Are you planning on making the software commercial?  If not, may I 
suggest making it open source?  I know that programming by committee 
can really slow things down and cause feature creep, but maybe after 
you've finished the initial release you could open it up to the 
community.  That way you could get some serious muscle behind it.  An 
open source list manager may be pretty useful.

Once I have all the pieces in place, I plan on making it open source. I 
don't want to get involved with programming by committee until it's time 
to tweak and improve the basics.

My current plan is to release it as open source shareware on the honor 
system. Terms of use will explicity prohibit use for sending unsolicited 
messages. Will probably allow any nonprofit or personal management of a 
single mailing list for free. Commercial users and those with multiple 
lists will probably be requested to pay $5/year per mailing list.

At this point, it looks like we'll mostly be using PHP and MySQL.

No. It will probably be the first line of the message, something like:

PowerBook List Message #12345, part of digest #8765.

This should help keep feed and digest mode subscribers on the same page, 
too.

You'll likely have to be flexible on this for a while.  I'd suggest it might
be more useful to limit how many times one can post in a particular thread.

In principle this is a good idea, to prevent lengthy, runaway OT
discussions, but sometimes when folks are helping a newbie troubleshoot,
there can be a lot of give  take.

We've had problems on some lists with one person becoming very dominant.

three, but it could go as high as maybe 20-25% of all postings in the

In any event, it may be a good idea to have a month or so of 'warnings' when
this first gets implemented.  Instead of rejecting the posts outright, for
some period of time, just send an e-mail telling the person that they are
now X over the proposed daily limit.

We'll have the best error messages ever. :-)

It's going to be big, but we can build it one piece at a time.
