan Ravens

The West Side Ravens have been in the West 40s the last few days.  Right now in 
Gotham West 43/11th, yesterday on the USS Intrepid.  Only 3 birds though, 
thought they fledged more young.

Road.     7/12: 235 LESSER YELLOWLEGS, 30 GREATER YELLOWLEGS, 7 SOLITARY 
SANDPIPERS 1 SPOTTED SANDPIPER, 2 KILLDEER and PEEP were all seen in 
Knox-Marsellus from Towpath Road.     7/13: 2 STILT SANDPIPERS, 6 SHORT-BILLED 
DOWITCHERS, LEAST SANDPIPERS,  SEMI-PALMATED SANDPIPERS,  GREATER and LESSER 
YELLOWLEGS, 4 SOLITARY SANDPIPERS and 16 GREAT EGRETS were seen in 
Knox-Marsellus Marsh.

Oswego County
     7/8: A CLAY-COLORED SPARROW was heard briefly in Constantia.     7/10: 2

JBWR, birds or birders. in my opinion, They care about active recreation where 
there is probably big grant money available, which offers more job security for 
NPS/Gateway staff. I would imagine that there is little job security in making 
shorebirds happy.

I realize I am a complete lurker to this subject and only a very 
sporadic visitor to Jamaica Bay WF.
It seems to me that perhaps this should be approached in a different 
way. 
Perhaps various Audubon societies and birding associations in the area 
should organize, find sponsors and volunteer the time and workforce to 
get this stuff done.
It seems to me a lot of time is spent there by birders anyway, that the 
complaints have gone on for years, and that the NWR system is 
overburdened and underfunded. It seems to me that in this day and age, 
that's how restorations and upkeep gets done in historic buildings and 
parks.
It's just a thought.

Jamaica Bay has three artificial water features. They *had* been 
excellent for birding.


1. A tiny artificial pond in the gardens with a leaky pond liner and a 
water supply that was shut off due to a leaky pipe. The liner has not 
been repaired or replaced, and the leaking pipe has not been repaired.


2. The west pond which was breached in 2012 by Hurricane Sandy. The 
breach has not been repaired.


3. The east pond with a nonfunctional valve system preventing draining 
of the water. The valve has not been replaced.


While these features have been ignored for years, they have been 
building platforms and fences.


"Wildlife refuge?"  yeah, right. It's time we all called out the NPS on 
their neglect of JB.

Hi Ardith and fellow NY birders,
A pair of Harriers at Jones Beach is nowadays a good find, but they
bred regularly on the south shore marshes not long ago. We had a pair
regularly just east of Gilgo Beach up to the 1980s, and we used to watch
the male drop a mouse to the female who rose up from where we assumed the
nest must be. They ought to breed still in Tobay, now that there is hardly
any human traffic there, but this is very late for an active nest unless an
earlier brood was destroyed.
Now find a Short-eared Owl - they bred at Tobay up to the 1970s at
least.

the East Pond, so I thought a visit and update was in order.

On this 4th of July, I visited the East Pond this morning to take a water level 
read and to get a sense of where the pond level is at. As I suspected, the 
recent rainfall has not helped compounded with drainage which is slow, the 
water level remains IMO, too high for this date.

Reports out of Canada already show shorebirds staging on the prairies and Isaac 
Grant who is in Virginia reported to me today that surveyors out there have all 
ready seen multiple Wilson's Phalaropes and Stilt Sandpipers among the several 
shorebirds reported out there.

With a West Pond basically out of commission, it is critical that the East 
Pond, is ready for migrating shorebirds who need a place to refuel and rest. At 
the current drainage I don't see this pond getting anywhere near the levels we 
need to be within the next few weeks as we have ZERO flat exposure on the South 
End which where we start seeing mudflats first.

I suggest to start calling these numbers to let NPS officials know how 
concerned you are about the East Pond water level.

was never replaced--not sure where you got that from.

Jones Beach Phalarope location clarification Re: [nysbirds-l] Red Phalarope, JBWE, YES

Hello,
Just to clarify the phalarope is located at Jones Beach West End (JBWE -- 
Nassau County) NOT Jamaica Bay wildlife refuge (JBWR Queens County). 
These near identical acronyms looked like they might pose a problem for some. 
Hope this helps avoid navigation errors and wasted days-offs in search of this 
beautiful bird!

pond early this year after problems last year, but that there has been too much

Still feeding at 2nd pond when I arrived at 11:15am, observed with Brooklyn 
birders Cathy and Karen. Flew to 1st pond (nearest to Nature Center) around 
noon, where it sat at the far end and, after 30 minutes, flew left, possibly 
into the phragmites area. Birders are at the location now, waiting for the 
phalarope to re-appear.

critical that the East Pond, is ready for migrating
shorebirds who need a place to refuel and rest. At the
current drainage I don't see this pond getting
anywhere near the levels we need to be within the next
few weeks as we have ZERO flat exposure on the South End
which where we start seeing mudflats first.

