 This is still a problem, but I can confirm that this style does seem to work:   
 

 
 
confine :os do |os| 
 
 
os['family'] == 'RedHat' 
 
 
end

 This is pretty important functionality to be missing from such a basic and frequently used resource like file. I can't think of many environments where folks would want file and directory modes to be the same. Usually a directory needs to be executable (not always) and files in that directory need to be readable but not necessarily executable.
