[recoznet2] VCE Legal Studies

1999-07-19 Thread Liam

hi all,

I was hoping you could help me, I am doing yr11 VCE Legal Studies at Emmaus
College. As part of a recent work requirement we were asked to choose one of
a number of case studies and then work out a possible solution for the
person involved.
The case I chose was about a 24 year old Aboriginal man, Stephen Bonner, who
decided to go to a nightclub with a friend, Keri James, when they arrived at
the nightclub, the arrendent told them the club is full.

They decided to go elsie where, when they were walking away they saw the
attendent allow a group of people gain entry. They decided to go back to
question the attendant about this, the attendant said the club was booked
out and they may as well leave if they don't have a reservation.

While Stehpen spoke to the attendant, Keri looked in the club doors and
there seemed to be plenty of tables free without reservation signs on them.
Keri refused to leave and tried to enter the club. He and the attendant got
into a fight. Stephen asked to see the manager but was pushed out of the way
byanother club worker. The police came and asked both the men to leave, keri
struck out at police and as a result the police hit Keri with their batons a
number of times. Keri fell to the ground. Both men were arrested with being
drunk and disorderly in a public place and for unlawfully assaulting a
police officer.

Where are possible places Stephen and Keri could go for help?
How could Stephen and Keri deal with the problem?
Will lack of time or money be an issue?
What law/s apply to this?
What are Stephen and Keri's rights?
What would be the broad area of law here?
How will the Anti Discrimination List/Ombudsman deal with this issue?
What would be a possible outcome of any action taken?

I do appreciate any and all information and time you could give me,
peace
Liam

[recoznet2] Fall-out from article in SMH

1999-07-19 Thread Trudy and Rod Bray

ABC News:
Women's group raises doubts
 over some land claim evidence
 Tuesday 20 July, 1999 (11:53am AEST)

A rural women's lobby group wants answers from the
 Australian Anthropological Society regarding recent
allegations of dishonest and illegal activities by
anthropoligists relating to Aboriginal land claims.

Spokeswoman for the Regional Women's Alliance,
Lindsay MacDonald, said leaseholders are concerned by
recent media reports that some anthropologists are
fabricating and distoring evidence to ensure Aboriginal
 clients win land claim cases.

Mrs MacDonald said Australia's legal processes will be
undermined unless the Anthropological Society can
ensure all its members are acting with integrity and
 accountability.

"Fabricating eveidence which is going to influence a land
claim case is illegal," she said.

"Its up to the Anthropological Society to ensure the
public that its members are acting honestly and this
 practice is not going on."