  NPS officials know how concerned you are about

I am glad Shai visited the East Pond and saw what I have been raising
awareness about for the past few weeks. We CANNOT...we MUST not give up
people, keep those e-mails and phone calls into NPS, we must convince them
that they have to take appropriate action to try and salvage this shorebird
season. I have no intention of giving up although a break for some northern
birding sounds good!

I shudder to think those juvenile shorebirds not being able to imprint the
East Pond into their migration route--we had that happen in 2011. See a

I also visited the East Pond this morning with the same hopes as Shai.
Only, I went to the South End where the pond layout, is such that end is
the first to start showing flats. I could see that the water level is lower
but NO flats! There is some shoreline developing across from the Big John's
Overlook where I saw one Lesser Yellow Legs, but that is it!

I remain hopeful that weather and just maybe an NPS fix however short term
would save the season. I even suggested to them this morning that they
could remove the outflow flap all together and let the pond flow for awhile
to get caught up in terms of the water level draw down. That requires some
extra maintenance but it could be done. It would also give them a good idea
on what the the problem is, whether blockage vs leakage etc.

Mute Swans appear to be doing well though, I counted 127.

After hanging around for 2 hours and missing the bird yesterday morning, I 
deserted my wife for breakfast today to try again.  This time it paid off, as 
the bird was there  and was close to the edge of the pond west of the bird

 Neotropic based on size/proportions alone, but of course it would be nice to

 the bird re-located to any of the other (closer) breakwalls, it should be

 recommend if anyone has use of a canoe, kayak, or boat that it would be more 
 than worth trying to get out there and document (photograph) the bird if you

 This evening around 7:15 pm, Dean DiTomasso and I watched a probable adult 
 Neotropic Cormorant sitting with about 475 Double-crested Cormorants on the 
 outermost breakwall in Buffalo Harbor as viewed from the tower at Erie Basin 
 Marina. The very small size is extremely distinctive, but that being said 
 there are smaller Double-crested Cormorants out there, while the effects of 
 position and lighting on sitting birds (due to uneveness in the breakwall 
 surface) can cause some Double-cresteds to look quite small at times. We had 
 the bird sitting up and preening somewhat off on its own initially, but later 
 next to a DCCO that flew in and landed near it. I also saw the bird briefly 
 in-flight and re-locating to another portion of the breakwall after the they 
 were flushed by a boat. It was present up until dark and evidently was 
 roosting on the breakwall with the group of Double-crested's and various 
 gulls and terns.
 
 The light there is best in the early morning and the best viewing of the 
 breakwalls is from the tower at Erie Basin Marina, but decent views of the 
 same outermost breakwall can be had from the hill at the end of Wilkeson 
 Point Park along Fuhrmann Blvd (in the outer harbor south of Erie Basin). If 
 the bird re-located to any of the other (closer) breakwalls, it should be 
 identifiable with 100% certainty through a scope, but I would obviously 
 recommend if anyone has use of a canoe, kayak, or boat that it would be more 
 than worth trying to get out there and document (photograph) the bird if you 
 are willing to do so.

The ranger I just spoke to at the refuge claims that they started draining the 
pond early this year after problems last year, but that there has been too much 
rain. He also says that at this point there's nothing they can do to get it 
lower any faster.

Several people have recently contacted me about the water level situation 
on the East Pond, so I thought a visit and update was in order. 
  On this 4th of July, I visited the East Pond this morning to take a water 
level read and to get a sense of where the pond level is at. As I suspected, 
the recent rainfall has not helped compounded with drainage which is slow, the 
water level remains IMO, too high for this date. 
  Reports out of Canada already show shorebirds staging on the prairies and 
Isaac Grant who is in Virginia reported to me today that surveyors out there 
have all ready seen multiple Wilson's Phalaropes and Stilt Sandpipers among the 
several shorebirds reported out there. 
  With a West Pond basically out of commission, it is critical that the East 
Pond, is ready for migrating shorebirds who need a place to refuel and rest. At 
the current drainage I don't see this pond getting anywhere near the levels we 
need to be within the next few weeks as we have ZERO flat exposure on the South 
End which where we start seeing mudflats first. 
  I suggest to start calling these numbers to let  NPS officials know how 
concerned you are about the East Pond water level.

