gnome-online-accounts: Permission to update the Google icon

Hello everybody,

Since Google recently changed their logo, Jimmac has created new icons
to match it: https://bugzilla.gnome.org/show_bug.cgi?id=754142

I would like to use these new icons in 3.18.

Not an issue from the documentation side, but have you checked that
you're complying with all of Google's requirements?

Jimmac created the icon, so maybe he took care to comply with the
requirements? I don't know.

Once upon a time the GNOME Foundation board (through Karen and the
SFLC) used to help with things like this, but recently I have had a
hard time evoking any response on matters like these. So, I have given
up.

Anyway, I looked at the Google Brand Permissions [1]. It looks very
restrictive on the surface and I am not sure what to make of it. eg., it
says [2]:
Q: "Google is sponsoring my event. Do I need permission to use the logo?"
A: We typically do not approve the use of our logo for events we sponsor. If
you're working with us on an event, please work with your Google contact to
obtain permission for an exception to this policy.

Given that I am used to seeing a big Google banner at GUADECs, I
wonder if we have some arrangement regarding this. Maybe the only way
forward is to file a formal request [3] and find out? I would be glad if
the board could help out with this.

Did the requirements significantly change compared to the old icon?
How did we solve this same issue back then?

As far as I am aware, we never did any legal review of the
icons. Maybe there are some established practices here that I am not
aware of? /me looks at jimmac

What we did do in the past was go through the terms of use of each
service provider before adding them to GNOME. This is what David
Zeuthen told me when he handed it over to me in early 2012. By then
Google was already there, and he was waiting for the legal review of
Facebook and Windows Live. Subsequently, I would contact Karen before
merging any new provider, and she would sometimes review it herself or
ask someone from SFLC to help.

Of late, it has been hard to evoke much response from the board on
these matters (presumably they were overburdened with other stuff).

I wrote this from memory, so I apologize if I am misrepresenting any
facts. If you want more details, I have to dig them up from my inbox.

Keeping in mind that I'm not a lawyer and that I'm expressing my own
personal opinion, given this information I would just go ahead and update
the icon, as our position with regards to Google would not change as a
consequence of the update.

As an aside, if you still have unresolved issues that require the attention

The board cannot answer if there is no ask.

Reading the guidelines, it looks like it's ok to use the trademark
because we're representing Google and are not modifying the logo.
(This is only something that Jacub can confirm, of course.) As far as
I can see, we do not even come close to any of their "don't"s.

This is a completely different case as they pay for a service (i.e.
having their logo displayed) and it is quite explicit that they are
buying this.

No. GOA was missing a size of the Google logo. GOA having already shipped
the old version of the logo, I only updated it to the current one, without
investigating any legal implications. I'll be happy to recreate the old
version of the logo, if that is the desired course of action.

Right. I already pushed the new icon to master (after creating a
gnome-3-18 branch). I will now cherry-pick it to other relevant
branches.

Ok. My understanding of the phrase "Google is sponsoring my event"
matched with "Google is sponsoring GUADEC", but I'll trust you.

I am not a lawyer, and I am way more incompetent than your usual
layman when it comes to reading legal documents.

What we get from them is essentially explicit permission. We can
actually seek this for the logo use for this case too, there's a link
at the bottom of the pageā€¦ but I think we'd be more successful if we
were to attempt to seek explicit permission via one of the open source
people at Google.

It has been brought to my attention that my message might have come across
as an approval of our usage of the logo.
To clear any possible misunderstanding, I want to reiterate that I was
expressing my personal opinion (and not the board's), and that I was
exclusively referring to the update of our existing icons to the new logo.

Ekaterina's point about making sure our usage is complying with Google's
trademark requirements still stands independently of which version of the
logo we use, and I agree it would be a good idea to seek an explicit
permission.

Is there any reason you would like the board to be handling that communication?
I think that as the GOA maintainer it would be appropriate for you to reach 
out. (Keeping in mind that of course the board is available to help if needed!)