information but I can't guarantee anything will come of it. it) 
  Alternatively, you could contact Dave Taft: 718-338-3625 or Jennifer

Hi Ardith and fellow NY birders,
A pair of Harriers at Jones Beach is nowadays a good find, but they
bred regularly on the south shore marshes not long ago. We had a pair
regularly just east of Gilgo Beach up to the 1980s, and we used to watch
the male drop a mouse to the female who rose up from where we assumed the
nest must be. They ought to breed still in Tobay, now that there is hardly
any human traffic there, but this is very late for an active nest unless an
earlier brood was destroyed.
Now find a Short-eared Owl - they bred at Tobay up to the 1970s at
least.

 exposure on the South End which where we start seeing mudflats first.
 
 I suggest to start calling these numbers to let NPS officials know how 
 concerned you are about the East Pond water level.

Can you elaborate on this problem a bit more?

I was under the impression that with the east pond's valve having
been replaced the water level problem could be mitigated and that
NPS staff should be attending to the task of lowering the water
level as presumably they are supposed to do.

What is the problem? Are they simply not doing their job?

Just to clarify the phalarope is located at Jones Beach West End (JBWE -- 
Nassau County) NOT Jamaica Bay wildlife refuge (JBWR Queens County). 
These near identical acronyms looked like they might pose a problem for some. 
Hope this helps avoid navigation errors and wasted days-offs in search of this 
beautiful bird!

I suggest you read the e-mails I have been posting about the issue. The valve 
was never replaced--not sure where you got that from.

I am glad Shai visited the East Pond and saw what I have been raising
awareness about for the past few weeks. We CANNOT...we MUST not give up
people, keep those e-mails and phone calls into NPS, we must convince them
that they have to take appropriate action to try and salvage this shorebird
season. I have no intention of giving up although a break for some northern
birding sounds good!

I shudder to think those juvenile shorebirds not being able to imprint the
East Pond into their migration route--we had that happen in 2011. See a

I also visited the East Pond this morning with the same hopes as Shai.
Only, I went to the South End where the pond layout, is such that end is
the first to start showing flats. I could see that the water level is lower
but NO flats! There is some shoreline developing across from the Big John's
Overlook where I saw one Lesser Yellow Legs, but that is it!

I remain hopeful that weather and just maybe an NPS fix however short term
would save the season. I even suggested to them this morning that they
could remove the outflow flap all together and let the pond flow for awhile
to get caught up in terms of the water level draw down. That requires some
extra maintenance but it could be done. It would also give them a good idea
on what the the problem is, whether blockage vs leakage etc.

Mute Swans appear to be doing well though, I counted 127.

The ranger I just spoke to at the refuge claims that they started draining
the pond early this year after problems last year, but that there has been
too much rain. He also says that at this point there's nothing they can do
to get it lower any faster.

Still feeding at 2nd pond when I arrived at 11:15am, observed with Brooklyn 
birders Cathy and Karen. Flew to 1st pond (nearest to Nature Center) around 
noon, where it sat at the far end and, after 30 minutes, flew left, possibly 
into the phragmites area. Birders are at the location now, waiting for the 
phalarope to re-appear.

[nysbirds-l] JBWR East Pond Water Levels

a good thought on your part. unless andrew backsh can say otherwise with his 
knowledge of the inner workings of the national park service, in my view the 
problem is that
in this day and age, the issues of liabilities and lawsuits would very likely 
prevent any volunteer from working on levees and release valves, not to mention 
federal union rules about workforce mgmt concerns. 


unfortunately, from my past experience, the only way to solve the problem is 
through organized public pressure. the biggest achilles heal for public 
officials is public opinion. if the public is mad enough to raise enough 
commotion with congressional representatives in both sides of the house, things 
will change. until then, birders concerns fall on deaf ears. the jamaica bay 
coalition should not disband after the west pond issue is resolved, but 
strengthen and follow through to make sure that the JBWR is funded, managed and 
staffed to meet the needs of the refuge ecosystem, wildlife and its usership. 


until we take that approach, we will be standing up to our knees in east pond  
'gook'. in  recent years, i have been in favor of transferring JBWR to the NWR 
system, and taking out of the hands of the NPS, who seem to care not for 
managing for wildlife, but only for skateboard parks, bicycle paths and 
ballfields. i don't think that top management in NPS Gateway really cares about 
JBWR, birds or birders. in my opinion, They care about active recreation where 
there is probably big grant money available, which offers more job security for 
NPS/Gateway staff. I would imagine that there is little job security in making 
shorebirds happy.

All,

Jamaica Bay has three artificial water features. They *had* been 
excellent for birding.


1. A tiny artificial pond in the gardens with a leaky pond liner and a 
water supply that was shut off due to a leaky pipe. The liner has not 
been repaired or replaced, and the leaking pipe has not been repaired.


2. The west pond which was breached in 2012 by Hurricane Sandy. The 
breach has not been repaired.


3. The east pond with a nonfunctional valve system preventing draining 
of the water. The valve has not been replaced.


While these features have been ignored for years, they have been 
building platforms and fences.


Wildlife refuge?  yeah, right. It's time we all called out the NPS on 
their neglect of JB.

I realize I am a complete lurker to this subject and only a very 
sporadic visitor to Jamaica Bay WF.
It seems to me that perhaps this should be approached in a different 
way. 
Perhaps various Audubon societies and birding associations in the area 
should organize, find sponsors and volunteer the time and workforce to 
get this stuff done.
It seems to me a lot of time is spent there by birders anyway, that the 
complaints have gone on for years, and that the NWR system is 
overburdened and underfunded. It seems to me that in this day and age, 
that's how restorations and upkeep gets done in historic buildings and 
parks.
It's just a thought.

on this ongoing issue at Jamaica Bay Wildlife Refuge, Queens Co. (N.Y.

Please correct if incorrect, but there is a relatively recent  
agreement with the City of New York's Parks Dept., that does not  
appear to transfer any management/decision-making back to the city**   
These issues likely need to be addressed most to,  by, the top  
administrators at Gateway National Recreation Area (Ms. Jennifer  
Nersesian is the head administrator there) and possibly on up the  
chain to the Washington DC offices of the National Parks Service.  The  
city of New York once owned and managed Jamaica Bay Wildlife Refuge,  
and (I believe) the laws that were applicable to its management were  
different from those that apply now. For what it may be worth, and it  
is important to understand to those who do not see a difference, the  
management of the Jamaica Bay Refuge is under the purvey of a  
National Recreation Area, with an emphasis on the word:  
Recreation... hardly my preference nor that of anyone I know in the  
naturalist community who have visited Jamaica Bay Wildlife Refuge, it  
has had a lot of consequences to how things are managed there,  
particularly in recent times.  I would emphasize that as of now, the  
people Andrew Baksh has suggested we contact, as well as the ideas put  
forth by John Askildsen, be considered in earnest.  It will only  
happen if enough of us make our voices heard to those who administrate  
and who are meant to serve the public, we the people...

Again, Ms. Nersesian is the head administrator of Gateway National  
Recreation Area.   I would also tend to agree with at least most if  
not all of what John Askildsen posted, in part in response to Susan  
Herbst's prior post, in that there will be more action taken in favor  
of bird /or habitat protection when pressure is applied and in part,  
in addition to actual letters to elected representative (a physical,  
paper  ink letter, sent in the old USPS system, is considered to have  
the most impact of all ways of contacting a representative or an  
official, or for that matter anyone in a public position even in our  
age of mobile media. A phone call is also good, and an email is also  
good. Adding one's name to a petition can be useful but individual,  
personal input to one's elected officials and other public servants  
are likely to make a stronger impression overall.)  Another thought is  
that writers / editors for local newspapers and magazines, producers   
others with TV  radio programs,  web site managers might be  
contacted along with your local or regional birding or environmental  
group. (If a negatively-inclined piece appeared in, let's say, the NY  
Times, you can be sure that folks behind desks at the National Parks  
Service will quickly be made aware of that, and they will also be  
aware if they receive praise in public for work well-done, when such  
takes place, that is!) Also, being respectful and informed is a given  
with feedback to any public official for there to be a chance for a  
positive response.

Some of the additional ideas on volunteerism are of interest and could  
potentially be of worth, but an issue that must be dealt with are  
those in charge of management at the Refuge (or any other public lands  
locations  issues). The area in discussion must be seen as in need of  
work,  that work is in need of being done prior to now. We won't get  
a volunteer effort going (on the projects at issue here) without the  
approval of top management; their opinion  decisions can be affected  
in part by our input.

I just found out that the Young Birders Club had a scheduled trip to the East 
Pond this weekend. Guess they could cancel or switch to kayaking? Maybe a 
bucket brigade...teach the young uns the privilege of shorebirding does not 
come easy.

All of this made known to the relevant authorities in NPS will apply the much 
needed pressure to get the East Pond issue resolved.

 It seems to me a lot of time is spent there by birders anyway, that the 
 complaints have gone on for years, and that the NWR system is 
 overburdened and underfunded. It seems to me that in this day and age, 
 that's how restorations and upkeep gets done in historic buildings and 
 parks.
 It's just a thought.
